This is a hearing on H. R. 6180, a bill to amend the Federal Airport Act. It concerns the purchasing by air lines at airports. (H. R. 6180 and the report of the Department of Commerce are as follows:) [H. R. 6180, 80th Cong., 2d sess.] A BILL To amend the Federal Airport Act Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 11 of the Federal Airport Act is amended by the insertion, after paragraph-numbered (1) in that section, of a new paragraph to be numbered (2), reading as follows: "(2) every air carrier operating a scheduled service from such airport shall have the right to obtain and take delivery of, at the airport, from any person it may select, personal property of any nature (including, but not limited to, gasoline, fuel, propellants, lubricating oil, grease, parts, materials, food, beverages, and other materials, equipment, and supplies) without payment by said air carrier or person of any fees, charges, rentals, or payments of any kind, or taxes on or for the sale, purchase, use, storage, withdrawal from storage, dispensing, distribution, delivery of, or any similar activity with respect to, such property, except such charges, fees, or rentals as represent fair and reasonable compensation for the cost of any service rendered in connection therewith, and except for the payment of any tax which is imposed by the airport owner or operator upon business organizations generally in the taxing jurisdiction: Provided, however, That neither the air carrier nor said person shall be required to use any storage, dispensing, or delivery system, equipment or facilities, operated by, or under contract with, the airport owner or operator." and by the appropriate renumbering of the remaining numbered paragraphs in that section. CHAIRMAN: This letter is in reply to your communication of April 9, 1948, requesting the comments of the Department concerning H. R. 6180, a bill to amend the Federal Airport Act. This bill would amend the Federal Airport Act to provide that, as a condition precedent to his approval of a project under that act, the Civil Aeronautics Administrator shall receive assurance in writing from an airport sponsor that every air carrier operating a scheduled service from such projected airport shall have the right to obtain and take delivery of, at the airport, from any person it may select, personal property of any nature, without payment by the carrier of 1 |
