D. Is it readily apparent that the local economy will be unduly disrupted by recognition of the offered base property?

E. Advice to Lien older. Have lien holders of record been timely advised of the assignment by certified notice? Timely advised means far enough in advance to have taken some action if desired.

.34 Action

A. Not Timely Submitted. The authorized officer may, if he deems such action appropriate, issue a decision revoking the grazing preference involved in the transfer whenever the assignment has not been filed within the 60 days required. The decision will be issued to the transferee.

B. Not Properly Executed. Whenever the assignment forms have been improperly completed or required information is lacking the authorized officer will immediately return the assignment to the transferee by certified mail with a copy to the transferor indicating the defects and giving a time period in which to correct the documents.

Improper Notice to Lien Holder. Whenever a lien holder of record (one which has recorded his interest in the preference with the authorized officer) has not been properly and timely advised by the transferor, the authorized officer shall treat the assignment as not properly executed in accordance with 4330.34B, with a copy of his notice to the transferee.

D. Base Property Inconsistent. Whenever it is readily apparent that the offered base property, either by location, definition, stability or local economy, is inconsistent with Taylor Grazing Act objectives the authorized officer will:

1. Issue a preliminary decision within 15 days of receipt of the assignment to both the transferor and the transferee indicating that based on initial findings the assignment does not appear to meet regulatory requirements and that a final decision will be issued within 30 days.

2. Issue a final decision to both parties rejecting the assignment on the basis that it does not meet regulatory requirements if in fact the offered base property is clearly inconsistent with Taylor Grazing Act objectives.

.35 Permit Issuance. Whenever an assignment meets regulatory requirements the authorized officer will issue a new permit to the transferee consistent with 4310.

.36 Noncompliance. Whenever it is determined that a permittee no longer qualifies by reason of loss of any mandatory qualifications as set forth under 4210 the authorized officer may revoke the preference on the basis thereof, or he may allow the permittee a reasonable period to properly qualify if the deficiency was created after the assignment and issuance of the permit.

AUM's are now in active use, which is concurred in by any lien holder on
the base property who has been timely and properly notified of this trans-
action per the documentary evidence attached.

assignee, hereby attests to controlling base property and being engaged in the livestock business in or near the district in which the grazing preference is sought pursuant to the regulations, 43 CFR Part 4000; that the base property is platted on the reverse hereof or attached with documentary evidance of control of the property; and that this assignment is subject to the terms and conditions of the existing grazing permit and that all interests and obligations under any range improvement cooperative agreement or permit are transferred.
