§ 200.80

Fiscal Officer and Deputy.

To the position of Fiscal Officer, and under his general supervision to the position of Deputy Fiscal Officer, there is delegated the following basic authority and functions:

(a) To direct the activities of the Fiscal Branch.

(b) To devise and establish fiscal procedures and to administer the fiscal policies and activities of the Administration.

(c) To approve all operating and property expenditures and receipt vouchers necessary to carry out the provisions of the National Housing Act upon his determination that they are in accordance with applicable regulations, decisions and laws.

(d) To certify that all required documents, information and approvals with respect to operating and property expense and debenture transactions are present; to vertify the accuracy of the computations and the consistency of the information included in the various documents; to determine that the transactions are in strict accordance with all applicable regulations, decisions and laws; to execute Certificates of Claim; to certify requisitions to the Treasury Department for the issuance of debentures; and to certify vouchers for cash settlement of claims.

(e) To approve or disapprove amounts claimed by mortgagees in debentures or cash settlements, including amounts claimed for operating, protecting and preserving properties prior to conveyance to the Commissioner.

(f) To extend the period of time for submission of fiscal data or title evidence supporting a mortgagee's application for debentures.

To the position of Procedures Officer, and under his general supervision to the position of Deputy Procedures Officer for Accounting Systems with respect to paragraphs (a), (b), (f), (g), (h), and (j) of this section and to the position of Deputy Procedures Officer for Automatic Data Processing with respect to paragraphs (c), (d), and (e) of this section, there is delegated the following basic authority and functions:

(a) To initiate, develop, and maintain an accounting systems and procedures program for the Administration.

(b) To coordinate and direct a program to preserve or reconstruct basic records of the Administration for Civil Defense purposes and in the event of a national emergency.

(c) To serve as a member of the Departmental ADP Services Management Advisory Committee.

(d) To advise the FHA Automatic Data Management Board with respect to data, information, and reports requirements of the Administration, recommending systems and procedures for gathering the input data for processing by the Departmental Office of ADP Systems Management and Operations.

(e) To maintain liaison with the Office of ADP Systems Management and Operations with respect to FHA fiscal and reporting operations.

(f) To prepare for the Assistant Secretary-Commissioner letters to FHA approved mortgagees and lenders pertaining to fiscal and accounting procedures.

(g) To provide advice within FHA concerning field office accounting, fiscal insurance servicing procedures, assessability of fees, and the interpretation of related procedures.

(h) To review for fiscal implications proposed agreements with other Government agencies establishing procedures pertaining to special-purpose programs.

(i) To provide liaison service with the Treasury Department pertaining to depositary facilities for FHA field offices. (j) To maintain archives files of the Administration.

Reports Officer and Deputy.

To the position of Reports Officer, and under his general supervision to the position of Deputy Reports Officer, there is delegated the following basic authority and functions:

(a) To direct the activities of the Financial Reports Branch.

(b) To devise and establish basic policies, practices, and procedures with respect to the preparation, analysis, and interpretation of the financial statements and fiscal reports of the Administration, and to direct the preparation of such statements and reports.

(c) To maintain effective control over the management of the various FHA insurance funds and accounts and to provide adequate financial information pertaining thereto.

(d) To submit to the Treasury Department authorizations for purchase of U.S. Government securities, pursuant to agreements between mortgagors or other depositors and FHA, and sales and disposition of U.S. Government securities purchased for mortgagors or other depositors, received as a result of assignment of insured mortgages or as a result of other agreements; U.S. Government securities deposited in accordance with mortgagor corporate charters, regulatory or special agreements, for safekeeping; and requests for withdrawal of U.S. Government securities.

(e) To execute and certify vouchers in payment of U.S. Government securities invested for the various insurance funds and/or pursuant to agreements between mortgagors or other depositors and FHA.

(f) To execute and certify vouchers to provide funds in the account of the Treasurer of the United States for payment of principal and interest on FHA debentures, for the repayment of borrowed funds and interest thereon, and for return to the Treasury Department of surplus funds arising out of operations of certain accounts.

(g) To execute and submit to the Treasury Department and/or to the Bureau of the Budget inter-governmental financial reports required by applicable statutes or regulations of the Treasury Department or Bureau of the Budget.

