SEC. 2. That authority for the said easement is granted upon the conditions that the said highway shall be constructed and maintained by the city of New York without expense to the United States; that the area of land under water between mean high-water line and the inshore line of said highway, as laid out, shall be filled up to the grade established for said highway, such fill to be made by said city without expense to the United States; and that the construction and maintenance of said high- etc., from Fort Hamilton, way under the easement herein granted shall be subject pass, etc. to such terms and conditions as may be prescribed by the Secretary of War for the protection of the reservation and the Fort Hamilton Wharf from trespass and other improper use, as well as for the construction of suitable means of access from said highway to the reservation; the terms and conditions, so prescribed, to be performed by said city without expense to the United States. CHAP. 758.-An Act To authorize the Secretary of War to grant easements in and upon the public lands and properties at Canal Bridge, on the Fox River, in Kaukauna, Wisconsin, to the city of Kaukauna for public-road purposes.

Be it enacted by the Senate and House of Representatives Wis., granted of the United States of America in Congress assembled, right of way over That the Secretary of War be, and he is hereby, authorized, empowered, and directed, under such terms and conditions as are deemed advisable by him, to grant to the city of Kaukauna, Wisconsin, an interminable easement for a right of way over, across, in, and upon the Government land consisting of the right canal bank and that portion lying between the said canal at the juncture of the canal bridge and the new municipal bridge and also the lands immediately adjacent to the left end of the canal bridge and including the left canal bank proper, the said grant being for the purpose of creating the right of way over the Government property to and from the new municipal bridge, with permission to lay necessary pavements and roadway, subject to the condition that the United States may require the city to vacate any part of the right of way thus created or make such changes in the layout of the roadway or the pavements as may be necessitated by future improvements of the canal in the interests of navigation.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Interior be, and he is hereby, authorized and directed to have an examination and investigation made of the swamp and overflow lands on for reclaiming, the Yazoo, Tallahatchie, and Coldwater Rivers in the etc. State of Mississippi, with a view to determining the area, location, and general character of the swamp and overflow lands in the valley of the Yazoo River and its said tributaries, which can be developed and reclaimed at a reasonable cost, and the character, extent, and cost of a reclamation and development system of the swamp and overflow lands along the Yazoo River and its said tributaries.

That the said Secretary shall also report as to the extent, if any, to which in his opinion, the United States should contribute to the cost of carrying out the plan or plans which he may propose; the approximate proportion of the total cost which should be borne by the various drainage districts or other public agencies now organized or which may be organized; the manner in which their contribution should be made; to what extent and in what manner the United States should control, operate, or supervise the carrying out of the plan proposed, and what assurances he has been able to secure as to the approval of, participation in, and contribution to, the plan or plans proposed by the various contributing agencies.

CHAP. 430.--An Act For the relief of Washington County, Ohio, S. C. Kile estate, and Malinda Frye estate.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, Muskingum That the Secretary of the Treasury be, and he is hereby, authorized and directed to pay, out of any money in the ignated claims for Treasury not otherwise appropriated, the sum of flood damages, au- $1,518.30 to Washington County, Ohio, the sum of $3,800 to the estate of S. C. Kile, and the sum of $1,680 to the estate of Malinda Frye, 20 per centum of the two latter amounts to be withheld until title to the land damaged and covered by the adjustment shall have been conveyed to the United States. Payment of these sums shall be in full settlement of all claims arising out of this break in Dam Numbered 3, Muskingum River.

Such sums represent the amount of damages, as determined by the Chief of Engineers, United States

Army, resulting from a break, during the winter of 19191920, in Dam Numbered 3, Muskingum River.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the President of the United States is hereby authorized to issue a patent to Joseph Mayhew, of Bowdoin, Montana, for the northwest quarter of the southwest quarter and lot 12 of section 5, township 30 north, range 32 east, Montana principal meridian, subject to a lien to the United States for the payment of the construction and operation and maintenance charges for the Milk River project, Montana, and subject also to the right of way reserved to the United States for ditches and canals under the Act of August 30, 1890 (Twenty-sixth Statutes, page 391): Provided, That prior to the issuance of such patent, the said Joseph Mayhew and all other parties ages having an interest in or a lien upon the north half of the southeast quarter and the southwest quarter of the southeast quarter of section 6, township 30 north, range 32 east, Montana principal meridian, shall release the United States from liability on all present or future claims for damage by seepage to said land in said section. 6: And provided further, That nothing herein shall be construed as an admission that said claims for damage by seepage would be valid, if the United States were liable to suit thereon.
