Mr. Briggs introduced the following resolution:

Resolved, That the Secretary of the Senate be requested to procure to be printed three hundred copies of His Excellency's message, for the use of the Senate.

Which was read and passed.

On motion of Mr. Converse,

Resolved, That the committee on bills be now appointed by the chair. Whereupon, the President announced as such committee, Mr. Short and Mr. Sears.

Mr. Briggs introduced the following resolution:

Resolved, That so much of His Excellency's message as relates to imprisonment for debt, be referred to the committee on the Judiciary; so much as relates to capital punishment be referred to a select committee of three; so much as relates to a geological survey, to the committee on education; so much as relates to the militia to the committee on military affairs.

Which was read and passed.

Mr. Bowen presented the memorial of Jeremiah Bemis and 195 others, inhabitants of Weathersfield, on the subject of the traffic in ardent spirits,

Which was referred to the committee on the memorial of inhabitants cf Thetford.

Mr. Steele called up the resolution designating a time for the election of a Senator to represent this State in the Congress of the United States. On motion of Mr. Hebard,

Ordered, That said resolution be laid on the table.

A message from the House of Representatives by Mr. Buck, assistant clerk:

MR. PRESIDENT: The House of Representatives have passed a resolution for a joint assembly for the election of a reporter of decisions of the Supreme Court, and an agent to settle the concerns of the Vermont State Bank. The House concur with the Senate in the resolution for the amendment of the joint rules of both houses.

The resolution from the House of Representatives is as follows:

Resolved, the Senate concurring herein, That the two houses meet in joint assembly on Thursday, the 18th instant, at two o'clock afternoon, for the election of a reporter of decisions of the Supreme Court of this State, and also an agent to settle the concerns of the Vermont State Bank.

Which was read and passed.

On motion of Mr. Briggs,

Resolved, That the committee raised on so much of the Governor's message as relates to capital punishment be now appointed by the chair. Whereupon the President announced as such committee, Mr. Swift, Mr. Steele and Mr. Chittenden.

The Senate adjourned.

MONDAY, OCTOBER 15.

(S. 4.) Mr. Swift Introduced a bill entitled “An act to abolish capi tal punishments,"

Which was read the first and second time, and referred to the committee, to whom was referred so much of the Governor's message as relates to capital punishments.

Mr. Tenny presented the memorial of the Orange County Temperance Convention,

Which was referred to the committee on the memorial of the inhabitants of Thetford.

Mr. Hebard called up the resolution assigning a time for the election of a Senator to represent this State in the Congress of the United States.

Mr. Hebard moved to amend said resolution by striking out the word Monday and inserting the word Wednesday.

And the question, being taken thereon, was decided in the affirmative. The resolution, as amended, was then passed.

Mr. Briggs introduced the following resolution:

Resolved, That the committee on Finance be instructed to inquire into the expediency of providing by law, for a proper officer to take charge of the State House, and its furniture and grounds about it, during the session of the Legislature, and in the recess thereof, and also to provide stationary, wood, lights, &c. for the use of the Legislature, and that they report by bill or otherwise.

Which was read and passed.

Mr. Lawrence introduced the following resolution:

Resolved, That the committee on Military affairs be instructed to ascertain and report to the Senate, the amount of the expenses incurred under the act of the last session relating to the militia, and the probable amount of the same expenses for the ensuing year.

Which was read and passed.

(S. 5.) Mr. Pierpoint introduced a bill entitled "an act relating to the Rutland Rail Road Bank,"

Which was read the first and second time and referred to the committee on banks.

Mr. Ranney introduced the following resolution:

Resolved, That the committee on Agriculture be requested to take into consideration the expediency of encouraging the formation of Agricultural Societies in each of the several counties in this state, and report by bill or otherwise.

Which was read and passed,

Mr. Converse introduced the following_resolution:

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of providing by law for the taking of depositions in certain cases, to be used in the trial of criminal causes, and report by bill or otherwise.

Which was read and passed,

The Senate adjourned.

AFTERNOON.

The President communicated to the Senate the following report from the committee appointed to revise the statute laws of this state. To the General Assembly now sitting:

The committee appointed by the Governor and Lieutenant Governor, agreeably to the act passed at the last session of the Legislature, to revise the statutes of this state, report: That they have made progress in the performance of the duties assigned them, but have found it impracticable to complete the work, so as to report to the General Assem bly, at their present session.

TUESDAY, OCTOBAK 16.

A message from the House of Representatives by Mr. Buck, assistant clerk:

MR. PRESIDENT: The House has passed a resolution relating to the settlement of the Treasurer's accounts, and a resolution authorizing the Auditor of Accounts against the State to settle the accounts of the Superintendent of the State House, in which they ask the concurrence of the Senate.

