expenses incurred and to be incurred by the state for expert engineers, accountants, assistants, traveling expenses and other incidental expenses connected with the litigation between the state and the Cumberland Telephone and Telegraph Company relating to telephone rates. Said money shall be disbursed by the state treasurer upon itemized vouchers approved by the attorney general. No part of this appropriation shall be used for the payment of attorneys fees. Sec. 2. Be it enacted by the Legislature of the State of Mississippi, That the sum of $3,037.50 be and the same is hereby appropriated out of any money in the state treasury not otherwise appropriated to pay to Hathorn & Williams and Rawls & Hathorn, attorneys, for their fees as attorneys for the land commissioner in the suit of the state of Mississippi, ex rel. R. D. Moore, land commissioner, vs. Edward Hines Yellow Pine Trustees, and numbered 1313 of the general docket of the circuit court of Pearl River county, Mississippi, in which suit the sum of fifteen thousand one hundred and eighty seven dollars and fifty cents ($15,187.50) was recovered for the state of Mississippi, and has been paid into the state treasury, said attorneys having been employed by the land commissioner, with the consent of the governor, under the provisions of section 2903 of the Mississippi code of 1906. Provided no part of this amount shall be paid over until said suit is finally disposed of in the courts in favor of the state, and the amount shall not exceed twenty per cent of the amount collected.
