of Land Management to maintain such roads, trails, lands,

or facilities in a satisfactory condition commensurate with 4 the particular use requirements and the use made by each, 5 the extent of such maintenance to be shared by the users in 6 proportion to such use or, if such maintenance cannot be so 7 provided, to deposit sufficient money to enable the Secretary 8 to provide such maintenance. Such deposits shall be credited 9 to a separate account in the Treasury and are hereby appro10 priated and made available until expended, as the Secretary may direct, to cover the cost to the United States of the main12 tenance of any road, trail, lands, or facility under the juris13 diction of the Bureau of Land Management: Provided, That 14 nothing in this subsection shall be construed to require the user or users to provide maintenance or deposits to repair 16 any damages attributable to general public use rather than 17 the specific use or uses of such user or users.

(c) Any moneys collected under this Act in connection 19 with lands administered under the Act of August 28, 1937

20 (50 Stat. 874), as amended, shall be expended for the 21 benefit of such land only.

(d) If any portion of a deposit or amount forfeited 23 under this Act is found by the Secretary to be in excess of the 24 cost of doing the work authorized under this Act, the amount 25 in excess shall be transferred to miscellaneous receipts.

SEC. 305. CONTRACTS FOR CADASTRAL SURVEY OPER

2 ATIONS AND RESOURCE PROTECTION. (a) The Secretary 3 is authorized to enter into contracts for the use of aircraft,

4 and for supplies and services, prior to the passage of an 5 appropriation therefor, for airborne cadastal survey and resource protection operations of the Bureau of Land Man7 agement. He may renew such contracts annually, not more 8 than twice, without additional competition. Such contracts. 9 shall obligate funds for the fiscal years in which the costs are incurred.

(b) Each such contract shall provide that the obligation 12 of the United States for the ensuing fiscal years is contingent 13 upon the passage of an applicable appropriation, and that no 14 payment shall be made under the contract for the ensuing 15 fiscal years until such appropriation becomes available for 16 expenditure.

17 SEC. 306. UNAUTHORIZED USE.-The use, occupancy, 18 or development of any portion of the national resource lands 19 contrary to any regulation of the Secretary or other respon20 sible authority, or contrary to any order issued pursuant to 21 any such regulation, is unlawful and prohibited.

SEC. 307. ENFORCEMENT AUTHORITY.— (a) Any vio

23 lation of regulations which the Secretary issues with respect 24 to the management, protection, development, acquisition, and 25 conveying of the national resource lands and property lo

1 cated thereon and which the Secretary identifies as being

2 subject to this section shall be punishable by a fine of not

3

more than $1,000 or imprisonment for not more than twelve 4 months, or both. Any person charged with a violation of 5 such regulation may be tried and sentenced by any United 6 States magistrate designated for that purpose by the court 7 by which he was appointed, in the same manner and sub8 ject to the same conditions and limitations as provided for in section 3401 of title 18 of the United States Code.

(b) At the request of the Secretary, the Attorney Gen

11 eral may institute a civil action in any United States district court for an injunction or other appropriate order to prevent 13 any person from using the national resource lands in viola

14

tion of laws or regulations relating to lands or resources 15 managed by the Secretary.

(c) For the specific purpose of enforcing any law or 17 regulation relating to lands or resources managed by the Sec18 retary, the Secretary may designate any employee to (i)

19

carry firearms; (ii) execute and serve any warrant or other 20 process issued by a court or officer of competent jurisdiction;

(iii) make arrests without warrant or process for a mis22 demeanor he has reasonable grounds to believe is being com

23

mitted in his presence or view, or for a felony if he has 24 reasonable grounds to believe that the person to be arrested

25 has committed or is committing such felony; (iv) search

without warrant or process any person, place, or conveyance

as provided by law; and (v) seize without warrant or process

3 any evidentiary item as provided by law.

SEC. 308. COOPERATION WITH STATE AND LOCAL

5 LAW ENFORCEMENT AGENCIES.-In connection with ad6 ministration and regulation of the use and occupancy of the 7 national resource lands, the Secretary is authorized to co8 operate with the regulatory and law enforcement officials of 9 any State or political subdivision thereof. Such cooperation 10 may include reimbursement to a State or its subdivision for 11 expenditures incurred by it in connection with activities. 12 which assist in the administration and regulation of use and 13 occupancy of national resource lands.

SEC. 309. CALIFORNIA DESERT AREA.-(a) The Congress finds that

(1) the California desert contains historical, scenic, archeological, environmental, biological, cultural, scientific, and educational resources that are unique and irreplaceable;

(2) the desert environment is a total ecosystem that is extremely fragile, easily scarred, and slowly healed;

(3) the desert environment and its resources, including certain rare and endangered species of wildlife, plants, and fishes, and numerous archeological and his

toric sites, are seriously threatened by air pollution, in

adequate Federal management authority, and pressures

of increased use, particularly recreational use;

(4) because of the proximity of the California desert to the rapidly growing population centers of southern California, these threats are certain to intensify;

(5) the Secretary has initiated a comprehensive planning process and established an interim management program for the California desert; and

(6) to insure further study of the relationship of man and the desert environment and preserve the unique

and irreplaceable resources of the California desert, the public must be provided more opportunity to participate

13 in such planning and management, and additional man

agement authority must be provided to the Secretary to enable effective implementation of such planning and management.

(b) It is the purpose of this section to provide for the 18 immediate and future protection and management of the 19 California desert within the framework of a program of 20 multiple use and the maintenance of environmental quality. (c) (1) For the purpose of this section, the "California desert area" is the area generally depicted on a map entitled "California Desert Area-Proposed", dated April 1974, and
