and in describing the general efficiency of the employee. Notation must be made under every heading and answer given to every question shown on the card. Where the section or question is not applicable to the position held by the employee, the words "not applicable" should be entered. It is particularly important that rating officers make proper notations of warnings or cautions to employees for poor or inefficient work and for improper conduct. In those districts in which, because of division of the district into field areas or other subdivisions, employees in competition are rated by different rating officers, a numerical rating may be provided by district regulations in order that there may be means of determining the relative standing of the employees. These numerical ratings will be kept as confidential records of the district concerned. 1024.6. Absence on account of military duty not to affect efficiency ratings adversely. For provisions of law directing that absence on military duty shall not be permitted to affect efficiency ratings adversely, see paragraph 1029, Part I, 1 (a) of these regulations.

1024.7. Promotions to be made in accordance with efficiency reports. All promotions in the classified service shall be made in the order of merit as established by the last annual efficiency report, subject to such examination as may be required under civil-service rules: Provided, That any person entitled to promotion under the terms of this order who shall become markedly inefficient, or be guilty of any serious misconduct after the preparation of the last annual efficiency report, shall forfeit the right to promotion, and the same shall accrue to the next eligible person on the list (G. O. 3, C. of E., 1910).

1024.8. Reductions. Employees rated in general efficiency on any efficiency list as inferior shall be regarded as deficient in their respective classes and shall be reduced in grade or pay. All who on any one report receive a rating of inferior may be recommended for reduction or dismissal in the discretion of the District Engineer. All employees except those entitled to veteran preference, who on two consecutive reports receive such ratings, shall invariably be reported for dismissal. In the case of those entitled to preference under Revised Statutes 1754, dismissal may be recommended by the District Engineer in his discretion, and if recommendation for dismissal be made, should be accompanied by full statement of the facts showing the degree of inefficiency involved.

1024.9. Information to be furnished employees as to their efficiency ratings.— (a) Employees whose efficiency ratings are "satisfactory" or higher, who desire to see their efficiency ratings, shall be shown their own ratings under such rules and procedures as the District Engineer may prescribe.

(b) In any case in which the rating received by an employee is less than "satisfactory" he shall be informed in writing of the rating attained.

1024.10. Use of stop watches and other time-measuring devices forbidden. Congress in various appropriation acts has decreed a general policy that no appropriations shall be available for the salary or pay of any officer, manager, superintendent, foreman, or other person having charge of the work of any employee of the United States while making or causing to be made with a stop watch, or other time-measuring device, a time study of any job of any such employee between the starting and completion thereof, or of the movements of any such employee while engaged upon such works; nor shall any part of such appropriations be available to pay any premium or bonus or cash reward to any employee in addition to his regular wages, except for suggestions resulting in improvements or economy in the operation of any Government plan (Bul. 24, W. D., 1916; Army act approved March 4, 1915; and fortification acts approved July 6, 1916, and February 14, 1917, etc.). Led

1025. STRENGTH REPORTS

1025.1. Employees.-Reports of civilian employees in the form required by civil-service Form 3257b and prepared in accordance with instructions contained in civil-service Form 3280 should be made to the Chief of Engineers at the end of each month, and submitted in time to reach his office not later than 14 days after the close of the month to which they pertain. If it is not possible to submit this report by regular mail within the required time, thé information should be furnished by air mail or telegram. Form 3257b should contain the following information beneath the information box:

(a) A break-down of the employees reported for the last pay-roll period into clerical and subclerical groups.

(b) A statement as to the number of full-time employees reported on that form who were on the pay roll for the last day of the month, the number of parttime employees reported on that form who were on the pay roll for the last day of the month, and the total Form 3257b employees on the pay roll for that day. 1025.2. Reports of number of employees. (a) The carrying letter should contain a break-down as to the number of employees engaged on river and harbor work, flood-control work, and military work in the following manner:

1027. EXAMINATIONS FOR NONEDUCATIONAL POSITIONS

1027.1. Local boards of examiners.-In each engineer district there shall be a local board of examiners, composed of the manager of the civil-service district in whose district the headquarters of the engineer district may be located and one or more civilian employees of the Engineer Department at large. Preferably the board should have a clerical employee as secretary, one or more engineers, or other technical or professional employees, as members, and an auxiliary member at each large project away from the headquarters of the engineer district where work is likely to continue for a considerable period of time. After consultation with the district engineer by Commission through the District Manager, the Commission will designate the employees who are to serve on the local board. 1027.2. Duties of board members. The members of local boards shall perform such duties as the Commission may direct, in connection with the execution of the civil-service act and rules, and in the performance thereof they shall be under the direct and sole control of the Commission. Such duties shall be considered part of the duties of the position in which they are serving, and time will be allowed therefor during office hours. No board shall be composed solely of adherents of one political party when other persons are available and competent to serve. The local secretary shall keep the records of the board and perform other clerical service for the board. The District Manager and such other member of the local board as he may request) in any case shall rate the

papers of noneducational examinations for positions in the Engineer Department which may be filled from such registers, in accordance with instructions of the Commission. These papers will be rated quarterly, or more or less often, according to the needs of the service for employees in the respective positions. In the performance of their duties as local board members, employees will be under the supervision of the civil-service district manager.

