1 (4) Officers, employees, and special Government em2 ployees of joint committees of the Congress, the Architect 3 of the Capitol, Botanic Garden, Library of Congress, Govern4 ment Printing Office, Congressional Budget Office, Office of 5 Technology Assessment, General Accounting Office, and 6 Cost Accounting Standards Board shall file such report with 7 the Secretary of the Senate not later than May 15 of each 8 year. Each such individual shall file a copy of such report 9 with the head of the agency in which such individual occu10 pies any office or position at the same time such report is 11 filed with the Secretary of the Senate.

(5) The head of each agency, and each Presidential 13 appointee in the Executive Office of the President who is not 14 subordinate to the head of an agency in the Executive Office, 15 appointed by the President, shall file such report with the 16 Chairman of the Civil Service Commission not later than 17 May 15 of each year.

(6) The President may exempt any individual in the 19 Central Intelligence Agency, the Defense Intelligence Agency, or the National Security Agency, or any individual en21 gaged exclusively in intelligence activities in any agency of 22 the United States from the requirement to file a report with 23 the Civil Service Commission if the President finds that, due 24 to the nature of the office or position occupied by such indi25 vidual, public disclosure of such report would reveal the

1 identity of an undercover agent of the Federal Government. 2 Each individual exempted by the President from such re3 quirements shall file such report with the head of the agency 4 in which he occupies an office or position or, if an individual 5 described in paragraph (5), with the Chairman of the Civil 6 Service Commission.

7 (b) (1) Each individual required to file a report under 8 section 4 (b) as a candidate shall file such report with the 9 Federal Elections Commission within one month after such 10 individual becomes a candidate and on May 15 in any suc11 ceeding year if such individual is a candidate on such date. (2) Each individual required to file a report under sec13 tion 4 (b) (5) as a Presidential nominee shall file such re14 port with the Federal Elections Commission and with the 15 appropriate committees of Congress within ten days after 16 the nomination is submitted.

17 (c) (1) Any individual who ceases prior to May 15 of 18 any calendar year to occupy the office or position the occu19 pancy of which imposes upon him the reporting requirement 20 contained in section 4 (a) shall file such report for the pre21 ceding calendar year and the period of such calendar year 22 for which he occupies such office or position on or before 23 May 15 of such calendar year.

24 (2) Any individual who ceases to occupy such office or 25 position after May 15 of any calendar year shall file such 26 report for the period of such calendar year which he occupies

such office or position on the last day he occupies such office 2 or position.

(d) The Chairman of the Civil Service Commission, the Director of the Administrative Office of the United States

5 Courts, the Secretary of the Senate and the Clerk of the

6 House may grant one or more reasonable extensions of time

7

for filing any report but the total of such extensions shall not 8 exceed ninety days.

(e) The Chairman of the Civil Service Commission, the Director of the Administrative Office of the United States 11 Courts, the Secretary of the Senate and the Clerk of the 12 House shall promulgate such rules and regulations as are re13 quired to carry out the provisions and purposes of this title 14 no later than sixty days after the date of the enactment 15 of this Act.

16 FAILURE TO FILE OR FALSIFYING REPORTS: PROCEDURE 17 SEC. 7. (a) (1) Any individual who knowingly and 18 willfully falsifies or fails to report any information such in19 dividual is required to report under section 5 shall be fined 20 in any amount not exceeding $10,000, or imprisoned for not 21 more than one year, or both.

(2) The Attorney General may bring a civil action in 23 any district court of the United States against any individual 24 who fails to file a report which such individual is required to

1 file under section 4 or who fails to report any information 2 which such individual is required to report under section 5. 3 The court in which such action is brought may assess against 4 such individual a penalty in any amount not to exceed 5 $5,000.

6 (b) The head of each executive agency, the Clerk of 7 the House of Representatives with respect to any Member, 8 officer, or employee of the House of Representatives, the 9 Secretary of the Senate with respect to any Member, officer or employee of the Senate, or of agencies in the legislative 11 branch named in section 6 (a) (4) and the Director of the 12 Administrative Office of the United States Courts with re13 spéct to any justice, judge, officer, or employee of any court 14 of the United States shall submit annually to the Congress a complete list of individuals who are required to file a report 16 under section 4 and shall submit at the close of each calendar

quarter a list of individuals who have begun or have term18 inated employment with such agency, the House of Repre19 sentatives or the Senate, or any court in such calendar

20 quarter.

(c) The President, the Vice President, either House of 22 Congress, the Director of the Administrative Office of the 23 United States Courts, the head of each agency, or the Civil 24 Service Commission may take any appropriate personnel or

1 other action against any individual failing to file a report

2 or information or falsifying information.

3 CUSTODY AND AUDIT OF, AND PUBLIC ACCESS TO REPORTS SEC. 8. (a) Officers of the executive, legislative and 5 judicial branches of the Government with whom reports are 6 filed under provisions of section 4 shall, with due regard for 7 the right of privacy of persons required to file reports, re8 lease such reports for public disclosure under the following 9 conditions:

(i) The requestor shall present a written request which shall state his name and address and the name and

addresses of the person or organization, if any, on whose behalf he is making the request.

(ii) The request shall state the reason for the request; the purpose for which the disclosure statement will be used, and the basis upon which the requestor

believes the report contains information indicating the existence of a conflict of interest or potential conflict of interest.

(iii) At the time the report is made available the person with whom the report is filed shall notify the individual whose report has been made available. Such notification shall include a copy of the written request for

the report.
