0403. Effect of Orders and Instructions.

The orders and instructions issued by a Naval Technical Assistant in the execution of the duties assigned to him by law, regulation, or other directive from higher authority shall be considered as emanating from the Secretary of the Navy, and shall have full force and effect as such.

0404. Manuals and Other Publications.

The Naval Technical Assistants shall prepare and issue manuals and other appropriate publications containing orders, instructions, and procedures, conforming to these regulations, and pertaining to matters under their control. They shall insure that these publications accurately delineate their respective fields of authority, as mutually agreed upon by the bureaus and offices concerned, and in conformity with decisions or policies of higher authority. Where exceptions exist in the fields of authority, as defined by these regulations, the manuals of each bureau and office concerned shall set forth the details of such exceptions.

0405. "Management Control" and "Technical Direction" Construed.

Where used in these regulations, the terms "management control" and "technical direction" shall be construed to mean:

1. Management control: the exercise of executive authority and responsibility for the performance of the mission, tasks, and work of shore activities. This responsibility includes mission planning, shore activity development and workload planning, internal organization and procedures, budgeting, accounting, staffing, and the utilization of personnel, funds, materials and facilities. Management control also includes responsibility for appropriate coordination and application of technical direction.

2. Technical direction: the specialized or professional service performed, or professional guidance or direction exercised through the promulgation of policies and procedures in technical matters, by bureaus and offices of the Department of the Navy, in accordance with their assigned missions.

3. Individual responsibilities and executive authority in management control matters will

be commensurate with one another, and complete, except to the extent that the Secretary of the Navy assigns specific responsibilities for technical direction to others.

0406. Safety Precautions.

Each Naval Technical Assistant shall prepare and issue to the Naval Establishment the safety precautions, and instructions pertaining thereto, which are necessary or appropriate in connection with matters under his technical direction.

0407. Safeguarding Information.

When any bureau or office is engaged in the preparation of plans for, the research and development in, or the design, test, production, procurement, storage, shipment, or use of, material about which a degree of secrecy must be maintained, the Naval Technical Assistant concerned shall promulgate such instructions as may be required for the safeguarding of information pertaining thereto in all naval activities or civilian establishments wherein the material is located or used.

0408. Organization Restricted to Assigned Field of Authority.

A Naval Technical Assistant shall create or maintain only those units of organization which are concerned with, and essential to the efficient administration of, the field of authority assigned to him.

0409. Information to the Chief of Naval Operations.

Each Naval Technical Assistant shall furnish such information and data as may be called for by the Chief of Naval Operations; and if the request covers any items under the control of another bureau or office, such Naval Technical Assistant shall inform the other bureau or office of the action desired by the Chief of Naval Operations, advising the latter in the premises. 0410. Exchange of Information.

There shall be a mutual exchange of information among the bureaus and offices concerning all matters that require cooperation and coordination.

0411. Coordination of Research and Develop

ment Programs.

1. The Naval Technical Assistants shall furnish to the Chief of Naval Research such information relating to their research, experimental, test, or development projects and programs as the latter may request. They shall likewise furnish information to him relative to budget estimates for research within their respective fields of authority in order that he may effectively coordinate the research program and discharge his other responsibilities with respect thereto.

2. The Naval Technical Assistants shall refer to the Chief of Naval Research for comment and recommendation, prior to final action, all plans within the Navy Department for establishment of, abolishment of, or significant changes in, all laboratories concerned with scientific research and development.

0412. Recommendations to the Chief of Naval Personnel.

1. Except as otherwise specified in these regulations for personnel of the Medical, Dental, Medical Service, Hospital, and Nurse Corps, and of the Marine Corps, each Naval Technical Assistant shall make recommendations to the Chief of Naval Personnel relative to:

(a) The numerical requirements of the Naval Establishment, and of such specific activities thereof as he considers appropriate, for naval personnel especially trained or qualified in the field over which such Naval Technical Assistant has authority.

(b) The training and education of naval personnel who are assigned, or are intended for assignment, to duties in such field.

(c) The assignment of naval personnel trained, or to be trained, in such field.

2. The Chief of Naval Personnel, in filling the personnel requirements, shall give consideration to the above recommendations. He shall further make accessible to each Naval Technical Assistant information as to the availability of trained personnel.

0413. Procurement Contracts.

The Naval Technical Assistants are authorized to make contracts for such materials and services as are allocated by the Secretary of

the Navy to them for procurement, in accordance with such instructions as the Secretary may issue; and, except when prohibited by statute, to delegate that authority as may be necessary.

0414. Installations in New Vessels.

Upon request by the Chief of the Bureau of Ships each of the other Naval Technical Assistants shall submit to him an itemized statement giving description, weight, position, and center of gravity of all materials, under the control of such other Naval Technical Assistants, which are proposed for installation in a new vessel. Should any of the foregoing data be based upon estimates, it shall be so indicated, and corrected data shall be furnished as soon as practicable.

0415. Recommendations Concerning Design, Alterations, or Repair.

1. No change shall be made in matters pertaining to the design, alteration, or repair of ships, craft, aircraft, equipage, or shore facilities which involves an important departure from a former decision or ruling of the Navy Department without permission of the Secretary of the Navy. A Naval Technical Assistant recommending such change shall invite the attention of the Secretary of the Navy to:

(a) The previous decisions or rulings of the Navy Department in regard to the subject in question.

(b) The reasons for recommending a departure from a previous ruling or any change in policy.

2. Proposals for work, the performance of which would alter the basic characteristics of any ship or shore station, shall be referred to the Secretary of the Navy for decision, via the Chief of Naval Operations for his recommendation, prior to authorization thereof.

0416. Work Done for Other Bureaus, Offices, or Government Agencies.

Work may be performed by one bureau or office for another bureau or office, or for another Government agency, under such arrangements as are legal and agreeable to the parties concerned. Such work shall be accomplished in accordance with standards mutually agreed upon, and shall be completed to the satisfaction