(h) To maintain liaison with the General Accounting Office, Treasury Department, Bureau of the Budget, and the Secretary of Housing and Urban Development on matters pertaining to financial activities, and with the Federal National Mortgage Association concerning the acceptance of debentures in exchange for mortgages held by the Secretary of Housing and Urban Development.

(i) To act with the Assistant Commissioner-Comptroller and under his direction in the determination of basic financial management and reporting policy.

(j) To determine the present and future cash requirements of the various insurance funds and accounts, and to recommend investment, borrowing and repayment transactions.

(k) To prepare certifications to Department of Defense, National Aeronautics and Space Administration, and Atomic Energy Commission of operating losses incurred by FHA under Armed Services Housing Insurance programs as provided for in agreements.

§ 200.83 Assistant Commissioner for Property Disposition and Deputy.

To the position of Assistant Commissioner for Property Disposition and under his general supervision to the position of Deputy Assistant Commissioner for Property Disposition there is delegated the following basic authority and functions:

(a) To direct the activities of the Property Disposition Division.

(b) To formulate procedures for the operation and management of all properties conveyed to the Federal Housing Commissioner, all properties held during foreclosure proceedings by the Commissioner as mortgagee in possession pursuant to court orders, and all properties held pursuant to the agreement entered into between the Department of Defense and the Department of Housing and Urban Development with respect to section 1013 of the Demonstration Cities and Metropolitan Development Act of 1966.

(c) To develop and maintain a program for the management, operation and disposition of all properties conveyed to the Federal Housing Commissioner and, as required, to operate and manage such properties, properties held as mortgagee in possession, and all properties held pursuant to the agreement entered into between the Department of Defense and the Department of Housing and Urban Development with respect to section 1013 of the Demonstration Cities and Metropolitan Development Act of 1966, in accordance with general policies promulgated by the Property Management Committee and approved by the Commissioner, including authority with respect to such property to:

(1) Approve offers to rent or purchase, except that offers to purchase 12 or more living units acquired by the Commissioner under any title of the Act shall be subject to the approval of the Property Disposition Committee.

(2) Make repairs, alterations and improvements.

(3) Execute such contracts, leases, assignments and instruments as may be necessary in the rental or sale of such properties other than deeds or other documents in connection with the conveyance of title, deeds of release, assignments or satisfactions of mortgages, deeds of trust or other liens taken as security in connection therewith.

(4) Authorize expenditures.

(d) To handle and dispose of claims of the mortgagee against the mortgagor or others arising out of mortgage transactions and assigned to the Commissioner in connection with home mortgage insurance operations.

Assistant Commissioner for Property Disposition; Director, Community Disposition Staff; Assistant to the Director, Community Disposition Staff; Field Director (Community Disposition) and Assistant Field Director (Community Disposition). (a) To the position of Assistant Commissioner for Property Disposition and, under his general supervision, to the positions of Director, Community Dis

position Staff, and Assistant to the Director, Community Disposition Staff, there is hereby delegated the authority to execute the functions, powers and duties delegated to the Assistant Secretary for Mortgage Credit and Federal Housing Commissioner under delegation of the Secretary of Housing and Urban Development effective June 5, 1966 (31 F.R. 6839).

(b) To the positions of Field Director (Community Disposition) and Assistant Field Director (Community Disposition), there are delegated the following authorities with respect to the functions referred to in paragraph (a) of this section:

(1) To execute any deed, contract to purchase (installment contract of purchase), offer, acceptance, or other form of contract of sale, or other instrument, in connection with the disposition of the Government's interest in property at such communities, or lease of such property.

(2) To make the finding concerning the availability of financing on reasonable terms from sources other than the Secretary of Housing and Urban Development under section 62 of the Atomic Energy Community Act of 1955, as amended (42 U.S.C. 2362), in connection with the disposition of the Government's interest in such property.

(3) To endorse any checks or drafts in payment of insurance losses on which the United States of America, acting by and through the Housing and Home Finance Administrator or the Secretary of Housing and Urban Development, or the successors or assigns of either of them, is a payee (joint or otherwise) in connection with the disposition of the Government's interest in property at such communities or lease of such property.

(c) Each of the officials named in paragraphs (a) and (b) of this section is authorized to execute any contract for advertising under Rev. Stat. § 3828 (44 U.S.C. 324) in connection with the disposition of property within the respective authority hereunder.

§ 200.84b Field Office Directors, Deputies, and Assistants.

