DEAR BEN: Please be advised that the contract for the new plant has passed the Office of the Secretary of the Navy approved.

However, in discussing this matter with Capt. Blank this morning, he informs me they are doing everything they can to expedite same but the machine tools will have to be checked to determine whether or not you are ordering a sufficient quantity or whether you are ordering too many and he feels it will take at least 2 weeks longer before they will be able to send it to you. Furthermore, they will have to write an addendum to this contract as you have not shown in same an optional price for the leased land in the event the Government desires to take it over. Therefore, please write such a letter in triplicate and send it to the writer. In reference to the proposal for the loading of these cartridge cases, this has also been approved and should be sent to you within the next three or four days. It is now on its way to the Bureau of Supplies & Accounts.

GENTLEMEN: Enclosed are four copies of our tire chain catalog. Each of the other members, who will receive a copy of this letter Special Delivery, will please see to it that four copies of their present catalog are mailed to you Special Delivery. Acting as agent for our group of licensees, we wish you to bid 531⁄2% from catalog_prices, delivered.

If the Treasury Department can furnish Priority A-1-F, or better, we can ship their orders in 10 to 15 days after receipt. A-10 to 1-A-F Priority orders can be shipped within 30 days-with no priority, shipment can be made only as material is available for civilian needs.

Cash discount terms: 2%, 10 days; 1%, 20 days; net, 30 days.

Prices include prepaying shipments to destination within the United States. The Treasury Department has never issued a Federal Excise Tax Exemption Certificate, hence we do not believe there should be any mention about Excise Tax, but you should know in the event they bring up the question, we would allow whatever Excise Tax they would permit us to deduct in our payment of Excise Tax to them on this commodity.

1. Amounts and dates of payments made during the years 1939, 1940, 1941, and 1942 to the firm of Shirley, Olcott & Nichols, Mills Building, Washington, D. C. If not employed by your company during all of these years, state payments made to them since their employment.

2. Amount of money due, or that will become due, to Shirley, Olcott & Nichols from your company as a sales commission when payment is received for materials or services furnished by your company to the United States.

3. For each contract obtained by your company from the United States during Shirley, Olcott & Nichols' employment during the above years please furnish

(a) Contract number.

(b) Contract amount.

(c) Government department or agency.

4. The circumstances surrounding the hiring of Shirley, Olcott & Nichols as Washington representatives of your company; please furnish a full explanation as to whether your company was solicited by Shirley, Olcott & Nichols or whether you sought their services.

A full and complete reply to the above questions in the form of an affidavit will obviate the necessity of subpenaing the books and records of your company to obtain this information. The affidavit must be received not later than
