ARTICLE XV.

Et a fin de pourvoir plus efficacement à la fureté des deux parties contractantes, pour qu'il ne leur foit fait aucun préjudice par les vaiffeaux de guerre de l'autre partie ou par des armateurs particuliers, il fera fait défense à tous les capitaines et commandants de vaiffeaux de sa Majesté Suedoise et des Etats Unis, et tous leurs fujets, de faire aucun dommage ou infulte à ceux de l'autre partie; et au cas qu'ils y contreviennent, ayant été trouvés coupables, après l'examen fait par leurs propres juges, ils feront tenus de donner fatisfaction de tout dommage et interêt; et de les bonifier fous peine et obligation de leurs perfonnes et biens.

ARTICLE XVI.

Pour cette cause chaque particulier, voulant armer en courfe fera obligé, avant que de recevoir les patentes ou fes commiffions fpéciales, de donner par devant un juge compétent, caution de perfonnes folvables, chacun folidairement pour une fomme fuffisante, afin de repondre de tous les dommages et torts que

ARTICLE XVII.

One of the contracting parties being at war and the other remaining neuter, if it fhould happen that a merchant: fhip of the neutral power be taken by the enemy of the other party, and be afterwards retaken by a fhip of war or privateer of the power at war, alfo fhips and merchandizes of what nature foever they may be, when recovered from a pirate or fea rover, fhall be brought into a port of one of the two powers, and fhall be committed to the cuftody of the officers of the faid port, that they may be restored entire to the true proprietor as foon as he fhall have produced full proof of the property. ARTICLE XVII.

Une des parties contractantes étant en guerre, et l'autre reftant neutre, s'il arrivoit qu' un navire marchand de la puiffance neutre fût pris par l'ennemi de l'autre partie, et repris enfuite par un vaiffeau ou par un armateur de la puiffance en guerre; de même que les havires et marchandifes de quelle nature qu'elles puiffent être lors qu'elles auront été enlevées des mains de quelque pirate ou ecumeur de mer, elles feront emmenées dans quelque port de l'un des deux Etats, et feront remifes à la garde des officiers du dit port, afin d'être rendûes en entier à leur veritable propriétaire, auffitôt qu'il aura produit des preuves fuffifantes de la propriété. Les marchands, patrons et propriétaries des navires, matelots, gens de toute forte, vaiffeaux et bâtimens et en général aucunes marchandifes ni aucuns effets de chacun des alliés ou de leurs fujets, ne pourront être affujetis à aucun embargo, ni retenus dans aucun des pays, territoires, ifles, villes places, ports, rivages ou domaines quelconques de l'autre allie, pour quelque expedition militaire, ufage public ou particulier de qui que ce foit, par faifie, par force ou de quelque manière femblable. ARTICLE XVIII.

If it fhould happen that the two contracting parties fhould be engaged in a war at the fame time with a common enemy, the following points shall be observed on both fides.

ft. If the fhips of one of the two nations, re-taken by the privateers of the other, have not been in the power of the enemy more than twenty-four hours, they fhall be restored to the original owner, on payment of one-third of the value of the fhip and cargo. If, on the contrary, the veffel retaken has been more than twenty-four hours in the power of the enemy, it fhall belong wholly to him who has

retaken it.

2d. In case, during the interval of twentyfour hours, a veffel be retaken by a man of war of either of the two parties, it fhall be restored to the original owner, on payment of a thirtieth part of the value of the veffel and cargo, and a tenth part of it has been retaken after the twenty-four hours, which fums fhall be diftributed as a gratification among the crew of the men of war that fhall have made the recapture.

3d. The prizes made in manner abovementioned, fhall be restored to the owners, after proof made of the property, upon giving fecurity for the part coming to him who has recovered the veffel from the hands of the enemy.
