Sec. 4. CHAPTER XXXVI.

An Act for regulating Proceffes in the Courts of the United States, and providing Compenfa tion for the Officers of the faid Courts, and for Jurors and Witneffes.

E it enacted by the Senate and Houfe of Reprefentatives of the United Writs by States of America, in Congress affembled, That all how and writs and proceffes iffuing from the fupreme or ted. a circuit court, fhall bear teft of the chief juf

tice of the fupreme court (or if that office shall be vacant) of the affociate juftice next in precedence; and all writs and proceffes iffuing from a district court, fhall bear teft of the judge of fuch court, (or if that office fhall be vacant,) of the clerk thereof, which faid writs and proceffes fhall be under the feal of the court from whence they iffue, and figned by the clerk thereof. The feals fhall be provided at the expenfe of the United States.

Sec. 2. And be it further enacted, That the and feals form of writs, executions and other procefs, provided. except their ftile and the forms and modes of proceeding in fuits in those of common law writs, &c. fhall be the fame as are now used in the faid courts respectively in pursuance of the act, intitled, "An act to regulate proceffes in the courts of the United States," in those of equity and in those of admiralty and maritime jurifdiction, according to the principles, rules and ufages which belong to courts of equity and to courts of admiralty, respectively, as contradistinguished from courts of common law; except fo far as may have been provided for by the act to establish the judicial courts of the United States, fubject however to fuch alterations and additions as the faid courts refpectively shall in their discretion deem expedient, or to fuch regulations, as the fupreme court of the United States fhall think proper from time to time by rule to prescribe to any circuit or district court concerning the fame: Provided, When That on judgments in any of the cafes afore- plaintiff faid, where different kinds of executions are out a cas iffuable in fucceffion, a capias ad fatisfaciendum tisfacienpias ad fabeing one, the plaintiff fhall have his election dum, in to take out a capias ad fatisfaciendum in the first inftance.

Sec. 3. And be it further enacted, That from and after the paffing this act, the fees and compenfations to the several officers and other perfons hereafter mentioned, fhall be as follows that is to fay, to the marshals of the feveral districts of the United States, for the fervice of any writ, warrant, attachment or process in chancery, on each person named in the fame, two dollars: for his travel out in serving each writ, warrant, attachment or procefs aforefaid, five cents per mile, to be computed from the place of fervice to the court where the writ or procefs fhall be returned; and if more perfons than one are named therein, the travel shall be computed from the court to the place of fervice which is most remote, adding thereto the extra travel neceffary to ferve it on the other: Provided, That the fee for travel where there is one perfon named in fuch writ, warrant, attachment or process, fhall in no cafe exceed feven dollars, and when there are more than one, the fee for extra travel fhall not exceed one dollar above feven dollars for each perfon. States, ten dollars per day for his attendance in court, and for his other fervices in difcharging the duties of his office, double the fees of the clerk of the fupreme court of that ftate in which the fupreme court of the United States fhall be holden. To the clerk of the district and circuit courts, fuch fees in each state refpectively as are allowed in the fupreme courts of the fame; and five dollars per day for his attendance on any circuit or district court, and at the rate of ten cents per mile for his expenses and time in travelling from the place of his abode to either of the faid courts. And in cafe any clerk of a court of the United States fhall in difchaging the duties of his office perform any kind of fervice which is not performed by the clerks of the courts of the ftate, and for which the laws of the state make no allowance, the court in which fuch service fhall be rendered may allow a reasonable compenfation therefor. To each grand and petit juror fifty cents per day for attending in court, and for travelling at the rate of five cents per every mile from their respective places of abode to the place where the court is held, and the like allowance for returning: To witneffes fummoned in any of the courts of the United States the fame compenfations in each ftate refpectively as are allowed in the fupreme courts of the fame: To the attorney VOL.
