Regarding Rosman, N.C., no objection provided mutually acceptable agreements are reached between NASA and non-Government licensees, which are authorized to operate in the band 5925-6425 Mic/s in the same geographical area and within potential interference range of this operation.

EXHIBIT 5.-MEMORANDUM OF NOVEMBER 20, 1964

ubject: Frequencies for NASA's applications technological satellite.

The situation with respect to assignment of frequencies for NASA's applicaons technological satellite is as follows:

On January 3, 1963, NASA requested the assignment of frequencies for its dvanced Syncom project: Four 6 Gc/s frequencies with 10 kw from Rosman, .C. and Mojave, Calif., earth stations to the satellite, four 4 Gc/s frequencies ith 2.5 w. from the satellite to earth stations; and one 4 Gc/s satellite beacon requency. It was stated in justification that, “*** frequencies have been elected from the Bell System Technical Journal, May 1962, as the most techically feasible channels for experimental communications satellite data transission, which included recommendation for 59.3 mc channel separation." Under anding instructions, the Frequency Assignment Subcommittee (FAS), on [arch 29, 1963, referred the application to the IRAC.

Following NASA substitution of different frequencies, the IRAC considered nd tabled the applications at several meetings between April and September 963, to allow time for FCC staffing and FCC-NASA to resolve the question of ossible interference with the common carriers near Rosman. At the September 4, 1963 meeting NASA requested tabling pending recall.

At the February 11, 1964, IRAC meeting, NASA withdrew its pending applicaions and substituted the attached requests for the advanced technological proram: two 6 Gc/s frequencies with 10 kw from the Rosman and Mojave earth tations to the satellite; two 4 Gc/s frequencies with 2.5 W from the satellite o earth stations for data transmissions; and two 4 Gc/s frequencies with 2.5 w. or a satellite beacon. These substitute applications were referred to the IRAC n March 27, 1964 (IRAC Doc. 8303 attached).

Most of the IRAC consideration was devoted to whether there would be interference, present or future, to common carrier operation. The Chair questioned the use of the non-Government bands instead of Government bands and was assured that the research would be helpful to the CSC as well as the Government, operation on the same or nearby frequencies would make possible research which could not be conducted in different bands, and that a change would be costly in time and money. Since there were no objections or stipulations other than the FCC which requested an agreement between NASA and the carriers with respect to 62.12.094 Mc/s, the IRAC on April 14, 1964, offered no objection to the assignments subject to FCC concurrence on the use of 62.12.094 Mc/s at Rosman, N.C. (attachment). The FCC later concurred subject to NASA furnishing a contour map for the Rosman operation or operating on a noninterference basis. NASA is now considering which condition to accept.

The situation is now different. The CSC is moving ahead and in March asked the FCC to authorize "Early Bird" to be in operation in 1966 and global in 1967. The Early Bird will use the same or nearby frequencies and is too far advanced to profit from NASA ATS research except with respect to the problems of two satellite systems operating on nearby frequencies. Also, the military have indicated a possible trend by their arrangements for the use of Syncom II and III. In addition, the DOD-CSC negotiations reacted to make it impossible at this time to allocate Government satellites to Government bands and commercial satellites to non-Government bands (the 4, 6, 7 and 8 Gc/s bands are now proposed for Comstats without division between Government and non-Government). Further, unlike advanced Syncom which was designed for communications research only, the ATS will include numerous experiments (at least 10) not related to satellite communication per se. Reconsideration is appropriate and necessary.

In the circumstances, and in accordance with your assignment of responsibility to me, I have instructed the Chairman, FAS, to tell the subcommittee that you wish the applications referred to your office without assignment action. To avoid a frantic call to you, I told Mr. McElroy, NASA, in the absence of Mr. Price, of my action and that I am seeking to arrange a meeting in your office at 9:30 a.m., Monday, December 7, to discuss the entire subject. Mr. McElroy thinks that perhaps as many as six persons many attend from NASA and is
