ARTICULO X.

En el cafo de que un buque perteneciente à una de las dos partes contratantes naufrugafe, varafe, ó fufriefe alguna avería en las coftas ó en los dominios de la otra, fe focorra á los sùbditos ó ciudadanos refpectivos, así á fus perfonas como à fus buques y efectos, del mismo modo que fe haria con los habitantes del pais donde fuceda la defgracia, y pagaran folo las mifmas cargas y derechos que fe hubieran exígido de dichos habitantes en femejante cafo. Y fi fuefe necefario para componer el buque que fe defcargue el cargamento en todo ó en parte, no pagarán impuesto alguno, carga, ó derecho de lo que fe vuelva á embar car para fer exportado.

ARTICULO XI.

Los ciudadanos ó súbditos de una de las dos partes contratantes tendrán en los eftados de la otra la libertad de difponer de fus bienes perfonales bien fea por teftamento, donacion, ú otra manera, y fi fus herederos fuefen súb ditos ó ciudadanos de la otra parte contratante, fucederàn en fus bienes ya fea en virtud de teftamento ó ab inteftato, y podrán tomar pofefion, bien en perfona, ó por medio de otros que hagan fus veces, y difponer como les pareciere fin pagar mas derechos que aquellos que deben pagar en cafo femejante los habitantes del pais donde fe verificafe la herencia.

Y fi eftubiefen aufentés los herederos fe cuidará de los bienes que les hubiefen tocado, del mismo modo que fe hubiera hecho en femejante ocasion con los bienes de los naturales del pais, hafta que el legítimo propietario haya aprobado las difpoficiones para recoger la herencia. ARTICLE XII.

ARTICULO XII. Nor fhall any citizen, fubject or inhabitant of the faid United States apply for or take any commiffion or letters of marque for arming any fhip or fhips to act as privateers against the fubjects of his Catholic Majefty, or the property of any of them, from any prince or ftate with which the faid king fhall be at war. And if any person of either nation fhall take fuch commiffions or letters of marque, he fhall be punished as a pirate.

ARTICLE XV.

It fhall be lawful for all and fingular the fubjects of his Catholic Majefty, and the citiportsfecur- zens, people and inhabitants of the faid United States, to fail with their fhips, with all manner of liberty and fecurity, no diftinction being made who are the proprietors of the merchandizes laden thereon, from any port to the places of those who now are, or hereafter shall be at enmity with his Catholic Majesty or the United States. ARTICULO XIV.

Ningun, súbdito de S. M. Católica tomará encargo ó patente para armar buque o buques que obren como corfarios contra dichos Eftados Unidos, ó contra los ciudadanos pueblos y habitantes de los mismos, ó contra fu propiedad ó la de los habitantes de alguno de ellos de qualquier Príncipe que fea con quien eftubieren en guerra los Estados Unidos.

Ygualmente ningun ciudadano ó habitante de dichos Estados Unidos pedirá ó aceptará encargo ó patente para armar algun buque ó buques con el fin de perfeguir los súbditos de S. M. Católica, ó apoderarfe de fu propiedad, de qualquier Príncipe ó Eftado que fea con quien eftuviere en guerra S. M. Católica. Y fi algun individuo de una ó de otra nacion tomase semejantes encargos ó patentes ferá caftigado como pirata.

ARTICULO XV.

Se permitirá à todos y à cada uno de los súbditos de S. M. Católica, y à los ciudadanos pueblos y habitantes de dichos Eftados, que puedan navegar con fus embarcaciones con toda libertad, y feguridad fin que haya la menor excepcion por este respecto, aunque los propietarios de las mercaderías cargadas en las referidas embarcaciones vengan del puerto que quieran, y las traygan deftinadas à qualquiera plaza de una potencia actualmente enemiga ó que lo fea defpues, así de S. M. Católica como de los Estados Unidos. Se permitirá igualmente a los súbditos y habitantes mencionados navegar con fus buques y mercaderías, y freqüentar con igual libertad y feguridad las plazas y puertos de las potencias enemigas de las partes contratantes, ó de una de ellas fin
