PROVISIONS OF LAW RELATING TO 1947 CENSUS OF MANUFACTURES

[From Fifteenth Census Act, approved June 18, 1929; 46 Stat. 21, 13 U.S.C. 210, 211, 217]

SECTION 17.-That the Director of the Census be, and he is hereby, authorized and directed to collect and publish, for every second year after 1927, statistics of manufacturing industries; and the director is hereby authorized to prepare such schedules as in his judgment may be necessary.

SECTION 10.-That it shall be the duty of every owner, official, agent, person in charge, or assistant to the person in charge, of any company, business, institution, establishment, religious body, or organization of any nature whatsoever, to answer completely and correctly to the best of his knowledge all questions relating to his respective company, business, institution, establishment, religious body, or other organization, or to records or statistics in his official custody, contained on any census schedule prepared by the Director of the Census under the authority of this act, or of the act to provide for a permanent Census Office, approved March 6, 1902, or of acts amendatory thereof or supplemental thereto;

and any person violating the provisions of this section by refusing or willfully neglecting to answer any of said questions shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not exceeding $500, or imprisoned for a period not exceeding 60 days, or both so fined and imprisoned, and any person violating the provisions of this section by willfully giving answers that are false shall be fined not exceeding $10,000 or imprisoned for a period not exceeding one year, or both.

SECTION 11.-That the information furnished under the provisions of this act shall be used only for the statistical purposes for which it is supplied. No publication shall be made by the Census Office whereby the data furnished by any particular establishment or individual can be identified, nor shall the Director of the Census permit anyone other than the sworn employees of the Census Office to examine the individual reports.

PROVISIONS OF LAW RELATING TO FUTURE CENSUSES OF MANUFACTURES [From Public Law 671-80th Congress; 62 Stat. 478, 13 U.S.C. 121]

AN ACT

To provide for the collection and publication of statistical information by the Bureau of the Census

SECTION 1.-That (a) the Director of the Bureau of the Census, hereinafter referred to as the Director and the Bureau, respectively, is authorized and directed to take, compile, and publish the censuses of manufacturers, of mineral industries, and of other businesses, including the distributive trade, service establishments, and transportation (exclusive of means of transportation for which statistics are required by law to be filed with a designated regulatory body), in the year 1949 and every fifth year thereafter, and each such census shall relate to the year

immediately preceding the taking thereof; Provided, That the census of manufacturers shall not be taken in 1949. The censuses herein provided for shall include the United States and its Territories and such possessions as may be determined by the Director with the approval of the Secretary of Commerce.

(b) That the Director is further authorized to make such surveys as are deemed necessary to furnish annual and other interim current data on the subjects covered by the censuses provided for in this and other Acts.

CENSUS REPORT FORMS AND PUNCH CARDS

The report form shown on pages 267-275, Form MC-33H, is an example of the 208 standard forms used in the 1947 Census of Manufactures. Parts I through VI are the same on nearly all standard forms. Part VII is a special inquiry adapted to the requirements for information on production of commodities by different industries. Part VIII, Section A, which deals with consumption of materials, appears only on selected schedules and is also adapted to the requirements of individual industries. Part VIII, Section B, is included in schedules sent to establishments performing metalworking operations.

The report form shown on pages 280 and 281 of this appendix, Form MC-100A, was sent to small establishments in selected industries. The general inquiries included on this form were greatly abridged, and the product inquiry (Part VII) permitted the

manufacturer to describe his principal products in his own words. Smaller establishments in the lumber and most printing and publishing industries received forms, on which the general inquiries were essentially the same as those on MC-100A, but the product inquiry consisted of a preprinted list suitable to the industry.

The instructions for preparing these reports are also shown below. Instruction MC-1 accompanied the schedules sent to independent manufacturers (owning or operating one manufacturing establishment) and Instruction MC-2 accompanied those sent to multiple-establishment companies (operating two or more manufacturing establishments).

The census punch cards are shown on pages 282 and 283.

Everyone to whom a Census of Manufactures schedule is addressed is required
by law to make a return. Complete answers to all questions must be supplied
for each manufacturing establishment. You are requested to complete and
return this schedule within 30 days after its receipt. If additional lime is
required, a request for an extension should be addressed to the Director, Bureau
of the Census, Washington 25, D. C., stating the reasons for the request and the
additional time needed. RETAIN THE GREEN COPY FOR YOUR FILES.
If this establishment was not in business or did not operate at any time during
the calendar year 1947, explain briefly under "Remarks," execute the certifica-
tion, and return the schedule immediately.

for example, a factory, mill, or plant. Where a single physical location com-

PART II-EMPLOYMENT AND PAYROLLS

ANALYSIS OF PAYROLL ENDED NEAREST OCTOBER 15, 1947-Persons employed include only those employees attached to the manufacturing establishment covered by this report. When this report is for one of several manufacturing establishments operated by the same concern, the employees attached to the general administrative office of this concern should not be reported on this form.

Include all full-time and pai time employees who worked or received pay for any part of the pay period ended nearest October 15, 1947, and all persons on paid sick leave, paid holidays, and paid vacation during this pay period. Exclude all other persons, such as members of the armed forces and pensioners, carried on your active rolls but not working during this pay period.

DEFINITIONS

Item 8a.-PRODUCTION AND RELATED WORKERS.-Report working foremen and all non-
supervisory workers (including lead men and trainees) engaged in fabricating, processing,
assembling, inspection, receiving, storage, handling, packing, warehousing, shipping, mainte-
nance, repair, janitorial, watchman services, product development, auxiliary production for
plant's own use (e. g., power plant), and record-keeping and other services closely associated
with the above production operations. Exclude supervisory employees above the working.
foreman level and their clerical staffs,

Item 8b.-FORCE-ACCOUNT CONSTRUCTION WORKERS.-Report employees on your
payroll engaged in construction of major additions or alterations to the plant who are utilized
as a separate work force. Do not include workers engaged in regular maintenance and repair
operations who should be reported in item 8a.

Item 8c(2)-ALL OTHER EMPLOYEES.-Report all employees not classified in any one of the
above categories. This will include employees engaged in executive, purchasing, finance,
legal, personnel (including cafeteria, medical, etc.), professional, and technical activities, sales,
sales delivery (including driver-salesmen), advertising, credit, collection, Installation and servic
ing of establishment's product, and factory supervision above the working-foreman level. Where
manufacturers have classified their employees for purposes of the Fair Labor Standards Act
and have reported subject employees in 8c(1), report here employees exempt from the minimum
wage and overtime provisions of that Act.
