Part 6-Forms for Coordinated Procurement

16-600 Scope of Part. This Part prescribes forms to be used by a requiring Department to request that supplies or nonpersonal services be procured by another Department or agency in accordance with the provisions of Section V, Part 11.

16-601 Military Interdepartmental Purchase Request (MIPR) (DD Form 448) and Standard Form 36. DD Form 448 shall be used by the requiring Departments

to:

(i) request the procurement of supplies or nonpersonal services by the procuring department or agency, and

(ii) permit the procuring department or agency to authorize manufacture of the necessary supplies.

DD Form 448 is authorized for use in effecting other types of coordinated procurement pursuant to Section V, Part 11. When a continuation sheet is necessary, Standard Form 36 shall be used.

16-602 Acceptance of MIPR (DD Form 448-2). DD Form 448-2 shall be used by the procuring department to notify the requiring department of the action taken or to be taken upon a MIPR.

16-603 Requisition for Coal, Coke, or Briquettes (DD Form 416). DD Form 416 shall be used in lieu of DD Form 448 by the requiring departments to request the procurement of coal, coke, or fuel briquettes by the procuring department.

16-604 Requisition and Invoice/Shipping Document (DD Form 1149). DD Form 1149 is prescribed for use in accordance with 5-1108.1 and 24–301.5.

Part 7-Contract Termination Forms

16-700 Scope of Part. This Part prescribes forms for use in connection with terminated contracts (see Section VIII).

16-701 Notices of Termination. Use of Standard Form 30 (Amendment of Solicitation/Modification of Contract) is prescribed in 16-103(b)(iii) for notices of termination. Appropriate texts of telegraphic and confirming notices of termination which may be used are set forth in 8-801.1 and 8-801.2. Regardless of the format used in issuing termination notices, a supplementary PII number shall be employed to identify the action in accordance with 20-204.

16-702 Settlement Proposal Forms. Although the forms prescribed below are designed for use by prime contractors, they are equally suitable for use by sub

contractors.

16-702.1 Settlement Proposal-Inventory Basis (DD Form 540). DD Form 540 is prescribed for use by contractors in presenting claims resulting from the termination of fixed-price contracts when such claims are computed on the inventory basis.

16-702.2 Settlement Proposal-Total Cost Basis (DD Form 541). DD Form 541 is prescribed for use by contractors in presenting claims resulting from the termination of either fixed-price or cost-reimbursement type contracts when such claims are computed on the total cost basis.

16-702.3 Settlement Proposal for Cost-Reimbursement Type Contracts (DD Form 547). DD Form 547 is prescribed for use by contractors in submitting claims resulting from the termination of cost-reimbursement type contracts.

16-702.4 Settlement Proposal (Short Form) (DD Form 831). DD Form 831 is authorized for use by contractors in submitting claims resulting from the termination of fixed price contracts when the total claim is less than $10,000.

16-702.5 Inventory Schedules (DD Forms 542, 543, 544, 545, and 832). The DD Form 832 (Termination Inventory Schedule E-Short Form) is prescribed for use by contractors to support settlement proposals submitted on DD Form 831. For other inventory schedule forms to support settlement proposals submitted on DD Forms 540, 541, and 547, see 16-818.

16–702.6 Schedule of Accounting Information (DD Form 546). DD Form 546 is prescribed for use by contractors in connection with settlement proposals (see 8-307.1).

16-703 Application for Partial Payment (DD Form 548). DD Form 548 is prescribed for use by contractors when applying for partial payments (see 8-213.1(a)).

16-704 Reserved.

16-705 Forms of Settlement Agreement. Use of Standard Form 30 (Amendment of Solicitation/Modification of Contract) is prescribed in 8-210 for termination settlement agreements. Appropriate texts are set forth in 8–805.

16-706 Instructions for Use of Termination Forms. DD Form 1114 consists of instructions for the use of contract termination settlement and inventory schedule forms.

Part 8-Miscellaneous Forms

16-800 Scope of Part. This Part prescribes miscellaneous forms, other than contract forms, for use in connection with the procurement of supplies and services.

16-801 Statement and Certificate of Award (Standard Form 1036).

(a) Standard Form 1036 (Statement and Certificate of Award), which briefly recites the circumstances relating to contract awards, shall be executed by the contracting officer in connection with all contracts entered into after formal advertising, as required by 2-407.7.

