1 standards prescribed and in effect under this title and shall 2 furnish the Attorney General and, when appropriate, the 3 Secretary of the Treasury any information obtained and test 4 results indicating noncompliance with such standards, for 5 appropriate enforcement or customs action.

6 (b) For purposes of enforcement of this title, officers or 7 employees duly designated by the Secretary, upon presenting 8 appropriate credentials and a written notice to the owner, 9 operator, or agent in charge, are authorized (1) to enter, at 10 reasonable times, any factory, warehouse, or establishment in 11 which motor vehicles or items of motor vehicle equipment are 12 manufactured, or held for introduction into interstate comB3 merce or are held for sale after such introduction; and (2) 14 to inspect, at reasonable times and within reasonable limits and 15 in a reasonable manner, such factory, warehouse, or establishment. Each such inspection shall be commenced and completed with reasonable promptness,

(e) Every manufacturer of motor vehicles and motor 19 vehicle equipment shall establish and maintain such records, make such reports, and provide such information as the 21 Secretary may reasonably require to enable him to deter

mine whether such manufacturer has acted or is acting in 23 compliance with this title and motor vehicle safety stand24 ards prescribed pursuant to this title and shall, upon request

of an officer or employee duly designated by the Secretary,

1 permit such officer or employee to inspect appropriate books,

papers, records, and documents relevant to determining

3 whether such manufacturer has acted or is acting in com4 pliance with this title and motor vehicle safety standards 5 prescribed pursuant to this title.

6 (d) All information reported to or otherwise obtained by 7 the Secretary or his representative pursuant to subsection (b) 8 or (c) which information contains or relates to a trade secret 9 or other matter referred to in section 1905 of title 18 of the 10 United States Code, shall be considered confidential for the 11 purpose of that section, except that such information may be 12 disclosed to other officers or employees concerned with car13 rying out this Act or when relevant in any proceeding under 14 this Act.

CERTIFICATION

SEC. 115. Every manufacturer or distributor of motor 17 vehicles or motor vehicle equipment shall furnish to the dis18 tributor or dealer at the time of delivery of such vehicle or 19 equipment of such manufacturer or distributor a certification 20 that each such vehicle or item of motor vehicle equipment con21 forms to all applicable Federal motor vehicle safety stand22 ards. Such certification may be in the form of a label or tag 23 on such vehicle or item of equipment or on the outside of a 24 container, if any, in which such items of equipment are 25 delivered.

NOTIFICATION

SEC. 116. (a) Every manufacturer of motor vehicles

3 shall furnish notification of any defect in any motor vehicle 1 or motor vehicle equipment produced by such manufacturer 5 which he determines, in good faith, relates to motor vehicle 6 safety, to the purchaser (where known to the manufacturer) 7 of such motor vehicle or motor vehicle equipment, within a 8 reasonable time after such manufacturer has discovered such 9 defect.

(b) The notification required by subsection (a) shall 11 be accomplished

(1) by certified mail to the first purchaser (not including any dealer of such manufacturer) of the motor vehicle or motor vehicle equipment containing a defect; and

(2) by certified mail or other more expeditious means to the dealer or dealers of such manufacturer to whom such motor vehicle or equipment was delivered.

(c) The notification required by subsection (a) shall 20 contain a clear description of the defect, an evaluation of the 21 risk to traffic safety reasonably related to the defect, and a 22 statement of the measures to be taken to repair the defect. 23 (d) Every manufacturer of motor vehicles shall furnish 24 to the Secretary a true or representative copy of all notices, 25 bulletins, and other communications to the dealers of such

1 manufacturer or purchasers of motor vehicles or motor vehi2 cle equipment of such manufacturer regarding any defect in 3 such vehicle or equipment sold or serviced by such dealer. 4 The Secretary shall disclose so much of the information con5 tained in such notice or other information obtained under 6 subsection 114(a) to the public as he deems will assist in 7 carrying out the purposes of this Act, but he shall not disclose

any information which contains or relates to a trade secret

9 or other matter referred to in section 1905 of title 18 of the 10 United States Code unless he determines that it is necessary 11 to carry out the purposes of this Act.

(c) If through testing, inspection, investigation, or re13 search carried out pursuant to this title, or examination of 14 reports pursuant to subsection (d) of this section, or other15 wise, the Secretary determines that any motor vehicle or item 16 of motor vehicle equpiment—

(1) does not comply with an applicable Federal motor vehicle safety standard prescribed pursuant to sections 102 and 103; or

(2) contains a defect which relates to motor vehicle safety;

22 then he shall immediately notify the manufacturer of such 23 motor vehicle or item of motor vehicle equipment of such de24 fect or failure to comply. The notice shall contain the findings 25 of the Secretary and shall include all information upon

1 which the findings are based. The Secretary shall afford 2 such manufacturer an opportunity to present his views and 3 evidence in support thereof, to establish that there is no failure 4 of compliance or that the alleged defect does not affect motor 5 vehicle safety. If after such presentation by the manufac 6 turer the Secretary determines that such vehicle or item of 7 equipment does not comply with applicable Federal motor 8 vehicle safety standards, or contains a defect which relates 9 to motor vehicle safety, the Secretary shall direct the manu10 facturer to furnish the notification specified in subsection (c) 11 of this section to the purchaser of such motor vehicle or item 12 of motor vehicle equipment as provided in subsections (a) 13 and (b) of this section.

USED MOTOR VEHICLE INSPECTION STUDY

SEC. 117. (a) In order to assure a continuing and 16 effective national traffic safety program, it is the policy of 17 the Congress to encourage and strengthen the enforcement of 18 State inspection of used motor vehicles.

(b) The Secretary shall conduct a thorough study and 20 investigation to determine the adequacy of motor vehicle 21 safety standards and motor vehice inspection requirements 22 and procedures applicable to used motor vehicles in each 23 State, and the effect of programs authorized by this Act 24 upon such standards, requirements, and procedures for used
