WEATHER MODIFICATION

U.S. SENATE,

COMMITTEE ON COMMERCE.

The committee met at 10 a.m. in the Safari Room (building 7), Hotel Sahara, Las Vegas, Nev., the Honorable Howard W. Cannon presiding.

Senator CANNON. Gentlemen, the hearing will come to order.

The Senate Commerce Committee today is beginning its formal hearing on S. 23, which would authorize a program in five arid areas of the United States to increase usable precipitation.

(The bill follows:)

A BILL To direct the Secretary of the Interior to conduct a program in five areas of the United States to increase usable precipitation, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of the United States of America in Congress assembled, That the Secretary of the Interior, acting in cooperation with the National Science Foundation, shall initiate and carry out a program which is directed at increasing in substantial degree the annual average usable supply of water from rainfall and snowfall in areas of the United States where such increase would be beneficial.

SEC. 2. In the formulation of the program authorized in this Act the Secretary of the Interior and the National Science Foundation shall advise and consult with the Governors of the States to be affected by any such program, and shall not initiate any such program within a State without the approval of the Governor of such State.

SEC. 3. In order to carry out the provisions of this Act

(1) the Secretary of the Interior and the Director of the National Science Foundation are authorized to establish such joint operating and coordinating procedures and committees as they may deem to be necessary or convenient for the conduct or administration of the program provided for in this Act; (2) the Secretary of the Interior is authorized

(A) to conduct (either directly or by means of grant, contract, or cooperative agreement) in not less than five different locations in the United States such engineering and meteorological studies and investigations of physical methods and devices as he deems advisable, including but not limited to cloud seeding to increase precipitation, and techniques of controlling snowpack storage and runoff;

(B) to acquire by purchase, license, lease, donation, or otherwise, such technical data, inventions, patent applications, licenses, real property and interests therein; and

(C) to cooperate with other Federal departments and agencies and State and local agencies and instrumentalities; and

(3) the National Science Foundation is authorized to exercise all powers and authority vested in it by sections 3(a) (9) and 14 of the National Science Foundation Act of 1960, as amended (42 U.S.C. 1862 (a) (9) and 1872a).