A resolution from the House of Representatives:

Resolved, the Senate concurring herein, That the Treasurer of this State be authorized to receive of Allen Wardner, Esq. late Treasurer, ninety-four dollars in Windsor Bank bills, in the settlement of the bal ance due the State.

Which was read and passed.

A resolution from the House of Representatives:

Resolved, The Senate concurring herein, That the Auditor of Accounts against the State be authorized to settle and adjust the accounts of the superintendant of the State House for the past year, and also, the Auditor Report to the Legislature the whole amount of expenditure on the State House and appendages since its commencement.

Which was read and passed.

Mr. Hebard introduced the following resolution:

Resolved, That so much of His Excellency's message as relates to elections and the elective privilege, be referred to the committee on elections.

Which was read and passed.

Mr. Hubbell introduced the following resolution:

Resolved, That the committee on Elections be instructed to inquire into the expediency of so amending the law concerning elections, that the office for which a person is voted fo: shall be designated upon the ballot, and report by bill or otherwise.

Which was read and passed.

(S. 6.) Mr. Swift introduced a bill entitled "An act extending the time and continuing in force for a limited time, an act to incorporate the president, directors and company of the bank of Bennington.

Which was read the first and second time and referred to the committee on banks.

Mr. Heywood introduced the following resolution:

Resolved, That the committee on land taxes be directed to inquire into the expediency of reporting a bill for the annual taxation of wild and unoccupied lands, according to their value.

Which was read and passed.

Mr. McMillan presented the account of Gen. Isaac Fletcher, disallowed by the Auditor and by him referred to the General Assembly, Which was referred to the committee on claims.

Mr. Kittredge introduced the following resolution :

Resolved, That the Judiciary committee be instructed to inquire into the expediency of repealing the existing laws of this State, authorizing ⚫ the taking of depositions without the state to be used in the trial of civil causes; also, to inquire into the expediency of providing by law for the taking of testimony without this state under a commission issu ing from the respective courts of this state:

Which was read and passed.

On motion of Mr. Briggs,
The Senate adjourned.

AFTERNOON.

Mr. Hubbell, from the committee on the Judiciary, to whom was referred the resolution introduced on the fifteenth instant on the subject of providing by law for taking depositions to be used in criminal causes, reported that no legislative action is necessary on the subject of the resolution,

(S. 3.) Mr. Kittredge, from the committee on Banks, to whom was referred the bill entitled "An act incorporating the Brandon Rail Road Bank," reported the same with amendments.

On motion of Mr. Pierpoint,

A message from the House of Representatives. by Mr Merrill, their clerk :

Mr, PRESIDENT: The House of Representatives have passed a resolution for a joint assembly, for the election of a surveyor general. The said resolution is as follows:

Resolved the Senate concurring herein, That both houses meet in joint assen bly on Wednesday, the 17th instant, at ten o'clock, A. M. for the purpose of electing a surveyor general of the State for the year ensuing.

Which being read,

Resolved, to concur in passing said resolution.

On motion of Mr. Briggs,

(S. 3.) The Senate took up the bill entitled "an act incorporating the Brandon Rail Road Bank," and the same was considered by the Senate, as in committee of the whole; the amendments, reported by the committee on banks were adopted and the bill was further amended, when,

Ordered, That the bill be laid on the table.

A message from the House of Representatives by Mr. Merrill, their clerk:

MR. PRESIDENT: The House of Representatives concur with the Senate in passing a resolution, assigning a time for the election of a Senator to represent this State in the Congress of the United States, with a proposal of amendment, in which they ask the concurrence of the Senate.

The said proposal of amendment is as follows:

"In House of Representatives, Oet. 16, 1838. Resolved to concur in passing this resolution, with the following proposal of amendment:→ Strike out the word Wednesday, and insert in lieu thereot Friday."

Which was read; and the question being taken, Will the Senate concur in the amendment proposed to the resolution by the House of Representatives?" was decided in the negative.

(S. 7.) Mr. Briggs introduced a bill entitled "an act in addition to an act entitled av act to incorporate the Goshen turnpike company,' which was read the first and second time, and referred to the committee on roads and canals.

(S. 5.) Mr. Converse, from the committee on Banks, to whom was referred the bill entitled "an act relating to the Rutland Rail Road Bank," reported the bill without amendment.

On motion of Mr. Hubbell,

Ordered, That said bill be laid on the table.

On motion of Mr. Pierpoint,

Ordered, That the vote taken this afternoon refusing concurrence in the amendment proposed by the House of Representatives to the resolution designating a time for the election of Senator to represent this state in the Congress of the United States, be reconsidered.

The question was then stated, "Will the Senate concur in the amendment proposed to said resolution by the House of Representatives?" and being taken, was decided in the negative.
