them, either in kind or by commutation, to
officers of equal rank in their own army; and
all others fhall be daily furnished by them
with fuch ration as they allow to a common
foldier in their own fervice; the value where-

tual adjustment of accounts for the fubfiftence
of prisoners at the clofe of the war; and the
faid accounts fhall not be mingled with, or fet
off against any others, nor the balances due
on them, be withheld as a fatisfaction or re-
prifal for any other article, or for any other
cause, real or pretended, whatever; that each
party fhall be allowed to keep a commiffary
of prifoners of their own appointment, with
every separate cantonment of prisoners in pof-
feffion of the other, which commissary shall fee
the prisoners as often as he pleases, fhall be
allowed to receive and diftribute whatever
comforts may be fent to them by their friends,
and fhall be free to make his reports in open
letters to those who employ him; but if any of
ficer fhall break his parole, or any other pri-
foner fhall escape from the limits of his can-
tonment, after they fhall have been defignated
to him, fuch individual officer or other prifon-
er, fhall forfeit fo much of the benefit of this
article as provides for his enlargement on pa-

Le montant de ces dépenfes fera payé par l'autre puiffance, d'aprés une liquidation de compte á arrêter reciproquement pour l'entretien des prifonniers à la fin de la guerre; et ces comptes ne feront point confondus ou balancés avec d'autres comptes, ni la folde qui en eft due, retenue comme compensation ou repréfailles, pour tel autre article ou telle autre prétention réelle ou fuppofée. Il fera permis à chacune des deux puiffances d'entretenir un commiffaire de leur choix, dans chaque cantonnement des prifonniers qui font au pouvoir de l'autre; ces commiffaires auront la liberté de vifiter les prifonniers, auffi fouvent qu'ils le defireront; ils pourront également recevoir et diftribuer les douceurs que les parens ou amis des prifonniers leur feront parvenir. ARTICLE XXV.

The two contracting parties grant to each other the liberty of having each in the ports of the other, confuls, vice-confuls, agents and commiffaries of their own appointment, whose allowed in functions fhall be regulated by particular agreement whenever either party shall chuse to make fuch appointment; but if any fuch confuls fhall exercife commerce, they fhall be fubmitted to the fame laws and ufages to which the private individuals of their nation are submitted in the fame place.

ARTICLE XXVI.

ARTICLE XXV.

Les deux parties contractantes fe font accordé mutuellement la faculté de tenir dans leurs ports respectifs, des confuls, vice-confuls, agens et commiffaires de leur choix et dont les fonctions feront determinées par un arrangement particulier, lorfque l'une des deux puiffances aura nommé à ces poftes. Mais dans le cas que tel, ou autre de ces confuls, veuille faire le commerce, il fera foumis aux mêmes loix et ufages, aux-quels font foumis les particuliers de fa nation à l'endroit où il réfide.

ARTICLE XXVI.

ARTICLE XXVII.

His Majesty the King of Pruffia, and the United States of America, agree, that this treaty fhall be in force during the term of ten years from the exchange of ratifications; and if the expiration of that term should happen during the course of a war between them, then the articles before provided for the regula tion of their conduct during fucha war, fhall continue in force until the conclufion of the treaty which fhall re-establish peace; and that this treaty fhall be ratified on both fides, and the ratifications exchanged within one year from the day of its fignature,