1027.3. Open continuing examinations.-In any case in which there is a demonstrated shortage of qualified eligibles for filling a position of noneducational grade, Group III, and the District Engineer or Division Engineer believes that an open continuing examination will solve the problem, a statement of the facts with recommendation for open continuing examination may be submitted to the Civil Service District Manager.

1027.4. Preparation of eligible registers. The local board shall prepare eligible registers for local noneducational positions (those in Group III) and shall furnish one copy to each District Engineer within his district and one copy to the manager of the civil-service district. In making up eligible registers the board shall indicate thereon any qualifications which may be considered as special, and selection of eligibles on account of such qualifications shall be made by selection from the highest three having such qualifications as shown by the register. › The Commission will not, however, recognize as special qualification anything which is not a recognized branch of a trade or occupation; for example, a blacksmith may be a horseshoer, a forge man, etc., or a carpenter may be a stair builder or a ship carpenter, etc.

1027.5. Supplies.-The necessary blank forms will be furnished to local boards by the Commission through the District Managers, but all stationery, envelopes, rubber stamps, and other necessary supplies will be furnished by the engineer office in which the work of the board is carried on,

1028. LEAVES OF ABSENCE

1028.1. Uniform Leave Acts.-The Uniform Leave Acts approved March 14. 1936, 49 Stats. 1161 and 1162, are as follows:

(a) Annual Leave Act (49 Stat. 1161):

"Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That with with the exception of teachers and librarians of the public schools of the District of of Columbia and officers and employees of the Panama Canal and Panama Railroad on the Isthmus of Panama, and except as provided in section 4 hereof, all civilian officers and employees of the United States wherever stationed and of the government of the District of Columbia, regardless of their tenure, in addition to any accrued leave, shall be entitled to twenty-six days' annual leave with pay each calendar year, exclusive of Sundays and holidays: Provided, That the part unused in any year shall be accumulated for succeeding years until it totals not exceeding sixty days. This act shall not affect any sick leave to which employees are now or may hereafter be entitled. Temporary employees, except temporary employees engaged on construction work at hourly rates, shall be entitled to two and one-half days leave for each month of service. The annual leave herein authorized shall be granted, at such times as the heads of the various departments and independent establishments may prescribe. This act becomes effective January 1, 1936.

"SEC. 2. Each head of a department or independent establishment shall issue general public regulations, not inconsistent with law, setting forth the hours of duty per day and per week for each group of employees. Before issuing such regulations, which shall be issued within three months from the date of approval of this act, the heads of departments and independent establishments shall meet

and consult among themselves and make such regulations as nearly uniform as possible so that all employees, temporary or permanent, in all departments and independent establishments shall receive like treatment as nearly as may be practicable; Provided, That heads of departments and independent establishments may appoint a subcommittee to draft such regulations.

"SEO. 3. Each head of a department or independent establishment shall keep a record of all work performed, in excess of the work required by departmental regulations issued in conformance with section 2 hereof, for the period.commencing July 1, 1936, and ending December 31, 1936, and shall report same to the Civil Service Commission at the end of each month. The Civil Service Commission shall make a report of such record to the Congress on or before January 31, 1937.

"SEC. 4. Nothing in this act shall affect the Postmaster General and officers and employees in or under the Post Office Department: Provided, That officers and employees in the departmental service and in the Mail Equipment Shops of the Post Office Department shall be included within the provisions of this act.

"SEC. 5. Nothing in this act shall be construed to prevent the continuance of any existing leave differential now obtaining for the benefit of employees of the Federal Government stationed outside the continental limits of the United States.

"SEC. 6. The employees of any corporation created under authority of an act of Congress which is either wholly controlled or wholly owned by the United States Government, whether or not the employees thereof are paid from funds appropriated by Congress, shall be included within the provisions of this act.

"SEC. 7. The leave of absence herein provided for shall be administered under such regulations as the President may prescribe, so as to obtain, so far as practicable, uniformity in the application of this act.

"Approved, March 14, 1936."

(b) Sick Leave Act (49 Stat. 1162):

"Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That after January 1, 1936, except as provided in section 4 hereof, all civilian officers and employees of the United States wherever stationed and of the government of the District of Columbia, other than teachers and librarians of the public schools of the District of Columbia and officers and members but not the civilian personnel of the police and fire departments of the District of Columbia and other than officers and employees of the Panama Canal and Panama Railroad on the Isthmus of Panama, shall be entitled to sick leave with pay regardless of their tenure, as described herein.

"SEC. 2. On and after January 1, 1936, cumulative sick leave with pay, at the rate of one and one-quarter days per month, shall be granted to all civilian officers and employees, the total accumulation not to exceed ninety days. Temporary employees, except temporary employees engaged on construction work at hourly rates, shall be entitled to one and one-quarter days sick leave for each month of service: Provided, That all such employees shall furnish certificates satisfactory to the head of the appropriate department or i independent

"SEC. 3. Administrative officers may advance thirty days sick leave with pay beyond accrued sick leave in cases of serious disability or ailments and when required by the exigencies of the situation.
