§ 5A-74.410 Special provisions for export orders.

In addition to the requirements in connection with special applicable export provisions to be cited on orders for shipments to foreign destinations, a provision substantially as follows shall also be shown on these orders:

PACKING LISTS FOR EXPORT SHIPMENTS

In addition to the packing lists required by paragraph 33 of GSA Form 1246 to accompany each shipment, Contractor must furnish the following number of copies of applicable packing lists with his submission of GSA Form 489 (Application for Shipping Instructions): number of copies

§ 5A-75.000 Scope of part.

This part prescribes policies governing the functions and responsibilities of review committees and review teams. [35 F.R. 13438, Aug. 22, 1970]

Committees and Teams

§ 5A-75.101 Review committees.

The objective of review committees is to broaden the base of judgment in connection with major contract awards and policy questions related to contracting operations.

§ 5A-75.102 Review teams.

The objective of review teams is to standardize solicitations for offers by developing uniform requirements, improving writing style, incorporating the proper clauses, training of contracting officers, and generally providing professional and technical guidance for preparing solicitations for offers.

§ 5A-75.103 Regional review committees and teams.

Normally, necessary review shall be accomplished through regular supervisory channels. When the Regional Director, FSS, determines that the volume and complexity of solicitations for offers or awards requiring submission to him warrant, he may designate employees to serve as members of an ad hoc regional review team or committee. Regional review teams or committees or their staffs shall not be established as organizational elements of the regional Federal Supply Service.

Subpart 5A-75.2-Procurement Operations Division Review Committee

§ 5A-75.201 Review of contractual cases. The Procurement Operations Division (POD) Review Committee shall review and make recommendations in connection with proposed contract awards and related transactions designated by the Director, POD.

§ 5A-75.202 Schedule of meetings.

The POD Review Committee shall meet regularly on Tuesdays and Thursdays and when a contractual case is of sufficient importance to warrant a special meeting as determined by the chairman of the Review Committee. The regularly scheduled meetings shall normally convene at 9:45 a.m.

§ 5A-75.203 Submission of cases.

(a) Cases shall be submitted to the Review Committee as soon as possible and in sufficient time to permit adequate analysis and processing through higher levels for approval. Emergencies requiring accelerated processing must be clearly demonstrated.

(b) Extensions of offer acceptance time shall be requested, when necessary, to preclude processing as an emergency case. Where a low offeror refuses to extend the offer acceptance time, the Review Committee shall be given timely notice to initiate special handling. In no event shall an award be made prior to release of the case by the Review Committee unless authorized by the Director, POD, or higher authority.

§ 5A-75.204 Case documentation.

(a) Request for approval of awards. Proposed awards shall be submitted to the Review Committee under cover of GSA Form 1535, Request for Approval of Awards, executed in accordance with § 5A-1.375 of this chapter. Proposed awards to other than the low offeror shall be accompanied by GSA Form 2112, Proposed Award to Other than Low Bidder, as provided in § 5A-2.404-2 of this chapter.

(b) Procurement case summary. GSA Form 1447, Review Committee Procurement Case Summary, shall be prepared to record formal comments or recom

mendations by the Review Committee. The original of the form shall be signed by the Committee members and shall be made a part of the purchase case file. [35 F.R. 13439, Aug, 22, 1970] § 5A-75.205 bership.

The Director, POD, shall appoint the Review Committee members. The committee will normally consist of the (a) Assistant Director, POD, for the functional area involved (Chairman), (b) Chief, Procurement Review Staff, (c) Chief Counsel, Procurement Operations Area, and (d) Executive Secretary, Review Committee (reporting). The Director, POD, may substitute members or appoint additional members.

Subpart 5A-75.3-Procurement Operations Division Review Team § 5A-75.301 Cases required to be submitted to the Review Team.

The Procurement Operations Division (POD) Review Team shall, prior to issuance, review all solicitations for offers in the following categories:

(a) Where protests have been received on prior similar transactions. These cases shall be submitted together with information about such prior protests.

(b) Federal Supply Schedule solicitations.

(c) Solicitations involving term contracts for stores stock replenishment, unless they have been approved previously.

(d) Where changes from previously approved solicitations are proposed with respect to evaluation of offers, methods of awards, submission of samples, and standardized clauses.

(e) Solicitations specifically requested by the Director, POD, to be reviewed. [35 F.R. 13439, Aug. 22, 1970]
