A BILL To amend chapter 15 of title 38, United States Code, to provide for the payment of pensions of $100 per month to World War I veterans, subject to a $2,400 and $3,600 annual income limitation; to provide that retirement income such as social security shall not be counted as income; to provide that such pension shall be increased by 10 per centum where the veteran served overseas during World War I; and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That subchapter II of chapter 15 of title 38, United States Code, is amended by adding at the end thereof the following:

"§ 513. Veterans of World War I

"(a) (1) The Administrator shall pay to each veteran of World War I who meets the service requirements of section 521 of this title a pension at the rate of $100 per month.

"(2) Where a veteran entitled to pension under this section is in need of regular aid and attendance, the pension payable to him under paragraph (1) shall be increased by $70 monthly.

"(b) Where a veteran entitled to pension under this section served in the active military, naval, or air service outside the United States during World War I, the total pension payable to him under subsection (a) for any month shall be increased by 10 per centum thereof.

"(c) No pension shall be paid under this section to any unmarried veteran whose annual income exceeds $2,400, or to any married veteran or any veteran with children whose annual income exceeds $3,600.

"(d) In determining annual income for the purposes of this section, the Administrator shall disregard payments to a veteran under public or private retirement, annuity, endowment, or similar plans.

"(e) Where any veteran is entitled to pension under this section and is also entitled to pension under another section of this chapter, he shall receive whichever amount is the greater."

SEC. 2. The analysis of chapter 15 of title 38, United States Code, is amended by inserting immediately below item 512 thereof the following: "513. Veterans of World War I."

A BILL To amend section 503 of title 38, United States Code, to provide that workmen's compensation payments shall be disregarded in the computation of income for purposes of payment of pensions, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 503 of title 38, United States Code, is amended (1) by striking out the period at the end of paragraph (8) and inserting in lieu thereof "; and"; and (2) by adding at the end thereof the following:

"(9) payments under any workmen's compensation or industrial accident law of a State or of the United States."

SEC. 2. In determining annual income of any individual entitled to pension under the provisions of law saved from repeal by section 9 of the Veterans' Pension Act of 1959, the Administrator of Veterans' Affairs shall disregard all payments made to or for such individual under any workmen's compensation or industrial accident law of a State, Commonwealth, or possession of the United States, or of the United States.

A BILL To amend title 38, United States Code, to provide for the payment of pensions to veterans of World War I

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That this Act may be cited as the "World War I Pension Act of 1960"

SEC. 2. Chapter 15 of title 38, United States Code, is amended by inserting immediately below section 512 thereof the following new section:

"§ 513. Veterans of World War I

"(a) The Administrator shall pay to each veteran of World War I who meets the service requirements of this section a pension at the monthly rate of $100.

“(b) For the purposes of this section—

"(1) The term 'veteran' means an individual who served in the active military, naval, or air service and who was discharged or released therefrom under conditions other than dishonorable.

"(2) The term 'World War I' (A) means the period beginning on April 6, 1917, and ending on November 11, 1918, (B) in the case of any veteran who served with the United States military forces in Russia, means the period beginning on April 6, 1917, and ending on April 1, 1920, and (C) includes, in the case of any veteran, any period of service performed by him after November 11, 1918, and before July 2, 1921, if such veteran served in the active military, naval, or air service after April 5, 1917, and before November 12, 1918.

"(c) Pension shall be paid to a veteran under this section without regard to his annual income, whether derived from payments of social security benefits, railroad retirement benefits, pensions, annuities, or otherwise.

"(d) A veteran meets the service requirements of this section if he served in the active military, naval, or air service

"(1) for ninety days or more during World War I;

“(2) during World War I and was discharged or released from such service for a service-connected disability; or

"(3) for a period of ninety consecutive days or more and such period ended during World War I."

SEC. 3. The analysis of chapter 15 of title 38, United States Code, is amended by inserting immediately below

"512. Spanish-American War veterans."

A BILL To amend title 38, United States Code, to provide for the payment of pensions to veterans of World War I

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That this Act may be cited as the "World War I Pension Act of 1961".

