CHAPTER 82.

SENATE BILL No. 38.

AN ACT to authorize and direct the state treasurer to pay :o the board of oyster commissioners, twenty three thousand dollars ($23,000.00) out of the oyster fund, for each of the years 1922 and 1923, being the amount authorized to be expended under sections 3499 and 3506 of the code of 1906.

For support of the oyster commission.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the state treasurer be, and is hereby authorized and directed to pay to the board of oyster commissioners the sum of eight thousand dollars ($8,000.00) out of the oyster fund in the state treasury for each of the years 1922 and 1923 for expenses of enforcing chapter 102 of the Mississippi code of 1906 and amendments thereto; and the sum of fifteen thousand dollars ($15,000.00) or so much thereof as may be available, out of said oyster fund for each of the years 1922 and 1923 for the purpose of improving oyster reefs, spreading the shells, and making new bottoms as provided in section 3499 of the Mississippi code of 1906 and amendments thereto; provided, however, that the board of cyster commissioners shall not expend more than the amount of the revenue paid into the oyster fund if said amount does not equal the amounts appropriated; and all sums of money received by them in excess of the sums herein appropriated shall be turned into the general fund of the state.

Sec. 2. That this act take effect and be in force from and after its passage.

CHAPTER 83.

HOUSE BILL No. 130.

AN ACT making an appropriation of eighty thousand dollars in the aid and maintenance of the harbor and channel of the port of Gulfport.

Gulfport harbor-for aid and maintenance of.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That there is hereby appropriated out of any money in the state treasury not otherwise appropriated, the sum of forty thousand dollars ($40,000.00) for the year of 1922 and the sum of forty thousand dollars ($40,000.00) for the year of 1923, for the aid and maintenance of the harbor and channel of the port of Gulfport, provided the war department shall allot an amount of not less

than provided for herein, and, provided, that the city of Gulfport and Harrison county shall appropriate the sum of $5,000.00 each for the years 1922 and 1923, and provided the money so appropriated out of the state treasury shall be drawn and expended only according to the port commissioners of the city of Gulfport, three members thereof to be appointed by the governor by and with the advice of the Senate. They shall see that the funds are used in conjunction with federal fund appropriated by the war department for dredging the harbor and channel.

How funds to be drawn from treasury.

Sec. 2. The funds hereby appropriated shall be drawn from the state treasury on warrants of the auditor of the state therefor, which shall be issued by him only by certificate of said port commissioners, which certificate shall be approved by the governor. Itemized statement of disbursements required.

Sec. 3. The port commissioners shall prepare and submit a detail statement of all disbursements made by them to the governor on or before the first day of January, 1924, which statement shall be transmitted to the legislature by the governor at the session held in 1924.

Sec. 4. That this act take effect and be in force from and after its passage.

CHAPTER 84.

SENATE BILL NO 25.

AN ACT to make an appropriation to carry out the provisions of sections 2927, 2947, 2948, 2949, 4346, 4347, 4348, 4349 of the code of Mississippi of 1906, providing for the relief in repayment of money erroneously paid in privileges and state taxes and lands purchased.

To provide for refund of erroneous payment of taxes etc.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of $25,000.00, or so much thereof as may be necessary, for the years 1922 and 1923, is hereby appropriated out of any monies in the state treasury not otherwise appropriated, to carry out the provisions of sections 2927, 2947, 2948, 2949, 4346, 4347 4348, 4349 of the code of laws of the state of Mississippi, providing, for the relief in payment of erroneously paid privileges and state taxes and in land purchased, and saving the state cost in passing bills for relief by local and private legislation in certain cases, provided, no portion of said amounts shall be paid on account of

land obtained or claims for money paid under any patent or certificate heretofore issued by any secretary of state of the State of Mississippi.

For refunding privileges and state taxes.

Sec. 2. That $12,500.00 of the above amount shall be used to refund privileges and state taxes erroneously paid into the state treasury on account of lands purchased as provided in Section 1 of this act.

Sec. 3. That this act take effect and be in force from and after its passage.

CHAPTER 85.

HOUSE BILL No. 801.

AN ACT making an appropriation to refund taxes erroneously paid into the state treasury during the years 1920 and 1921 for which claims have been filed in the state auditor's office and approved by the attorney general and for which there was a deficit in the appropriations for said years.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of five thousand dollars, or SO much thereof as may be necessary, be, and the same is hereby appropriated out of any funds in the state treasury not otherwise appropriated to refund taxes erroneously paid into the state treasury during the years 1920 and 1921, for which claims have been filed in the state auditor's office and approved by the attorney general and which have not been paid on account of a deficit in the appropriations for the said years of 1920 and 1921.

Sec. 2. That this act take effect and be in force from and after its passage.

CHAPTER 86.

HOUSE BILL No. 797.

AN ACT to appropriate money to pay the principal and interest on state obligations maturing during the biennial period 1922 and 1923. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the following sums of money, or so much thereof as may be necessary, be, and the same are hereby appropriated out of any money in the state treasury, not otherwise appropriated,

for the purpose of paying the principal and interest on bonds maturing during the years 1922 and 1923 and 1924.

AN ACT to appropriate the sum of $104,833.15, or SO much thereof as may be necessary to pay and retire the notes executed by the governor of Mississippi to cover amounts loaned to the State Charity Hospital, of Jackson, Mississippi, the Blind Institute, of Jackson, Mississippi, and fo the relief of Braxton cyclone sufferers.

To pay money Borrowed by governor for Charity Hospital.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That there is hereby appropriated out of any money in the state treasury not otherwise appropriated, the sum of $104,833.15, to pay the principal and interest on certain notes executed by the governor of Mississippi to the Merchants Bank & Trust Company, of Jackson, Mississippi, as follows:

Said notes bearing interest from their dates at the rate of 6% per annum and the said amounts having been borrowed by the governor of Mississippi for the State Charity Hospital on account of the act providing for the support of said institution passed at the last session of the legislature having been declared void by the courts; for the Blind Institute on account of the destruction of the roof of the building and other damage done by a wind storm; and for the Braxton relief fund on account of the destruction of that town by a cyclone.

How payments to be made.

Sec. 2. That the payment of said notes and the interest on the same to the date of the payment thereof, shall be made by the state treasurer upon surrender of said notes and the state treasurer shall make requisition upon the auditor of public accounts for his warrants after payment of the notes shall have been made; and the auditor of public accounts is hereby authorized and directed to issue his warrants covering the amount of the notes so paid.

Sec. 3. That this act take effect and be in force from and after its passage.