To the position of Field Office Director, and to each of them; and to the position of Deputy Field Office Director, and to each of them under the general supervision of the Field Office Director having jurisdiction; and to the position of Assistant Field Office Director, and to each of them under the general supervision of the Field Office Director having jurisdiction there is delegated the basic authority and function to direct and supervise all activities of the Federal Housing Administration in the geographical area under his jurisdiction. (c) To assist the Intergroup Relations Service, the Deputy Employment Policy Officers, and the Deputy Contracts Compliance Officers with compliance activities under the Executive Orders for equal opportunity in housing, equal employment opportunity in government and on government contracts and governmentassisted contracts.

DELEGATIONS TO COMMITTEES

§ 200.85 Executive Board.

(a) Members. The committee called the Executive Board is comprised of the following members: Assistant SecretaryCommissioner, Chairman; Deputy Commissioner, Vice Chairman; Executive Assistant Commissioner; Assistant Commissioner for Field Operations; General Counsel; Assistant Commissioner for Home Mortgages; Assistant Commissioner for Multifamily Housing; Assistant Commissioner for Property Improvement; Assistant Commissioner for Technical Standards; Assistant Commissioner for Programs; Assistant Commissioner for Administration; Assistant Commissioner-Comptroller; Assistant Commissioner for Property Disposition; Assistant to the Commissioner, Intergroup Relations; and Director, Audit Division.

(b) Functions. The functions of the Executive Board are to consider and advise with respect to basic policy, plans and general program matters of the Administration.

(c) Minutes. The Commissioner shall designate a secretary to the Board who shall prepare minutes of each Board meeting, which shall constitute the official record of matters considered and actions taken by the Board. Such minutes shall be dated consecutively numbered and shall be signed by each member who attended the meeting The original of such minutes shall be retained by the Assistant CommissionerComptroller, in the official FHA records. § 200.86 Security Committee.

(a) Members. The Security Committee is comprised of the following members: Personnel Security Officer, Chairman; Assistant Commissioner for Administration, Vice Chairman; and Deputy Assistant Commissioner for Field Operations.

(b) Functions. The functions of the Security Committee are:

(1) To make recommendations to the Commissioner from time to time with respect to the designation of sensitive positions under the Security Regulations of the FHA, or the revocation of such designations.

§ 200.87 Management Improvement

Committee.

(a) Members. The Management Improvement Committee is comprised of the following members: Director of Management Division, Chairman; Director of Personnel, Vice Chairman; and one designee of each of the following: Assistant Commissioner-Comptroller; Assistant Commissioner for Multifamily Housing; Assistant Commissioner for Property Improvement; Assistant Commissioner for Technical Standards; Assistant Commissioner for Home Mortgages; Assistant Commissioner for Property Disposition; and Director of Budget Division.

(b) Functions. The functions of the Management Improvement Committee are to maintain and operate an FHA Employee Suggestion System within the framework of the over-all Employee Awards Program.

§ 200.88 Property Disposition Commit

tee.

(a) Members. The Property Disposition Committee is comprised of the following members: Deputy Commissioner, Chairman; Assistant Commissioner for Field Operations; General Counsel; Assistant Commissioner for Home Mortgages; Assistant Commissioner for Multifamily Housing; Assistant Commissioner for Technical Standards; Assistant Commissioner for Property Disposition; and such other members as the Commissioner shall designate.

(b) Functions. The functions of the Property Management Committee are:

(1) To pass upon and determine the action to be taken with respect to the acceptance or rejection of any offer to purchase a property of 12 or more living units or any mortgage acquired by the Commissioner in connection with multifamily housing mortgage insurance under any title of the Act, the sale and terms of sale of mortgages taken as security in connection with the sale of such properties, and to establish general policies with respect to the disposition of acquired properties and mortgages. The minutes of the Committee reflecting its determinations shall constitute the basis of acceptance or rejection of such offers and the execution of all documents and instruments relating and incident thereto by the Assistant Commissioner for Property Disposition or his Deputy.

(2) To determine whether or not an expenditure is "necessary to carry out the provisions" of Titles I, II, VI, VII, VIII and IX as such term is used in section 1 of the National Housing Act, and to approve such expenditure for and on behalf of the Commissioner whenever such a determination and approval is, in the opinion of the General Counsel, necessary to support the legal authority of the Commissioner to make such expenditure.

(3) In connection with the functions of this committee, the Chairman is authorized to execute in the official name of the Commissioner, as his agent, all