SEC. 2. Chapter 15 of title 38, United States Code, is amended by inserting immediately below section 512 thereof the following new section:

"(a) The Administrator shall pay to each veteran of World War I who meets the service and income limitations requirements of this section a pension at the monthly rate of 30 per centum over part 3 of the 'old pension provision' of $78.75. "(b) For the purpose of this section

"(1) The term 'veteran' means an individual who served in the active military. naval, or air service and who was discharged or released therefrom under conditions other than dishonorable.

"(2) The term 'World War I' (A) means the period beginning on April 6, 1917, and ending on November 11, 1918, and (B) includes, in the case of any veteran, any period of service performed by him during the period beginning April 6, 1917 and ending November 11, 1918.

"(c) Pension shall be paid to a veteran under this section, whose income, if single with no dependents, does not exceed $2,400, married with dependents, $3,600, exclusive of social security benefits, Railroad Retirement benefits, annuities or other pensions which said benefits, annuities and pensions shall be exempt for the purpose of computing the annual income of the veteran to determine his eligibility for a pension under this Act.

"(d) A veteran meets the service requirements of this section if he served in active military, naval, or air service

"(1) For ninety days or more during World War I;

"(2) During World War I and was discharged or released from such service for a service-connected disability; or

"(3) For a period of ninety consecutive days or more and such period ended during World War I."

A BILL To amend section 101 of title 38, United States Code, to extend full wartime benefits to persons who served in the Armed Forces of the United States for ninety days or more in Mexico or on its borders during the period beginning on May 9, 1916, and ending on April 6, 1917, and to extend full wartime survivor benefits to the survivors of such persons

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That paragraph (7) of section 101 of title 38, United States Code (defining World War I for purposes of such title 38), is amended by inserting immediately before the period at the end thereof the following: ", and (C) includes, in the case of any veteran, any period of service of ninety days or more performed after May 8, 1916, and before April 6, 1917, (i) in Mexico, (ii) on the borders of Mexico, (iii) in the waters adjacent to Mexico, or (iv) in any combination of the locations specified in clauses (i), (ii), and (iii)”.

A BILL To provide for the payment of pensions to veterans of World War I and their widows and children at the same rates as apply in the case of veterans of the SpanishAmerican War, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That this Act may be cited as the "World War I Pension Act".

SEC. 2. (a) Every person who served in the active military or naval service of the United States during World War I and who meets both the ninety-day service requirement described in subsection (b) and the age or disability requirement described in subsection (c), shall be entitled to receive from the Administrator of Veterans' Affairs a pension at the rate of—

(1) $101.59 per month; or

(2) $135.45 per month if he is helpless or blind, or requires the regular aid and attendance of another person.

(b) An individual meets the ninety-day service requirement referred to in subsection (a) if he was discharged or released from active military or naval service under conditions other than dishonorable, and—

(1) he served for ninety days during World War I;

(2) he served continuously for a ninety-day period which began or ended during World War I;

(3) he served during any reenlistment entered into on or after November 12, 1918, and before July 2, 1921, where there was prior service during World War I, if the periods of such service total at least ninety days; or

(4) he was discharged or released from a period of service which began or ended during World War I for a disability incurred or aggravated in line of duty.

(c) An individual meets the age or disability requirements referred to in subsection (a) if—

(1) he has attained the age of sixty-two years; or

(2) he is suffering from a permanent disability (not the result of his own misconduct or vicious habits) which is rated by the Administrator of Veterans' Affairs to be 10 per centum or more in degree.

SEC. 3. (a) The surviving widow, child, or children of any deceased person who served in the active military or naval service of the United States during World War I and who met the ninety-day service requirement described in subsection (b) of section 2, shall be entitled to receive pension at the rates established by subsection (b) of this section.

(b) The monthly rates of pension referred to in subsection (a) are as follows: (1) Widow, no child, $54.18, unless the widow was married to the person who served prior to November 12, 1918, in which case the rate shall be $67.73;

(2) Widow, one or more children, the rate established under paragraph (1), plus $8.13 for each child;

(3) No widow eligible for pension, one child below age sixteen, $62.31, with $8.13 additional for each additional child below age sixteen (total amount equally divided);

(4) No widow eligible for pension, no child below age sixteen, but one child age sixteen or over, $27.30;

(5) No widow eligible for pension, no child below age sixteen, but two children age sixteen or over, $40.95 (total amount equally divided); and

(6) No widow eligible for pension, no child below age sixteen, but three children age sixteen or over, $54.60 (total amount equally divided), with $7.56 for each additional child (total amount equally divided).

