individual activity or the limited quantity expected to be accumulated will preclude any sale to the detinning industry can be best determined by direct correspondence between the authorized selling activity and the nearest detinning companies listed in subparagraph 5. In this connection, detinning companies have indicated an interest in purchasing tin cans from any location in the United States with the exception of the Clearfield, Utah, and Key West, Fla. areas.

4. Accumulation of Cans. The accumulation of tin cans is required only when there is a reasonable prospect of sale either for detinning or as ferrous scrap. If there is a reasonable prospect of sale to a detinning company, the cans will be prepared in accordance with the requirements stated in subparagraph 3. It is recommended that such preparation be accomplished at the time the cans are opened and emptied, as they may be more easily cleaned at that time. The cans may be stepped on or flattened with a mallet and tossed into a receptacle in the galley pending pickup and removal to the storage point. Beer cans with conical tops, oil cans, paint cans, and cans made of terne or black plate are not acceptable for detinning and should be separated out. If there is no reasonable prospect of sale to a detinning company, the cans may be sold as ferrous scrap, in which event no special preparation is necessary except for baling, which increases the price of scrap.

5. Sale of Cans

a. General. Sales will be conducted by the authorized selling activities. If generations are considered large enough to justify a running term contract, the selling activity may sell the cans on a term basis not to exceed one year. Sales will be made upon a competitive sealed bid basis unless specific authority to the contrary is granted by the Quartermaster General of the Marine Corps. When the cans have been properly prepared for detinning, that fact will be clearly stated in the offering, and the following detinning plants will be included in the distribution.

b. Price Ceilings. Metal coated ferrous material sold for the recovery of the coating substance is exempt from price ceilings if

the sale is made to a person regularly engaged in such an operation. Otherwise, tinned scrap will be sold under the category of No. 1 Bundles as listed in Section 3(2) of OPS Ceiling Price Regulation No. 5.

c. Contract Provisions. Though tin cans may have been prepared for detinning it is necessary that the offering include terms and conditions which will be appropriate regard. less of the buyer's identity or the purpose of the purchase. Therefore, every offering of tin cans, whether on a running term or onetime basis, will include a provision making the price ceiling clause (see paragraph 60117-7) and scrap warranty clause (see paragraph 60117-2) applicable in the event the buyer is not a detinner. Offerings on a running term basis of tin cans which are suitable for detinning also will include the following price escalation and termination

Care

The price per gross ton stated in the bid for clean, prepared, used tin cans is based upon the current ceiling price at the Purchaser's basing point for No. 1 Bundle as published in the Office of Price Stabilization, Ceiling Price Regulation No. 5, and upon a base price per pound for grade A tin, New York market. In the event that either or both of the base prices specified in the preceding sentence increase or decrease during the current calendar month, the contract price shall be adjusted for that calendar month by adding thereto the corresponding price increase or increases or deducting therefrom corresponding price decrease or decreases, as the case may be, determined as follows, and the Purchaser shall pay such adjusted price for deliveries during that

calendar month:

(1) An amount per gross ton equal to the total increase or decrease in the average of the market prices for No. 1 Bundle Scrap (not in excess of the currently established ceiling price), as published in the Iron Age during the current calendar month, in excess of 25 cents variance from the ceiling price set forth above.

(2) An amount per gross ton of 12 cents for each one cent per pound increase or decrease in the average price for grade A tin, determined by averaging the "outside market prompt delivery New York price" (not in excess of the Purchaser's currently established ceiling price), as published in the American Metal Market during the current calendar month, from the current price existing at the time of award.

TERMINATION BY PURCHASER (Note: This clause is applicable only if the Purchaser is a detinning company). The Purchaser may terminate this contract at any time by giving the Government 30 days written notice that the contract is terminated at the end of said 30 day period."

1. DEFINITION. The term "typewriter" as used in this paragraph means manually or electrically operated machines having keyboards and designed to produce printed char

acters by impression of type upon paper through the medium of inked ribbon, and it includes vari-typers, hektowriters, proportional spacer, and portable-type machines but does not include bookkeeping, billing, or teletype machines.

2. REPORTING. Declarations covering typewriters will not include other types of property. The declarations will include the make, model, type (standard, electric, noiseless, portable, etc.), carriage width, type face, and serial number.

1. All legal or letter size four and five drawer filing cabinets, in R-4 condition or better, when determined to be surplus, will be reported to the Quartermaster General of the Marine Corps for disposal instructions. 60161 MATERIALS SUBJECT TO ALLOCATIONS, PRICE CEILINGS, AND OTHER CONTROLS

1. The application of ceiling price, allocation, and similar regulations to disposals of Government surplus is subject to frequent change. This matter will be covered by specific instructions issued by the Office of Naval Material and implementing instruction issued by the Quartermaster General of the Marine Corps. A special provision to be added to the contract when the sale involves a ceiling price is set forth in paragraph 601176. In general, price ceilings are not applicable in foreign areas.
