MY DEAR MR. CHAIRMAN: The bill (H. R. 4129) for the relief of Edward M. Holian was referred to the Navy Department by your committee with a request for report and recommendation.

The purpose of this bill is to consider Edward M. Holian, as having been honorably discharged from the naval service on January 9,

1918.

The records of the Navy Department show that Holian was born on December 2, 1895, and on June 14, 1917, enrolled in the Naval Reserve. His record shows the following offenses:

October 17, 1917: Absent without leave 4 hours; summary court martial. December 12, 1917: Absent without leave 3 hours; summary court martial and sentenced to a bad-conduct discharge from the Naval Reserve which was effected on January 9, 1918, at the naval hospital, Chelsea, Mass.

This bill, if enacted into law, would result in no cost to the Navy; however, it is probable that a charge under the Veterans' Administration would be involved now or in the future.

The Navy Department recommends against the enactment of the bill H. R. 4129.

FOR THE RELIEF OF DANIEL JOSEPH HARTIE (H. R. 4131). MR.

MY DEAR MR. CHAIRMAN: The bill (H. R. 4131) for the relief of Daniel Joseph Hartie was referred to the Navy Department by your committee with a request for report and recommendation.

The purpose of this bill is to consider Daniel Joseph Hartie as having been honorably discharged from the naval service on April 10, 1899.

The records of the Navy Department show that Daniel Joseph Hartie was born on March 15, 1870, and enlisted in the Navy on July 12, 1898, to serve for a period of 3 years. Hartie's service record shows two offenses of absence over leave, for which he was punished by his commanding officer at mast. On February 23, 1899, Hartie was tried and convicted by summary court martial for being under the influence of intoxicating liquor on board the U. S. S. Yosemite and thereby unfit for duty, and sentenced to solitary confinement and loss of pay. He was again tried by summary court martial on March 23, 1899, for absenting himself from the U. S. S. Yosemite without leave from proper authority, and sentenced to be discharged from the naval service with a bad-conduct discharge. The badconduct discharge was effected on April 10, 1899.

This bill, if enacted into law, would result in no cost to the Navy; however, it is probable that a charge under the Veterans' Administration would be involved now or in the future.

The Navy Department recommends against the enactment of the bill H. R. 4131.
