(S. 5.) The engrossed bill entitled "an act relating to the Rutland Rail Road Bank," was read the third time, and on the question, Shall the bill pass? the yeas and nays were required by Mr. Robinson and were taken, and were as follows:

So the bill passed.

(S. 20.) Mr. Ranney, from the select committee to whom was refered a bill entitled "an act to incorporate the Windham County Mutual Fire Insurance Company," reported the bill without amendment.

Ordered, That the bill be engrossed and read the third time.

A message from the House of Representatives by Mr. Buck, assistant clerk :

MR. PRESIDENT: The House of Representatives have passed a bill entitled (H. 15) "an act to alter the names of Abel Clough and Amy Winship." The House concur with the Senate in passing a bill entitled (S. 7) "an act in addition to an act entitled an act to incorporate the Goshen Turnpike Company," with a proposal of amendment, in which they ask the concurrence of the Senate.

(S. 3.) The Senate resumed the consideration of the bill entitled "an act incorporating the Brandon Rail Road Bank.”

The amendment proposed by the committee of the whole, as Section 27, was adopted.

On the question of adopting the amendment proposed by the committee of the wholt, as Section 28, the yeas and nays, having been required by Mr. Robinson, were taken and were as follows:

Those who voted in the affirmative are:

Messrs. Bowen, Chittenden, Curtis, Edson, Goodwin, Heywood, Hebard, Hubbell, Jones, Robinson, Sears, Short—12. Those who voted in the negative are:

Messrs. Allen, Briggs, Burton, Chandler, Kittredge, Lawrence, Noble, Pierpoint, Ranney, Steele, Swift, Tenney, Young--13.

So it was decided in the negative, and the amendment was rejected.

On motion of Mr. Ranney the bill was amended by the addition of the following section:

"Sec. 28. No individual shall be permitted, by purchase, or otherwise, in his own name or by proxy, to hold more than one hundred shares of the capital stock of said bank."

On motion of Mr. Briggs the bill was further amended by inserting in the third section, after the words "subscribed for," the following: "Or shall secure, to the satisfaction of said commissioners, said sum, to be paid into the bank before said corporation shall issue any bills or make any loans."

The question was then stated, Shall the bill be engrossed and read the third time and on the question, the yeas and nays having been required by Mr. Robinson, were taken, and were as follows:

So it was decided in the affirmative.

Mr. Ranney called up the resolution introduced by him on the 16th ins. proposing Tuesday the 23d instant, as the time for the adjournment of the General Assembly.

On motion of Mr. Ranney the resolution was amended by striking out 23d and inserting 30th.

The resolution, as amended, was then passed:

(S. 22.) Mr. Burton introduced a bill entitled "an act to incorporate the Bennington County Mutual Fire Insurance Company," which was read the first and second time.

On motion of Mr. Pierpoint,

Ordered, That the bill be referred to the Senators from the county of Bennington.

Mr. Short, from the committee on bills, reported that said committee have this day delivered to the governor, for his approval and signature a bill entitled (S. 9) "an aet compensating the superintendent of the Vermont State Prison."

(S. 23.) Mr. Pierpoint introduced a bill entitled "an act in addition to an act regulating the chartering of banks,'

Which was read the first and second time, and referred, to the committee on banks.

(S. 24.) Mr. Briggs introduced a bill entitle "an act directing the treasurer to pay Marcus O. Porter and William P. Russell the sum therein mentioned,"

Which was read the first and second time, and referred to the committee on claims.

(S. 25.) Mr. Ranney introduced a bill entitled " an act to encourage the growing of silk,"

Which was read the first and second time, and referred to the committee on manufactures.

Mr. Short presented the memorial of inhabitants of Thetford for an act regulating the location of school-houses, which was referred to the Committee on education.

(S. 6.) Mr. Kittredge, from the committee on banks, to whom was referred the bill entitled "an act extending the time, and continuing in force for a limited time, an act to incorporate the president, directors, and company of the Bank of Bennington," reported said bill with amendments, which were considered by the Senate as in committee of the whole.

Mr. PRESIDENT: The House of Representatives are now ready to proceed to ballot for a senator to represent this state in the congress of the United States.

Ordered, That a message be sent to the House of Representatives informing them that the Senate are now ready to proceeed on their part to the election of a senator in congress.

Pursuant to the concurrent resolution of both houses, the Senate resumed the ballcting for a senator to represent this state in the congress of the United States.

Pending the balloting, Mr. Robinson moved that the Senate do now adjourn.

A question of order arising,

The President decided the motion of adjournment; at this time, to be in order.

Mr. Kittredge appealed from the decision of the chair.

The question was then stated,

Shall the decision of the chair stand as the judgment of the Senate? And being taken, was decided in the affirmative.

The question, Will the Senate now adjourn? was then taken and decided in the negative.

The Senate resumed ballotting for a senator to represent this state in the congress of the United States.

The Senate resumed the ballotting for a senator to represent this state in the congress of the United States.

The ballots, having been taken and examined,

had a majority of all the votes, and on the part of the Senate, was duly elected senator in congress for the term of six years, commencing on the fourth day of March next.

Ordered, That the Secretary inform the House of Representatives that the Senate have, on their part, elected a senator to represent this state in the congress of the United States, and are ready to meet the House of Representatives in joint assembly, to compare the proceeding of the two houses and complete the election.

(H. 16.) A bill from the House of Representatives entitled "an act to restore Melvin Harris to his legal privileges," was read the first time, and the question, Shall the bill be read the second time? being taken, was decided in the negative.

So the bill was rejected.

(H. 10.) Mr. Briggs called up the bill from the House of Represen→ tatives, entitled "an act altering the name of Milo Beecher," &c. and it was read the third time and passed.

(S. 26.) Mr. Burton, from the committee on finance, to whom was referred the petition of Caleb Lillie, reported a bill, entitled "an act for the relief of Caleb Lillie and Elijah Barber',' which was read the first and second time.

Ordered, That it be engrossed and read the third time.

(S. 27.) Mr. Burton, from the committee on finance, to whom was referred the petition of Kinsley Brown, reported a bill entitled "an act for the relief of Kinsley Brown and Allen-Brown," which was read the first and second time.
