every fhip or veffel, built in the United States, ships built after the fifteenth day of Auguft, one thoufand in U. S. af feven hundred and eighty nine, and belong- 1789, how ing wholly, or in part, to the fubjects of fo- to obtain reign powers, in order to be entitled to the benefits of a fhip, built and recorded in the United States, fhall be recorded in the office of the collector of the district, in which fuch thip or veffel was built, in manner following, that is to fay; The builder of every fuch fhip or veffel fhall make oath or affirmation, before the collector of fuch diftrict, who is hereby authorized to adminifter the fame, in manner following; "I(inferting here the name of fuch builder) of (inferting here the place of his refidence) fhipwright, do fwear (or affirm) that (defcribing here the kind of vefiel, as, whether thip, brig, fnow, schooner, floop, or whatever elfe) named (inferting here the name of the thip or veffel) having (inferting here the number of decks,) and being, in length (inferting here the number of feet) in breadth (inferting here the number of feet) in depth (inferting here the number of feet) and measuring (inferting here the number of tons) having (ipecifying, whether any or no) gallery, and (alfo fpecifying, whether any or no) head, was built by me, or under my direction, at (naming the place, county, and ftate) in the United States, in the year (inferting here the number of the year;") which oath, or affirmation, fhall be fubfcribed by the perfon making the fame, and fhall be recorded in a book, to be kept, by the faid collector, for that purpose.

Sec. 21. And be it further enacted, That the collectorte faid collector fhall caufe the faid fhip or veffel have them to be furveyed or admeasured, according to the rule, preferibed by the forty-third fection

of the act, intitled, "An act to provide more effectually for the collection of the duties impofed by law on goods, wares, and merchandize, imported into the United States, and on the tonnage of fhips or veffels ;" and the perfon, by whom fach admeasurement fhall be made, fhall grant a certificate thereof, as in the cafe of a fhip or veffel to be registered; which certificate fhall be counterfigned by the faid builder, and by an owner, or the master, or perfon having the command or charge thereof, or by fome other perfon, being an agent for the owner or owners thereof, in teftimony of the truth of the particulars therein contained.

Sec. 22. ment fhall have been made) having certified, that the faid fhip or veffel has (inferting here, her number of decks) is, in length (inferting here, the number of feet) in breadth (inferting here, the number of feet) in depth (inferting here, the number of feet) and meafures (inferting here, the number of tons): And the faid builder and (naming and defcribing the owner, or mafter, or agent for the owner or owners, as the cafe may be, by whom the faid certificate fhall have been counterfigned) having agreed to the faid defcription and admeafurement, the faid fhip or veffel has been recorded, in the district of (inferting here, the name of the district, where recorded) in the United States; Witnefs my hand and feal, this (inferting here, the day of the month) day of (inferting here, the name of the month) in the year (inferting here, the number of the year);" which certificate fhall be recorded in the office of the faid collector, and a duplicate thereof tranfmitted to the Regifter of the Treafury. of the United States, to be recorded in his office.

Sec. 23. And be it further enacted, That if the mafter, or the name, of any fhip or veffel mafter or fo recorded fhall be changed, the owner, part- the thip, to owner, or confignee of fuch fhip or veffel, be endorfed fhall caufe a memorandum thereof to be en- on certifi dorsed on the certificate of the record, by the cord. collector of the diftrict, where fuch fhip or veffel may be, or at which he fhall first arrive, if fuch change took place in a foreign country; and a copy thereof fhall be entered in the book of records, a tranfcript whereof fhall be tranfmitted, by the faid collector, to the collector of the district, where fuch certificate was granted (if not the fame perfon), who VOL. fhall enter the fame in his book of records, and forward a duplicate of fuch entry, to the Regifter of the Treafury of the United States; and in fuch cafe, until the faid/owner, partowner, or confignee, fhall caufe the faid memorandum to be made, by the collector, in manner aforefaid, fuch fhip or veffel fhall not be deemed, or confidered, as a veffel recorded, in purfuance of this act.

Sec. 24. And be it further enacted, That the mafter, or other perfon having the command or charge of any fhip or veffel, recorded in pursuance of this act, fhall on entry of fuch fhip or veffel, produce the certificate of fuch record, to the collector of the district, where fhe fhall be fo entered; in failure of which, the faid fhip or vessel shall not be entitled to vileges of the privileges of a veffel, recorded as aforefaid: Provided always, and be it further enacted, That nothing herein contained fhall be construed to make it neceffary to record, a fecond time, any fhip or veffel, which fhall have been recorded, pursuant to the act, hereby in part repealed but fuch recording fhall be of the like force and effect, as if made, pursuant to this act.

Fees.

Sec. 25. And be it further enacted, That the fees and allowances, for the feveral fervices to be performed, pursuant to this act, and the distribution of the fame, fhall be as follows, to wit: For the admeasurement of how distri- every ship or veffel, of one hundred tons, and under, one cent per ton; for the admeafurement of every fhip or veffel, above one hundred, and not exceeding two hundred tons, one hundred and fifty cents; for the admeasurement of every fhip or veffel, above two hundred tons, two hundred cents; for every cer

The whele amount of which fees fhall be received, and accounted for, by the collector, or, at his option, by the naval-officer, where there is one; and where there is a collector, naval-officer, and furveyor, fhall be equally divided, monthly, between the faid officers; and where there is no navalofficer, two-thirds to the collector, and the of fees. other third to the furveyor; and where there is only a collector, he fhall receive the whole amount thereof; and where there is more than one surveyor in any district, each of them shall receive his proportionable part of fuch fees, as shall arife in the port, for which he is appointed: Provided always, that, in all cafes, where the tonnage of any ship or veffel shall be ascertained, by any perfon appointed for that purpose, fuch perfon fhall be paid a reasonable compenfation therefor, out of the fees aforefaid, before any diftribution thereof, as aforefaid. And every collector and navalofficer, and every furveyor, who fhall refide at a port, where there is no collector, fhall caufe to be affixed, and conftantly kept, in fome confpicuous part of his office, a fair table of the rates of fees, demandable by this act.

Sec. 26.
