their ftead, and also upon spirits distilled within the United States, and for appropriating the fame, took effect: And provided aljo, That fuch allowance fhall not exceed the annual amount of feventy thousand dollars, until the fame shall be further ascertained by law.

Sec. 17. And be it further enacted, That the act intitled, "An act repealing after the laft day of June next, the duties heretofore laid upon distilled fpirits imported from abroad and laying others in their ftead, and alfo upon fpirits diftilled within the United States, and for appropriating the fame," fhall extend to and be in full force for the collection of the feveral duties herein before mentioned, and for the recovery and diftribution of the penalties and forfeitures herein contained, and generally for the execution of this act, as fully and effectually as if every regulation, reftriction, penalty, provision, clause, matter and thing therein contained were inferted in and re-enacted by this prefent act, fubject only to the alterations hereby made.

CHAPTER XXXIII.

An Act more effectually to provide for the National Defence, by establishing an Uniform Militia, throughout the United States.

Sect. 1.DE it enacted by the Senate and Houfe of Reprefentatives of the United whom to be States of America, in Congress affembled, That each and every free able-bodied white malecitizen of the refpective states, refident therein, who is or fhall be of the age of eighteen years, and under the age of forty-five years, (except as is herein after excepted) fhall feverally and respectively be enrolled in the militia by the captain or commanding officer of the company, within whofe bounds fuch citizen fhall refide, and that within twelve months after the paffing of this act. And it fhall at all times hereafter be the duty of every fuch captain or commanding officer of a company to enrol every fuch citizen, as aforefaid, and alfo thofe who fhall, from time to time, arrive at the age of eighteen years, or being of the age of eighteen years and under the age of forty-five years (except as before excepted) fhall come to refide within his bounds; and fhall without delay notify fuch citizen of the faid enrollment, by a proper non-commiffioned officer of the company, by whom fuch notice may be proved. That every citizen fo enrolled and notified, shall within fix months thereafter, provide himself with a good mufket or firelock, a fufficient bayonet and belt, two spare flints, and a knapfack, a pouch with a box therein to contain not lefs than twenty four cartridges, fuited to the bore of his musket or firelock, each cartridge to contain a proper quantity of powder and ball: or with a good rifle,

knapsack, fhot-pouch and powder-horn, twenty balls fuited to the bore of his rifle, and a quarter of a pound of powder; and shall appear, fo armed, accoutred and provided, when called out to exercife, or into fervice, except, that when called out on company-days to exercife only, he may appear without a knapsack. That the commiffioned officers fhall feverally be armed with a fword or hanger and efpontoon, and that from and after five years from the paffing of this act, all mufquets for arming the militia as herein required, shall be of bores fufficient for balls of the eighteenth part of a pound. And every citizen fo enrolled and providing himself with the arms, ammunition and accoutrements required, as aforefaid, fhall hold the fame exempted from all fuits, diftreffes, executions or fales, for debt or for the payment of taxes.

Sect. 2. And be it further enacted, That the Executive Vice-Prefident of the United States; the of officers, ficers, judicial and executive of the govern- crapted. ment of the United States; the members of both houses of Congrefs, and their respective officers; all custom-houfe officers with their clerks; all poft officers, and stage-drivers, who are employed in the care and conveyance of the mail of the poft-office of the United States; all ferrymen employed at any ferry on. the poft-road; all infpectors of exports; all pilots; all mariners actually employed in the fea-fervice of any citizen or merchant within the United States; and all perfons who now are or may hereafter be exempted by the laws of the respective states, fhall be, and are hereby exempted from militia duty, notwithstanding their being above the age of eighteen, and under the age of forty-five years.

And be it further enacted, That one year after the paffing of this act, the militia of the respective states fhall be arranged into divifions, brigades, regiments, battallions and companies, as the legiflature of each state shall direct, and each divifion, brigade and regiment, fhall be numbered at the formation thereof; and a record made of fuch numbers in the adjutant-general's office in the ftate; and when in the field, or in fervice in the state, each divifion, brigade, and regiment fhall, refpectively, take rank according to their numbers, reckoning the firft or loweft number highest in rank. That if the fame be convenient, each brigade fhall confift of four regiments; each regiment of two battallions; each battallion of five companies; each comby whom pany of fixty-four privates. That the faid militia fhall be officered by the respective states, as follows: To each divifion, one major-general and two aids-de-camp, with the rank of major; to each brigade, one brigadier-general, with one brigade-infpector, to ferve alfo as brigademajor, with the rank of a major; to each regiment, one lieutenant-colonel commandant ; and to each battallion one major; to each company one captain, one lieutenant, one enfign, four ferjeants, four corporals, one drum. mer and one fifer or bugler. That there fhall be a regimental staff, to confift of one adjutant and one quarter-master, to rank as lieutenants; one pay-master, one furgeon, and one furgeon's mate; one ferjeant-major; one drum-major, and one fife-major.

Each dragoon to furnish himself with a ferviceable horfe, at least fourteen hands and an half high, a good faddle, bridle, mail-pillion and valise, holfters, and a breaft-plate and crupper, a pair of boots and fpurs, a pair of pistols, a fabre, and a cartouch-box, to contain twelve cartridges for pistols. That each company of artillery and troop of horfe fhall be formed of Artillery volunteers from the brigade, at the difcretion whom to be of the commander in chief of the state, not formed; exceeding one company of each to a regiment, to be uni nor more in number than one eleventh part formly clad of the infantry, and fhall be uniformly cloathed at their own in regimentals, to be furnished at their own. expenfe; the colour and fashion to be determined by the brigadier commanding the brigade to which they belong.
