We believe both Bills will go a long way toward correcting the evils which we have pointed out. However, we tend to prefer H.R. 6088 because of its wider coverage and simplicity of administration.

GENTLEMEN: Please find attached a new Labor Agreement, ratified by the membership and negotiated by and between the International Union, United Plant Guard Workers of America and its Affiliated Local No. 600 and Industrial Maintenance Services, Inc., covering all guards at Fort Rucker, Alabama.

The Company and the Union jointly request that you issue a determination under the Service Contract Act on the following agreed upon additional provisions, as quick as possible and mail copies of such determination to the undersigned parties.

Appendix "A" (Wage and Shift Differential)

JURY DUTY-ARTICLE 10

Employees called for jury examination or serve on a jury shall be reimbursed by the Company for loss of regular wages not to exceed 8 hours per day or 40 hours per week, less what employee receives for serving on the jury.

FUNERAL LEAVE ARTICLE 11

Employees to receive three (3) days with pay at his straight time rate from his scheduled workweek for attending or arranging the funeral of a member of his immediate family as defined.

SICK LEAVE-ARTICLE 14

Employees to receive five (5) days paid sick leave each year at their straight time rate of pay. Any unused sick leave will be paid to employees at their straight time rate of pay on June 30th of each year or when the employee leaves the service of the Company.

DEAR MR. RUSSELL: I finally reached Mrs. Morrow today and inquired if she had received the new wage determination dated October 22, 1970. She made a check while I was on the phone and advised me that a brief search of the contract file did not reveal the receipt of the wage determination but she would inquire through the other contracting officers to see if it had come into their offices. She was to let me know if they had received it.

DEAR MR. RUSSELL: As I explained to you by telephone on Tuesday, December 1, I did contact Mrs. Morrow of the Purchasing and Contracting Office of Fort Rucker by telephone concerning the wage determination that was recently published by the Department of Labor concerning the security guards at Fort Rucker, Alabama. Mrs. Morrow advised me that after consulting with the legal department that she was told that since we had already had a revised wage determination issued which was included into our present extended contract that it was not necessary to modify the contract to include a new wage determination.

I would have to assume that this is normal procedure since the new wage determination dated in October of 70 was issued after the contract year had begun and the revised wage determination dated December 18, 1969 was effective for the entire contract year of 1970-71.

GENTLEMEN: Our Union is certified by the National Labor Relations Board as the bargaining representative for a unit of security guards employed by the Burns Detective Agency at Fremont, California. These guards are employed to perform security functions on a government project by Burns Detective Agency which was awarded a sub-contract for such services from the Federal Aviation Corporation, the prime contractor with the U.S. Government. The Burns Contract is effective from July 1, 1966, to June 30, 1967.

On June 9, 1966, your Department determinated the prevailing wage rate for this area to be $2.41 (No. WD 66-108). However, this determination did not include fringe benefits prevailing in the locality as required by Section 2(a) (2) of the Service Contract Act of 1965.

Although Burns Detective Agency is now paying its employees the prevailing rate of $2.41 per hour, it is refusing to pay any fringe benefits. Negotiations on a collective bargaining agreement are now stalled because Burns has informed our negotiators that its contract with the Federal Aviation Corporation contains no provision for payment of the normal fringe benefits enjoyed by other guard employees in the area.

Listed below are the major fringe benefits which other employers in the area under contract with this Union are paying their guard employees performing similar duties.

PAN-AMERICAN AIRWAY SYSTEMS (MECHANICAL REPAIR OPERATION), SAN FRANCISCO AIRPORT, CALIF.

1. Shift premium-11¢ afternoon shift and 18¢ midnight shift.

2. Paid Holidays-Seven per year.

3. Sick Leave 1 day sick leave for each month, with the right of accumulation to 60 days.

4. Vacations-1 day for each month of service for a period less than one year; ten days paid vacation after one year's service and up to ten years; 15 days vacation for ten years to 15 years service; 20 days vacation for 15 years or more service.

5. Three days paid bereavement leave time.

6. Uniforms are furnished.

7. Insurance $12,000 maximum life insurance coverage for each employee plus "A" type hospitalization, medical and sickness insurance coverage.
