Mr. Swift introduced the following resolution:

Resolved, That the Secretary of the Senate be instructed to procure to be printed, for the use of the Senate, three hundred copies of His Excellency's message.

Mr. Jones presented the petition of Chipman Swain and others, inhabitants of Brattleboro'; the petition of Shubael Atherton and others, inhabitants of Whitingham, and the petition of David Bascomb and others, inhabitants of Whitingham and Halifax, all praying for an act restraining the traffic in ardent spirits.

Which were referred to the committee on the petition of inhabitants of Derby.

Mr. Holmes presented the petition of David Carr and others; the petition of M. S. Chandler and others, and the petition of Spencer Clark and others, inhabitants of Lunenburgh, praying for an act restraining the traffic in ardent spirits.

S. 1.) Mr. Eaton introduced a bill entitled "an act establishing an academy at Enosburgh,'

Which was read the first and second time.

On motion of Mr. Foster,

Ordered, That said bill be laid on the table.

Mr. Kittredge introduced the following resolution :

Resolved, That so much of His Excellency's message as relates to common schools and a geological survey of the state, be referred to the committee on education; so much as relates to banks, to the committee on banks; so much as relates to the militia, to the committee on military affairs, and so much as relates to the distribution, among the several states, of the proceeds of the sales of public lands, to the committee on finance.

Which was read and passed.

AFTERNOON.

The following communication was received from the Commissioners appointed to revise the statute laws of the state:

MONTPELIER, Oct. 14, 1839.

To the Honorable General Assembly of the State of Vermont:

The commissioners appointed to revise the statute laws of the state, have attended to the duties assigned them, and are ready to present the result of their labors in such manner as the legislature shall direct.

The accompanying analysis shows the division of the several subjects embraced in the revision, and the manner in which the committee propose to arrange those subjects.

Mr. Pierpoint introduced the following resolution:

Resolved, by the Senate and House of Representatives, That a joint committee, consisting of three members of the Senate and three members of the House of Representatives, be appointed by their respective houses, to report such joint rules as may be deemed expedient for the action of the General Assembly upon the revision of the statutes, reported by the commissioners at the present session.

Which was read and passed.

Mr. Cobb introduced the following resolution:

Resolved, That the committee on the judiciary be directed to report a bill abolishing capital punishment, and substituting inl ieu thereof solitary imprisonment in the state prison, during life.

On motion of Mr. Cobb,

Ordered, That said resolution be laid on the table

TUESDAY, OCT. 15, 1839. (S. 1.) Mr. Eaton called up the bill entitled "an act establishing an academy in Enosburgh."

Mr. Chandler presented the petition of Warren Richmond and others, for a coinmittee to establish the line between Westminster and Ath

ens.

On motion of Mr. Chandler,

Ordered, That said petition be referred to the committee on the judiciary.

A message from the House of Representatives by Mr. Buck, assistant clerk:

MR. PRESIDENT: The House of Representatives concur with the Senate in the passage of a resolution for the appointment of a joint.committee to report rules relative to the action of the General Assembly on the revision of the statutes.

On motion of Mr. Kittredge,

Ordered, That the committee of the Senate on the joint resolution respecting the revised Statutes be appointed by the chair.

Whereupon the President appointed, as such committee, Mr. Pierpoint, Mr. Harvey and Mr. Adains.

The Senate adjourned.

AFTERNOON.

(S. 1.) Mr. Swift, from the committee on education, to whom was referred a bill entitled "an act establishing an academy in Enosburgh," reported said bill without amendment.

Ordered, That said bill be engrossed and read the third time.

(S. 2.) Mr. Converse introduced a bill entitled "an act to compensate the Superintendent of the Vermont State Prison,"

Which was read the first and second time and referred to the committee on finance.

Mr. Kittredge, from the committee on banks, to whom was referred, on the 11th instant, a resolution from the House of Representatives, on the subject of the Bank of Windsor and the Essex Bank, reported that said resolution be amended by striking out all after the word that in the first line, and inserting the following:

"A committee consisting of three persons be appointed, by the joint ballot of both houses, whose duty it shall be to visit the towns of Windsor and Guildhall, as soon as may be, and make inquiry into the management, conduct and present condition of the Bank of Windsor and Essex Bank, ascertain the causes of their failure, (if said banks or either of them have failed,) and the amount of loss the community will sustain

by reason of such failure--also to inquire into the situation and amount of the safety fund of this state, and whether that fund is sufficient to pay the losses to bill holders of the Essex Bank;-said committee to have power to send for persons and papers, and report to this legislature. On motion of Mr. Cobb,

Ordered, That said resolution and proposed amendment be laid on the table.

Mr. Lawrence introduced the following resolution :

Resolved, That the committee un military affairs be instructed to ascertain and report to the Senate the amount of money drawn from the treasury of the state the past year, under the act of 1887, for courts martial, military drills and other contingent expenses. Also what amount has been paid into the treasury for fines under the same act. Which was read and passed.

On motion of Mr. Bowen,

The Senate adjourned.

WEDNESDAY, Oct. 16, 1839.

(S. 2.) Mr. Pierpoint, from the committee on finance, to whom was referred a bill entitled "an act to compensate the Superintendent of the Vermont State Prison," reported the same without amendment. Ordered, That said bill be engrossed and read the third time.

The following engrossed bills were severally read the third time and passed:

(S. 1.) "An act establishing an academy in Enosburgh."

(S. 2.) "An act to compensate the Superintendent of the Vermont State Prison.”

Mr. Cobb called up the resolution relative to the Bank of Windsor and the Essex Bank, and the amendment thereto, reported by the committee on banks.

On motion of Mr. Tracy, the amendment proposed by the committee was amended, by inserting after the words as soon as may be, the following words: "if, in their judgment, it shall be necessary.

On motion of Mr. Pierpoint, the said amendment was further amended by striking out the words joint ballot of both houses, and by inserting the following words: "Senate and House of Representatives." The said resolution, as amended, was passed.

Mr. Marsh presented the petition of Asa Church and 63 others, inhabitants of Underl.ill, against the traffic in ardent spirits,

Which was referred to the committee on the petition of inhabitants of Derby.

The following communication was received from from His Excellency the Governor :

To the Senate:

I transmit to the Honorable Senate copies of the Quarter Master General's report,—of the report of the Auditor in the Treasury Department,-of the report on the school fund, of the report of the Treasurer on the situation of the safety fund, and of the report of the commissioners of the deaf and dumb and the blind.

(S. 3.) Mr. Tracy, from the committee on the judiciary, to whom was referred the petition of Warren Richmond and others, reported a bill entitled "an act to settle and establish the boundary line between the towns of Westminster and Athens."

Which was read the first and second time.

Ordered, That it be engrossed and read the third time.

A message from the House of Representatives, by Mr. Merrill, their clerk :

MR. PRESIDENT: The House of Representatives have passed a resolution for a joint assembly for the election of a secretary of state, an auditor of accounts against the state, and a sergeant-at-arms for the year ensuing.

The said resolution is as follows:

Resolved, by the Senate and House of Representatives, That both houses meet in joint assembly on Friday next, at ten o'clock forenoon, for the purpose of electing a Secretary of State, an Auditor of Accounts against the State and Sergeant-at-Arms for the ensuing year. Which was read and passed in concurrence.