(b) At the option of the contracting officer, a Standard Form 1036 may be prepared either:

(i) for each individual award, in which case the Standard Form 1036, will be retained in the contract file; or

(ii) for each invitation for bids which results in multiple awards, provided:

(A) an original Standard Form 1036 is signed by the contracting officer;

(B) the invitation number is shown in the upper right corner of the Standard Form 1036 in lieu of a contract number;

(C) the Standard Form 1036 identifies each contract awarded under that invitation, as well as including information required by 2-407.7;

(D) the signed Standard Form 1036 is retained in the contract file with the first contract awarded and the other contracts retained

in the contract files contain on their face the words 'Standard Form 1036 filed with Contract Number ...................`

16-802 Contractor's Statement of Contingent or Other Fees (Standard Form 119). Standard Form 119 is prescribed for use in accordance with 1-507 through 1-510.

16-803 Compliance With Labor Laws, Regulations, and Clauses.

16-803.1 Construction Contracts.

(a) Standard Form 308 (Request for Determination and Response to Request) shall be used, in accordance with the provisions of 18-704.2, for the submission of requests for the determination of wage rates by the Secretary of Labor.

(b) Standard Form 1093 (Schedule of Withholdings under the Davis-Bacon Act), shall be used, in accordance with the provisions of 18-704.13, to report deductions against payment vouchers of contractors on account of failure to comply with labor laws, regulations, and clauses. To facilitate the work of contracting agencies in computing underpayments (and where applicable, Eight-Hour Laws penalties) in investigation reports involving apparent violations of the Davis-Bacon and related Acts, the Department of Labor has developed and will furnish, on request, Form SOL-164 "Wage Computation and Transcription Sheet." Use of this form is optional; its use will also facilitate review of investigation reports.

(c) (1) The weekly payroll statement required by the contract clauses prescribed by 18-703.1 or 18-703.3 shall be in one of the following forms:

(i) “Payroll (For Contractor's Optional Use)," Form WH-347 (1 / 68) U. S. Department of Labor.

(ii) "Statement of Compliance," DD Form 879.

(iii) The contractor's own combined payroll-statement form, provided the statement is produced in exactly the language of Form WH-347 or DD Form 879 and the signer certifies on the statement: "The language of this statement is exactly the language ɔ................

(2) A supply of DD Forms 879 may be furnished to the contractors for their use. Forms WH-347 may be purchased from the Government Printing Office.

(d) Department of Labor Form WH 1321, Notice to Employees Working on Federal or Federally Financed Construction Projects, shall be furnished to the contractor in accordance with 18-704.2(j).

16-803.2 Supply Contracts. Department of Labor WH Publication 1313, Notice to Employees Working on Government Contracts, shall be furnished to the contractor in accordance with the provisions of 12–604.

16-803.3 Service Contracts.

(a) Notice of Intention To Make a Service Contract and Response to Notice (Standard Form 98). Standard Form 98 is prescribed for use in accordance with 12-1005.2(a).

(b) Notice of Award of Contract (Standard Form 99). Standard Form 99 is prescribed for use in accordance with 12-1005.5(a).

16-804 United States Government Tax Exemption Certificate (Standard Form 1094). Standard Form 1094 will be used in accordance with Section XI, Part 5.

16-805 Bond Forms. The bond forms listed below are available for use in accordance with Departmental procedures. (See Section X, Parts 1 and 2.)

(i) Bid Bond (Standard Form 24).

(ii) Annual Bid Bond (Standard Form 34).
(iii) Performance Bond (Standard Form 25).
(iv) Payment Bond (Standard Form 25-A).

(v) Continuation Sheet for Standard Forms 24, 25 and 25-A (Standard
Form 25-B).

(vi) Affidavit of Individual Surety (Standard Form 28).

(vii) Annual Performance Bond (Standard Form 35).

(viii) Performance Bond Form for Subcontracts (see 10–103.3(a)).

KNOW ALL MEN BY THESE PRESENTS, That we, the PRINCIPAL and SURETY above named, are held and firmly bound unto the Obligee above named in the amount of the penal sum stated above, for the payment of which sum well and truly to be made, we bind ourselves, our heirs, executers, administrators, successors, and assigns, jointly and severally, firmly be these presents.

WHEREAS, the Obligee and Principal have entered into a certain contract identified above, which contract is by reference made a part hereof and is hereinafter referred to as the contract. NOW, THEREFORE, the condition of this obligation is such that if the Principal shall well and truly perform and fulfill all the undertakings, covenants, terms, conditions, and agreements of said Contract, then this obligation shall be null and void; otherwise to remain in full force and virtue. 1. The Contract includes all duly authorized modifications and extensions thereof, with or without notice to the Surety and extends to any guaranty required by the terms thereof.

2. The rights of the Obligee hereunder may be assigned to the United States of America or a Department or Agency thereof, and without in any manner invalidating or qualifying this instrument. Notice of assignment shall be given the surety within a reasonable time, but a failure of notice shall not affect the validity of this bond or the assignment.
