The Committee on Foreign Relations discharged; considered and agreed to

RESOLUTION

To establish a Special Committee on the Termination of the National Emergency.

Whereas the existence of the state of national emergency proclaimed by the President on December 16, 1950, is directly related to the conduct of United States foreign policy and our national security: Now, therefore, be it

Resolved, That (a) there is established a special com

2 mittee of the Senate to be known as the Special Committee 3 on the Termination of the National Emergency (hereinafter 4 referred to as the "special committee”).

5 (b) The special committee shall be composed of eight 6 Members of the Senate equally divided between the majority 7 and minority parties to be appointed by the President of

1 the Senate, four of whom shall be members of the Com

2 mittee on Foreign Relations.

3 (c) The special committee shall select two co-chairmen

4 from among its members, one from the majority party and

5

one from the minority party. A majority of the members of 6 the special committee shall constitute a quorum thereof for 7 the transaction of business, except that the special committee 8 may fix a lesser number as a quorum for the purpose of 9 taking testimony. Vacancies in the membership of the special 10 committee shall not affect the authority of the remaining 11 members to execute the functions of the special committee. SEC. 2. It shall be the function of the special committee 13 to conduct a study and investigation with respect to the mat14 ter of terminating the national emergency proclaimed by the 15 President of the United States on December 16, 1950, and 16 announced in Presidential Proclamation Numbered 2914, 17 dated the same date. In carrying out such study and investi18 gation the special committee shall

(1) consult and confer with the President and his advisers;

(2) consider the problems which may arise as the result of terminating such national emergency; and

(3) consider what administrative or legislative actions might be necessary or desirable as the result of terminating such national emergency, including consid

eration of the desirability and consequences of terminating special legislative powers that were conferred on the President and other officers, boards, and commissions as

the result of the President proclaiming a national emergency.

SEC. 3. (a) For the purposes of this resolution, the 7 special committee is authorized in its discretion (1) to 8 make expenditures from the contingent fund of the Senate, 9 (2) to employ personnel, (3) to hold hearings, (4) to sit 10 and act at any time or place during the sessions, recesses, and 11 adjourned periods of the Senate, (5) to require, by subpena 12 or otherwise, the attendance of witnesses and the production 13 of correspondence, books, papers, and documents, (6) to 14 take depositions and other testimony, (7) to procure the 15 service of individual consultants or organizations thereof, in 16 accordance with the provisions of section 202 (i) of the Leg17 islative Reorganization Act of 1946, as amended, and (8) 18 with the prior consent of the Government department or 19 agency concerned and the Committee on Rules and Admin20 istration, to use on a reimbursable basis the services of per21 sonnel of any such department or agency.

22 (b) The co-chairmen of the special committee shall 23 preside over meetings of the special committee, except that 24 (1) in the absence of one of the co-chairmen, the other co25 chairman may preside, and (2) in the absence of both co

1 chairmen, any other member of the special committee des2 ignated by both co-chairmen may preside.

3 (c) Either co-chairman of the special committee or any 4 member thereof may administer oaths to witnesses.

5 (d) Subpenas authorized by the special committee may 6 be issued over the signature of either co-chairman, or any 7 other member designated by the co-chairmen, and may be 8 served by any person designated by the co-chairman or 9 member signing the subpena.

SEC. 4. For the period from January 3, 1973, through 11 February 28, 1974, the expenses of the special committee 12 under this resolution shall not exceed $175,000, of which 13 amount not to exceed $25,000 shall be available for the 14 procurement of the services of individual consultants, or 15 organizations thereof, as authorized by section 202 (i) of the 16 Legislative Reorganization Act of 1946, as amended. 17 SEC. 5. The special committee shall make a final report 18 of its findings, with respect to such period together with such 19 recommendations for legislation as it deems advisable, to the 20 Senate at the earliest practicable date, but not later than 21 February 28, 1974. The special committee may also submit 22 to the Senate such interim reports as it considers appropriate. 23 Upon submission of its final report, the special committee 24 shall cease to exist.

2 resolution shall be paid from the contingent fund of the Sen

3 ate upon vouchers approved by the two co-chairmen of the 4 special committee.
