(a) Arsenical compounds Care shall be exercised in the loading and unloading of "arsenical dust", "arsenic trioxide", and "sodium arsenate", allowable to be loaded into siftproof, steel hopper-type or dump-type motor-vehicle bodies equipped with water-proof, dust-proof covers well secured in place on all openings, to accomplish such loading with the minimum spread of such compounds into the atmosphere by all means that are practicable; and no such loading or unloading shall be done near or adjacent to any place where there are or are likely to be, during the loading or unloading process assemblages of persons other than those engaged in the loading or unloading process, or upon any public highway or in any public place.

(b) No class A or class C poisons in cargo tanks. No dangerous poison, class A, or any tear gas or irritating substance, class C, may be loaded into or transported in any cargo tank.

(c) Class A or class C poisons. It shall not be permissible to transport class A or class C poisons if there be any interconnecting means of any character between the containers.

NOTE 1: Tanks complying with ICC-106A (§ 178.275 or 178.276 of this chapter) specification containing class A or B poisons as authorized in §§ 173.333 (a) (2), 173.336 (a) (3), 173.338 (a) (3), 173.353 (a) (5) and 173.357 (b) (4) of this chapter may be transported in or on motor vehicles and in the manner authorized in § 177.840 (c), provided adequate facilities are present for handling tanks where transfer in transit is necessary. Tanks must be securely chocked or clamped thereon to prevent shifting.

(d) Radioactive material. A container of radioactive material, red label, must not be placed in vehicles, terminals, or other places closer than 3 feet to an area which may be continuously occupied by passengers, employees, or shipments of animals. When more than one such container is present, the distance from occupied areas must be computed from the table in subparagraph (1) of this paragraph by adding the number of units shown on labels on the containers.

(1) A container of radioactive material, red label, must not be placed closer than 15 feet to any package containing undeveloped film. If more than one such container is present the distance must be computed from the table in this subparagraph by adding the num

NOTE 1: The distance in the table must be measured from the nearest point of the radioactive container or containers.

(2) Shipments of radioactive materials as provided for in § 173.393 of this chapter shall be loaded and stored such that the number of radiation units (§ 173.391(b) of this chapter) in any car, vehicle or storage location does not exceed 40, as determined by totaling the number of radiation units shown on the individual labels on the packages. The provisions of this "40-unit rule" do not apply to sole-use shipments described in § 173.392 or § 173.393 of this chapter.

(3) All containers of radioactive material, red label, must be carried by the handles when handles are provided.

(4) Shipments of radioactive materials of low specific activity, loaded in accordance with § 173.392 (c) of this chapter, must be loaded so as to avoid spillage and scattering of loose material.

(5) Packages must be so blocked and braced that they cannot change position during conditions normally incident to transportation.

NOTE 1: The requirements of this paragraph shall not apply to magnesium-thorium alloy materials or uranium, normal or depleted, described in § 173.392 (e) and (f) of this chapter. The location of bundles, boxes, barrels, or crates of such material from packages of undeveloped film must be as stated on the label (see § 173.414(e) of this chapter).

(e) Poisonous liquids or solids, class B, must not be transported in the same vehicle with any foodstuffs, feeds, or any other material intended for consumption by humans or animals which are not packaged in air tight nonpermeable containers.
