Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the United States Court of Claims be, and hereby is, given jurisdiction to hear, determine, and render judgment, notwithstanding any statute of limitations, laches, or lapse of time, on the claim of any owner or operator of a gold mine or gold placer operation for losses incurred allegedly because of the closing or curtailment or prevention of operations of such mine or placer operation as a result of the restrictions imposed by War Production Board Limitation Order L-208 during the effective life thereof: Provided, That actions on such claims shall be brought within one year from the date this Act becomes effective. XXIV PRIVATE LAW 1009-82D CONGRESS CHAPTER 914-2D SESSION [S. 2046] AN ACT To confer jurisdiction upon the Court of Claims to hear, determine, and render judgment upon the claim of Llewellyn B. Griffith for retirement as an emergency officer under the provisions of Emergency Officers Retirement Act or as a disabled officer of the Regular Army of the United States. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That jurisdiction is hereby conferred upon the Court of Claims of the United States, notwithstanding the lapse of time or any statute of limitations, or any other limitation upon the jurisdiction of such court, to hear, determine, and render judgment on the claim of Llewellyn B. Griffith arising out of the failure of the War Department to certify him for retirement as an emergency officer pursuant to the provisions of the Emergency Officers Retirement Act, as amended (45 Stat. 735), or to retire him as a disabled officer of the Regular Army of the United States, as the facts may justify. In its consideration of such claim, the court shall determine whether or not the said Llewellyn B. Griffith should have been certified for retirement as an emergency officer or retired as a disabled officer of the Regular Army. Should the court decide that the said Llewellyn B. Griffith should have been so certified or retired, judgment shall be rendered in an amount equal to the amount the said Llewellyn B. Griffith would have received had be heen so certified or retired: Provided, That the passage and approval of this legislation shall not be construed as an inference of liability on the part of the Government of the United States. SEC. 2 Suit upon such claim may be instituted at any time within four months after the date of the enactment of this Act.
