2. The exemption in paragraph (n) in supplement 7 to the Ex Parte No. 318 tariff, and the parallel provision in the Ex Parte No. 330 tariff, found not to apply on movements to points in Illinois Freight Association Territory. Proceeding discontinued.

By petition filed February 16, 1978, various shipper interests (for convenience replicants') have appealed two of the findings made in the initial decision served January 27, 1978. A reply was filed on March 6, 1978, by Seaboard Coast Line Railroad Company (SCL or petitioner).

This proceeding was initiated pursuant to section 554(e) of the Administrative Procedure Act and addresses the issue of whether provisions in the Ex Parte No. 318 and 330 tariffs prevent SCL from charging the Ex Parte No. 318 increase of 7 percent on shipments of superphosphate from Florida to various destinations, as set forth in the initial decision, and limit the increase under Ex Parte No. 330 on these movements to 5 percent. The Administrative Law Judge found that the provisions in issue did not prevent and limit the