(c) (1) Remarriage of a widow shall bar her from being eligible for pension under this Act; however, if such remarriage is dissolved by death or divorce on grounds other than her adultery, she shall thereafter be eligible for pension under this Act.

(2) No widow shall be entitled to pension based on the service of more than one husband.

(3) The open and notorious adulterous cohabitation of any widow shall terminate her eligibility for pension under this Act.

SEC. 4. (a) The administrative, penal, and forfeiture provisions contained in public, Numbered 2, Seventy-third Congress, as amended, and the veterans regulations, as amended, shall apply to this Act.

(b) Terms used in this Act shall have the meaning which they have when used in the veterans regulations, except that the term "widow" means a woman who was married to the person who served prior to December 14, 1944, or for ten or more years. For the purposes of this subsection, all marriages shall be proven as valid marriages according to the law of the place where the parties resided at the time of marriage or the law of the place where the parties resided when the right to pension under this Act accrued, except that where the original date of marriage meets the requirements of this subsection and the parties were legally married at the date of death of the veteran, the requirements of this subsection as to the date of marriage shall be regarded as having been met.

SEC. 5. Section 2 of the Act entitled "An Act to safeguard the estates of veterans derived from payments of pension, compensation, emergency officers' retirement pay and insurance, and for other purposes", approved August 12, 1935 (38 U.S.C., sec. 556a), is hereby amended by inserting immediately after "Public Law Numbered 484, Seventy-third Congress," the following: "the World War I Pension Act,".

SEC. 6. (a) Except as provided in subsection (b) of this section, where eligibility for pension is established by virtue of this Act, pension shall be paid from date of receipt of application therefor in the Veterans' Administration, but in no event prior to the effective date of this Act.

(b) All persons receiving compensation or pension on the day prior to the effective date of this Act under laws administered by the Veterans' Administration shall be entitled to the benefits of this Act without the necessity of filing an application therefor.

SEC. 7. This Act shall take effect on the first day of the second calendar month which begins after the date of its enactment.

A BILL To eliminate the requirement that veterans have served for ninety days or more to qualify for certain benefits under laws administered by the Veterans' Administration

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 313 of the Veterans' Benefits Act of 1957 (38 U.S.C. 2313) is amended by striking out "for ninety days or more".

SEC. 2. Section 411 of the Veterans' Benefits Act of 1957 is amended by striking out "who meets the service requirements of this section”.

SEC. 3. Section 412 of the Veterans' Benefits Act of 1957 (38 U.S.C. 2412) is amended (1) by striking out subsection (b); (2) by striking out “(a) (1)” and inserting in lieu thereof “(a)"; (3) by redesignating paragraph (2) of subsection (a) as subsection (b) of such section 412; and (4) by striking out "who meets the service requirements of this subsection".

SEC. 4. Section 421 of the Veterans' Benefits Act of 1957 is amended by striking out", who meets the service requirements of this section, and”.

SEC. 5. Subsection (a) of section 500 of the Servicemen's Readjustment Act of 1944 (38 U.S.C. 694) is amended by striking out "after active service of ninety days or more, or by reason of an injury or disability incurred in service in line of duty,".

SEC. 6. Sections 436 (a) and 437 of the Veterans' Benefits Act of 1957 (38 U.S.C. 2436 (a), 2437) are each amended by striking out "412(a)” and inserting in lieu thereof “412 (b)”.

A BILL To amend section 402 of the Veterans' Benefits Act of 1957 with respect to determinations of permanent and total disability

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 402(a) of the Veterans' Benefits Act of 1957 (38 U.S.C. 2402 (a)) is amended by inserting immediately below subparagraph (2) the following: "In determining whether or not an individual is permanently and totally disabled, if competent medical evidence is presented to the Administrator to the effect that such individual in fact is so totally and permanently disabled, then the Administrator shall not consider the employ ment status of such individual in determining whether or not he is so disabled."
