Mr. Ranney introduced the following resolution:

Resolved, by the Senate and House of Representatives, That the two horses will adjourn without day on Tuesday the 23d day of October, instant.

Ordered, That a conference be requested with the House of Repre sentatives on the subject of the disagreeing votes of the two houses, on the resolution assigning a time for the election of a Senator to represent this state in the Congress of the United States.

On motion of Mr. Converse,

WEDNESDAY, OCT. 17, 1838,

Ordered, That the vote taken yesterday, refusing concurrence in the amendment proposed by the House of Representatives to the resolution designating a time for the election of a Senator to represent this state in the Congress of the United States, he reconsidered.

The said proposal of amendment being read,

Resolved, That the Senate concur therein.

(S. 8.) Mr. Steele, from the committee on Finance, to whom was referred a resolution introduced by Mr. Briggs, on the 15th inst., repor ted a bill entitled "an act relating to the office and duty of sergeant-atarms,"

Which was read the first and second time.

Ordered, That the bill be laid on the table.

Mr. Robinson presented the petition of Caleb Lullie and the petition of Kingsley Brown, which were severally referred to the committee on Finance.

A message from the House of Representatives, by Mr. Merrill, their clerk:

MR. PRESIDENT: The House of Representatives have passed a bill entitled "an act repealing an act regulating the practice a physic and surgery," "in which they ask the concurrence of the Senate. (H.1.) The said bill was read the first and second time and referred to the committee on Education.

The Senate adjourned.

AFTERNOON.

Mr. Bowen introduced the following resolution:

Resolved, That the committee on Elections be instructed to enquire into the expediency of so altering the law as to make it the duty of the presiding officers of freemen's meetings to enclose the votes given for

representatives to Congress in the certificate certifying said votes: also of making it the duty of the town clerk to sign the certificate with the presiding officer; and report by bill or otherwise.

Which was read and passed.

Mr. Briggs, from the judiciary committee, to whom was referred the communication from the committee appointed to revise the statule laws of this state, reported that no legislative proceedings thereon are necessary.

(S. 2) Mr. Briggs, from the same committee, to whom was referred. a bill entitled, an act relating to the judiciary," reported the same

without amendment.

On motion of Mr. Pierpoint,

(S. 9.) Mr. Converse introduced a bill entitled "an act compensating the superintendent of the Vermont State Prison,"

Which was read the first and second time and referred to the committee on claims.

(S.8.) Mr. Hebard called up the bill entitled "an act relating to the office and duty of sergeant-at-arms."

Ordered, That it be engrossed and read the third time.

Mr. Noble, from the committee on agriculture, to whom was referred a resolution introduced on the 13th inst. relative to agricultural societies, reported that it is inexpedient to pass any act on the subject contemplat ed in said resolution.

(S. 1.) r. Young. from the committee on roads and canals, to whom was referred a bili entitled "an act to incorporate the Lake Champlain and Otte. Creek Rail Road," reported the said bill with a proposition to anend the same by inserting atter the enacting clause, in the first and fourth sections, the words "H. G. Dana, Nathan T. Sprague, John A. Conant, E. N. Briggs, Thomas D. Hammond, Joseph Simonds, and Davis Rich."

Which amendments were adopted.

Ordered, That said bill be engrossed and read the third time.

(S. 9.) Mr. Pierpoint, from the committee on claims, to whom was referred the bill entitled "an act compensating the superintendent of the Vermont State Prison," reported the same without amendment.

Mr. Lawrence introduced the following resolution:

Resolved, That the Governor be requested to transmit to the Senate a copy of the report of the Adjutant and Inspector General. Which was read and passed.

Mr. Lawrence introduced the following resolution:

Resolved, That the Governor be requested to transmit to the Senate a copy of the report of the Quarter Master General for the past year.

Which was read and passed.

