(D) greater than $50,000, but not more than

$100,000, or

(E) greater than $100,000.

(2) Each individual shall report the actual amount or

(c) For purposes of paragraphs (1) through (6) of 8 subsection (a), an individual shall include each item of 9 income or reimbursement and each gift received, each item

10 received in kind, each asset held, each liability owed, each 11 transaction in commodities futures and in securities, each 12 purchase or sale of real property or interest in any real 13 property, and each patent right or interest in any patent 14 right held by him, his spouse, or any of his dependents, or 15 by him and his spouse or dependents jointly, or by any 16 person acting on his behalf or for his benefit.

FILING OF REPORTS

18 SEC. 5. (a) (1) Each individual required to file a 19 report under section 3 (a), other than a candidate, a Presi20 dential nominee, or an individual excepted under paragraph 21 (4) of this subsection, shall file such report with the Comp22 troller General not later than May 15 of each year. Each 23 such individual, other than the President, Vice President, a 24 Member of Congress, a justice or judge of the United States,

1 any officer or employee of the Senate or the House of 2 Representatives or any court of the United States, the head 3 of each agency, each Presidential appointee in the Executive 4 Office of the President who is not subordinate to the head 5 of an agency in the Executive Office, or each full-time 6 member of a committee, board, or commission appointed 7 by the President, shall file a copy of such report with the 8 head of the agency in which such individual occupies any 9 office or position at the same time as such report is filed with 10 the Comptroller General.

(2) Each Member, officer, and employee of the House 12 of Representatives and the Senate required to file a report 13 under section 3 (a) shall file a copy of such report with 14 the Clerk of the House of Representatives and the Secretary 15 of the Senate, respectively, and each justice, judge, officer, 16 and employee of any court of the United States shall file a 17 copy of such report with the Director of the Administra18 tive Office of the United States Courts at the same time as 19 such report is filed with the Comptroller General. 20 (3) The head of each agency, each Presidential ap21 pointee in the Executive Office of the President who is not 22 subordinate to the head of an agency in the Executive Office, 23 and each full-time member of a committee, board, or com24 mission appointed by the President, shall file a copy of such 25 report with the Chairman of the Civil Service Commission at

1. the same time such report is filed with the Comptroller

(4) The President may exempt any individual in the 4 Central Intelligence Agency, the Defense Intelligence

5

Agency, or the National Security Agency, or any individual 6 engaged exclusively in intelligence activities in any agency 7 of the United States from the requirement to file a report 8 with the Comptroller General if the President finds that, due

to the nature of the office or position occupied by such indi10 vidual, public disclosure of such report would reveal the 11 identity of an undercover agent of the Federal Government. 12 Each individual exempted by the President from such re13 quirements shall file such report with the head of the agency 14 in which he occupies an office or position or, if an individual 15 described in paragraph (3), with the Chairman of the Civil 16 Service Commission.

17 (b) (1) Each individual required to file a report under 18 section 3 (b) as a candidate shall file such report with the 19 Comptroller General within one month after such individual 20 becomes a candidate and on May 15 in any succeeding year 21 if such individual is a candidate on such date. 22 (2) Each individual required to file a report under 23 section 3 (b) (5) as a Presidential nominee shall file such 24 report with the Comptroller General and with the appropri25 ate committees of Congress within ten days after the nomi26 nation is submitted.

(c) (1) Any individual who ceases prior to May 15 of any calendar year to occupy the office or position the occu

pancy of which imposes upon him the reporting requirement contained in section 3 (a) shall file such report for the pre5 ceding calendar year and the period of such calendar year 6 for which he occupies such office or position on or before 7 May 15 of such calendar year.

(2) Any individual who ceases to occupy such office

or position after May 15 of any calendar year shall file such

report for the period of such calendar year which he occupies 11 such office or position on the last day he occupies such 12 office or position.

(d) The Comptroller General may grant one or more 14 reasonable extensions of time for filing any report but the 15 total of such extensions shall not exceed ninety days. 16 (e) The Comptroller General shall promulgate such 17 rules and regulations as are required to carry out the provi18 sions and purposes of this title no later than sixty days after 19 the date of the enactment of this Act,

20 FAILURE TO FILE OR FALSIFYING REPORTS; PROCEDURE SEC. 6. (a) (1) Any individual who knowingly and 22 willfully falsifies or fails to report any information such 23 individual is required to report under section 4 shall be 24 fined in any amount not exceeding $10,000, or imprisoned 25 for not more than one year, or both.

(2) The Attorney General may bring a civil action in

district court of the United States against any individual 3 who fails to file a report which such individual is required to 4 file under section 3 or who fails to report any information 5 which such individual is required to report under section 4. 6 The court in which such action is brought may assess against 7 such individual a penalty in any amount not to exceed 8 $5,000.

9 (b) The head of each agency, the Clerk of the House of 10 Representatives with respect to any Member, officer, or em11 ployee of the House of Representatives, the Secretary of the 12 Senate with respect to any Member, officer or employee of 13 the Senate, and the Director of the Administrative Office of 14 the United States Courts with respect to any justice, judge, 15 officer, or employee of any court of the United States shall 16 submit annually to the Comptroller General a complete list 17 of individuals who are required to file a report under sec18 tion 3 and shall submit at the close of each calendar quarter 19 a list of individuals who have begun or have terminated 20 employment with such agency, the House of Representatives 21 or the Senate, or any court in such calendar quarter.

(c) The Comptroller General shall refer to the Attorney 23 General the name of any individual the Comptroller General 24 has reasonable cause to believe has failed to file a report or 25 has falsified or failed to file information required to be re
