PORT AND TERMINAL SERVICES AND CHARGES

PILOTAGE

Vessels destined to Chester and other points on the Delaware River are,

under the laws of Pennsylvania and Delaware, subject to the following pilotage rules and charges:

Vessels subject to pilotage.- Every ship or vessel arriving from or bound to any foreign port or place is obliged to receive a pilot, except American vessels solely laden with coal mined in the United States; provided that a ship or vessel inward bound to any port or place on the River Delaware, which is not spoken or offered the services of a pilot outside a straight line drawn from Cape May Light to Cape Henlopen Light, is exempt from the duty of taking a pilot, as well as from the duty of paying pilotage, or any penalty whatsoever. Vessels exempt from pilotage.- All ships or vessels employed in or licensed for the coasting trade, having on board a pilot duly licensed to operate in these waters by the Federal Government, are exempt from the duty of employing a pilot or paying pilotage, or any penalty whatsoever, but any ship or vessel voluntarily taking a pilot shall pay the same fees for pilotage as are prescribed in case of a vessel bound to or from a foreign port.

Delaware Breakwater pilotage. Every ship or vessel liable to pilotage bound to the Delaware Breakwater for orders is obliged to receive a pilot provided she is spoken or a pilot offers his services outside of a straight line drawn from Cape Henlopen Light or Cape May Light. Every ship or vessel shall pay as a fee a sum equal to half the pilotage to the port of Philadelphia. Vessels shall also be obliged to receive a pilot and pay the same pilotage fees when outward bound from the breakwater, if such ship or vessel, without discharging her

pilot, proceed to the port of Philadelphia, or any other port or place on the Bay or River Delaware, only one full pilotage fee shall be paid; provided, however, that if the pilot bringing such ship or vessel to the breakwater be there discharged, and the ship or vessel afterward proceeds to Philadelphia or any other port or place on the Bay or River Delaware, she shall make the usual signal for a pilot and continue to make such signal until reaching Brandywine Light, and if spoken by or offered the service of a duly licensed Pennsylvania pilot, before reaching the Brandywine Light, shall be obliged to employ such pilot and pay him regular rates in addition to the fee paid for bringing her into the breakwater.

Pilotage fees.- Pilotage fees are based on a charge of $2 per half foot for vessels drawing 12 feet or less, and $3 per half foot for vessels drawing over 12 feet. An increase of 10 percent over these fees is charged when a vessel is spoken east of Five Fathom Bank Lightship or north of Hereford Inlet Lighthouse, or south of Fenwick Island Lighthouse, and a deduction of 10 percent is made when a vessel is spoken inside of a line joining Cape May and Cape Henlopen Lighthouses.

TOWAGE

A large fleet of tugs, operating from the port of Philadelphia, is available at any time of the day or night for any type service required. Although several operators limit their activities to ports within the Philadelphia port area most of the companies include the entire Delaware River and Bay, and tributary waters in their zone of operations. Some companies also have tugs available for deep-sea towing.

The following standard rates, terms and conditions are generally quoted by tugboat companies basing at Philadelphia for services rendered between Wilmington, Delaware, and Trenton, New Jersey, and within the port area. Charges for services performed by the towing company which are not provided for in the tariff are generally determined by mutual agreement between the towing company and the vessel or its agent on a contract or time basis.

As a general rule tugs are not required by vessels moving between Philadelphia and the sea. Most vessels traverse this distance under their own power. Schedule of rates, terms and conditions effective on March 30, 1948:

2. For all services on Sundays and holidays each tug shall be paid one hundred percent additional to all the rates and charges in this schedule applying to the particular services. Sunday or holiday work shall be optional with the tugs and their owners, agents and charterers who shall not be liable for any inability or refusal whatsoever to perform Sunday or holiday work or for any delay or loss to vessel and concerned resulting from the same.

3. If tugs are ordered into service by or in behalf of a vessel for a movement or service expected to be performed, and the movement or service is not performed or required by the vessel, the tugs shall be paid at the rates is this schedule applying to the particular services, the same as if the tugs had performed the services.

4. Holidays included in the above are as follows: New Year's Day, Washington's Birthday, Good Friday, Memorial Day, Independence Day, Labor Day, Armistice Day, Thanksgiving Day, and Christmas Day. Should any of these holidays fall on a Sunday, then the following Manday shall be considered as the holiday.

5. For all tug services in this schedule before 8 a.m. and after 4 p.m., there will be an additional charge of $15.00 (fifteen dollars) per hour overtime for each tug including running time to and from tug station, in addition to the regular rates. Overtime charges are to accumulate from 4 p.m., until tugs return to tug station. If tugs are required to come into service after 12 midnight, then the tug's overtime is to be accumulated until 8 a.m. including Sundays and holidays.

6. For assisting a vessel without power between points as outlined in paragraph 1, the rate shall be $25.00 (twenty-five dollars) per hour for each tug required. The total minimum charge to be not less than the docking and undocking charge per tug at the particular points, time chargeable to include, in addition, the running time of tug from and to tug stations at Philadelphia.

7. For attendance services or furnishing steam to a vessel, the rate shall be $25.00 (twenty-five dollars) per hour for each tug. Time chargeable to include in addition the running time of each tug and to tug stations at Philadelphia. Overtime to be additional at the rates specified in paragraph 5.

8. If tugs are sent to render services to a vessel and the vessel has not arrived or for any cause is not ready, detention of the tugs while waiting shall be paid at the rate of $25.00 (twenty-five dollars) net per hour