The following communication was received from His Excellency, the Governor, by Mr. Manser, Secretary of Civil and Military Affairs: EXECUTIVE CHAMBER, Oct. 18, 1838.

SIR, I have the honor, herewith to transmit to the Senate the report of the bank commissioners; of the commissioners of the deaf, dumb, and blind; the reports of the auditor in the treasury department, and the report of the auditor of accounts against the state.

A message from the House of Representatives, by Mr. Merrill, their elerk:

MR. PRESIDENT: The House of Representatives have passed a resolution directing the Secretary of State to deposite sundry copies of the eighth volume of the Vermont Reports in the Library.

The said resolution is as follows:

Resolved, the Senate concurring herein, That the Secretary of State be directed to deposite in the State Library ten copies of the 8th volume of Vermont Reports, for the use of said Library.

Which was read and referred to the committee on the judiciary.

(H. 1.) A bill from the House of Representatives entitled, "an act repealing an act regulating the practice of physic and surgery," was read the third time and passed.

(S. 10.) Mr. Heywood introduced a bill entitled "an act directing the treasurer to pay Isaac Cummings the sum therein mentioned,"

Which was read the first and second time and referred to the committee on claims.

Mr. Ranney introduced the following resolution:

Resolved, That the committee on the judiciary be requested to inquire into the expediency of removing by law all obstacles to every man's pleading his own cause in courts of justice.

(S. 11.) Mr. Swift, from the committee on education, to whom was referred so much of the Governor's message as relates to a geological survey of the state, reported a bill entitled "an act relating to a geological survey of the state,'

Which was read the first and second time.

Ordered, That the bill be laid on the table.

(S. 12.) Mr. Robinson, from the committee on the judiciary, to whom was referred a resolution introduced by Mr. Briggs on the 11th instant, reported a bill entitled "an act to abolish imprisonment for debt,"

Which was read the first and second time, and considered by the Senate, as in committee of the whole, and

On motion of Mr. Kittredge,

Ordered, That the bill be laid on the table.

Mr. Hebard introduced the following resolution:

Resolved, That the judiciary committee be instructed to report a bill extending the trustee process to all cases, whether the principal debtor shall have absconded or be concealed, or whether he shall remain within reach of process.

Mr. Hubbell moved that said resolution be laid on the table.

And the question being taken thereon, was decided in the negative.
The resolution was then passed.

The engrossed bill (S. 8) entitled an act relating to the office and auty of sergeant-at-armis," and the engrossed bili (S. 9) entitled "an act compensating the superintendent of the Vermont State Prison," were, severally, read the third time and passed.

(S. 13.) Mr. Briggs introduced a bill entitled "an act to incorporate the Rutland and Addison Mutual Fire Insurance Company,"

Which was read the first and second time, and referred to a select committee consisting of the senators from the counties of Rutland and Addison.

The Senate adjourned.

AFTERNOON

On motion of Mr. Kittredge,

Ordered, That the report of the bank commissioners be referred to the committee on banks.

PRESIDENT: The House of Representatives have passed a resolution relative to the distribution of the ninth volume of Vermont Reports: They have also passed an act entitled "an act (H. 2.) relating to the acknowledgement of deeds and land conveyances," in which they ask the concurrence of the Senate.

Resolved, the Senate concurring herein, That the librarian be dis rected to deliver to the representative of each town in this state one copy of the ninth volume of the Vermont reports, for the use of said town, and take his receipt therefor.

Which was read and referred to the committee on the judiciary.

FRIDAY, OCTOBER 19, 1838.

Mr. Jones presented the memorial of the inhabitants of Dover, relating to the raffic in ardent spirits, which was referred to the committee on the memorial of inhabitants of Thetfords

Mr. Jones, also, presented, the memorial of inhabitants of Dover, praying that the senators in congress from this state be requested to use all constitutional means to procure the abolition of slavery in the district of Columbia, &c.

On motion of Mr. Jones.

Ordered, That the memorial be referred to a select committee of three.
