Additional Procurement Information to the

1.1050-1 Policy In addition to publicizing procurements and contract awards in the Commerce Business Daily, it is NASA policy to furnish the public, upon request, through the public affairs office of the NASA installation receiving the request, information on specific current NASA procurements, including: (i) the names of firms invited to submit bids or proposals; (ii) the names of firms which attended pre-proposal briefing conferences when held; and

(iii) after the date established for receipt of bids or proposals, the names of firms which submitted bids or proposals. (But see 3.805-1(c) regarding requests for information involving

(iv) contract award information as required to be publicized in the Commerce Business Daily under the provisions of 1.1005-1. Exceptions to this policy will be permitted only when the Director of Procurement or the Director of the field installation concerned determines that the disclosure of such information would be prejudicial to the interests of NASA. 1.1050-2 Procedures.

PUBLICIZING PROCUREMENT ACTIONS

(a) Contracts requiring approval by the Director of Procurement, in accordance with Part 20, Subpart 50, will not bel distributed, or any information given to any source outside of NASA that the contract has been approved, until 24 hours after the Director of Public Affairs and the Director of Legislative Affairs, NASA Headquarters, have been advised that the contract has been consummated.

(b) For procurements other than those enumerated in (a) above, unclassified public information requested will be furnished through the Public Information Office of the NASA installation receiving the request. When press releases or public announcements are made. for procurements of $10.000 or more, they shall include the following information:

(1) For awards after formal advertising, state that the contract was awarded after competition by formal advertising and include the number of bids solicited and the number received, and state in general terms the basis for selection, e.g., the lowest responsible bidder.

(11) For awards after procurement by negotiation,___ include the information contained in the notice prescribed by 3.106-3(b) and where the award was made after competitive negotiation (either price or design competition). include a statement to this effect and state in general terms the basis for selection.

Subpart 11-Qualified Products

1.1100 Scope of Subpart. This Subpart sets forth policies and procedures to be followed only in the use of Qualified Products Lists in the procurement of microcircuits as authorized by NASA Management Instruction 5320.4, "NASA Microelectronics Reliability Program."

1.1101 General.

(a) It is sometimes necessary to qualify products in advance of any procurement action to determine if a product is available that will meet specification requirements. In such cases, the specification may require qualification of the product and, in some instances, prior Government approval of manufacturing and inspection processes and equipment as a condition to qualification. Qualification is the entire process by which products are obtained, examined, and tested for compliance with specification requirements, and then identified on a list of qualified products. Qualification is performed in advance and independent of any specific procurement action.

(b) A Qualified Products List (QPL) identifies the specification, manufacturer or distributor, item, trade name, place of manufacture, test and evaluation reports involved, and any special status ratings (See 1.11071(d)). Suppliers whose products have successfully passed qualification and who furnish evidence thereof are eligible for award although not yet included on the QPL.

(c) NASA NHB 5300.4(3F), "Qualified Products Lists Requirements for Microcircuits," is the basic instruction concerning establishment of qualified products lists providing uniform procedures and safeguards for microcircuit procurement when qualification is required. Copies of NHB 5300.4(3F) may be purchased by the public from the Superintendent of Documents, U.S. Government Printing Office, Washington, D.C. 20402.

1.1102 Responsibility for Qualification. A Federal, Military, or NASA Headquarters approved specification is the only medium for establishing a requirement for qualification. The NASA installation that prepared the specification, and identified in a detail specification, is responsible for qualification.

1.1103 Justification for Inclusion of Qualification Requirements in Procurements in Support of the NASA Microelectronics Reliability Program.

(a) NASA Headquarters Office of Reliability and Quality Assurance is responsible for justifying, determining, and approving NASA's need for inclusion and continued usage of qualification requirements in specifications under the NASA Microelectronics Reliability Program.

(b) Prior to the procurement of Class "A" microcircuit, as defined in NHB 5300.4(3F), the determination required by paragraph 3F103-2 of that handbook shall be made in writing by an authorized NASA field installation official.

(c) Qualification requirements may be included in a specification when one or more of the following conditions exist.

(i) The time required to conduct one or more of the examinations and tests to determine compliance with all the technical requirements of the specification will exceed 30 days (720 hours). (Use of this justification should advance product acceptance by at least 30 days (720 hours));

(ii) Quality conformance inspection would require special equipment not commonly available; or

(iii) It covers life survival or emergency life saving equipment.

GENERAL PROVISIONS

1.1104 Availablity of Lists. Qualified products lists are intended for the use of the Government, contractors, subcontractors, prospective bidders, and suppliers. Lists may be obtained from the NASA installation identified in the particular specifications by prospective bidders or suppliers who require these lists in furnishing supplies or services to the Government or its contractors. Lists are also available to the public upon request. When a person is provided with, or given access to, a qualified products lists, he should be advised that:

(i) the list has been prepared for use by or for the Government in the procurement of products covered by the specification and such listing of a product is not intended to and does not connote endorsement of the product by the National Aeronautics and Space Administration;

(ii) all products listed have been qualified under the requirements for the product as specified in the latest effective issue of the applicable specification;

(iii) the list may be revised or amended as necessary, and is subject to change without notice;

(iv) the listing of a product does not release the supplier from compliance with the specification requirements; and

(v) use of the information for advertising or publicity purposes is permitted, provided that such publicity or advertising does not state or imply that the product is the only product of that type so qualified, or that the line is the only line certified, or that the National Aeronautics and Space Administration in any way recommends or endorse the manufacturer's product or line.

1.1105 Opportunity for Qualification.

(a) Upon determination that a product is to be covered by a qualified products list, manufacturers shall be urged to submit their products for qualification and where possible shall be given sufficient time to arrange for qualification prior to issuance of the initial invitation for bids or request for proposals for the item as a qualified product. Appropriate notice of such determination shall be furnished to the U.S. Department of Commerce, Commerce Business Daily, 433 West Van Buren Street, Chicago, Illinois 60607, requesting publication in five consecutive issues of the daily "Synopsis of U.S. Government Proposed Procurement, Sales and Contracts Award." The publicity given to the requirement for qualification testing shall include the following:

(i) an intention to establish a qualified products list for a product;

(ii) the specification number and nomenclature of the product, and the name and address of the office to which the request for qualification should be submitted; and

(iii) notice that in making future awards consideration shall be given only to such products as have been accepted for inclusion in a qualified products list.

(b) Lists shall always be kept open for inclusion of products from additional suppliers.

1.1106 Clarification of Qualification Requirements. When there is any question concerning qualification requirements in a specification, the NASA field installation that prepared the specification will furnish clarification when requested by the NASA installation procuring the product.
