TAXES ERRONEOUSLY OR ILLEGALLY ASSESSED

The PRESIDING OFFICER (Mr. PAYNE in the chair) laid before the Senate the amendment heretofore received from the House of Representatives for concurrence to the text of the bill (S. 252) to permit all civil actions against the United States for recovery of taxes erroneously or illegally assessed or collected to be brought in the district courts with right of trial by jury, together with the amendment to the title, providing that the same read as follows: "An Act to permit all civil actions against the United States for recovery of taxes erroneously or illegally assessed or collected to be brought in the district courts."

The Secretary reported that on today he presented to the President of the United States the enrolled bill (S. 1644) to amend the act of May 27, 1940 (54 Stat. 223), as amended, and the act of February 14, 1931 (46 Stat. 1111), to remove the limitation upon the rank of the Director of Music, the leader of the United States Military Academy Band, and to remove the limitation upon the pay of the United States Naval Academy Band, and to authorize the appointment of the present leader of the United States Navy Band to the permanent grade of commander in the Navy.

STRENGTHEN CONDUCT OF RESEARCH,

DEPARTMENT OF AGRICULTURE

The VICE PRESIDENT laid before the Senate a communication from the Secretary of Agriculture, transmitting a draft of proposed legislation to amend the act of June 29, 1935 (the Bankhead-Jones Act), as amended, to strengthen the conduct of research of the Department of Agriculture; which, with the accompanying paper, was referred to the Committee on Agriculture and Forestry.

FEDERAL COMMUNICATIONS COMMISSION'S

The VICE PRESIDENT laid before the Senate a communication from the

Chairman of the Federal Communications Commission, transmitting, pursuant to law, a report on backlog of pending applications and hearing cases in the Commission as of May 31, 1953, which, with the accompanying report, was referred to the Committee on Interstate and Foreign Commerce.

A resolution of the City Council of Los Angeles, Calif., favoring immediate passage of H. R. 5661, to amend the mineral-leasing laws with respect to their application in the case of pipelines passing through public domain; to the Committee on Interior and Insular Affairs. Resolutions of the Legislature of the State of Massachusetts, as follows:

A resolution favoring the issuance of a postage stamp commemorating Samuel Osgood who served the State and Nation in many respects but chiefly as a delegate from Massachusetts to the Congress of the Confederation and first Commissioner of the Treasury under the Confederation; to the Committee on Post Office and Civil Service; and

A resolution of the Senate favoring the enactment of legislation liberalizing certain provisions of the law relating to immigration; to the Committee on the Judiciary.

WHEAT MARKETING QUOTAS

The Senate resumed the consideration of the bill (H. R. 5451) to amend the wheat marketing quota provisions of the Agricultural Adjustment Act of 1938, as amended, and for other purposes. Pending debate,

R. 5246) making appropriations for the Departments of Labor, and Health, Education, and Welfare, and related independent agencies, for the fiscal year ending June 30, 1954, and for other purposes; it agrees to the conference asked by the Senate on the disagreeing votes of the two Houses thereon, and has appointed Mr. BUSBEY, Mr. JENSEN, Mr. BUDGE, Mr. TABER, Mr. FERNANDEZ, Mr. ROONEY, and Mr. CANNON managers at the same on its part.

The House has disagreed to the amendments of the Senate to the bill (H. The House has agreed to the report of the committee of conference on the disagreeing votes of the two Houses to the amendment of the Senate to the bill (H. R. 6054) to amend the act of April 6, 1949, to provide for additional emergency assistance to farmers and stockmen, and for other purposes.

The House has passed the joint resolution (H. J. Res. 294) continuing the availability of appropriations for the Small Defense Plants Administration for the month of July 1953, and for other purposes, in which it requests the concurrence of the Senate.

The Speaker of the House having signed three enrolled bills, viz, S. 2199, H. R. 4072, and H. R. 5302, I am directed to bring the same to the Senate for the signature of its President.

The Secretary reported that he had examined and found truly enrolled the following bills:

S. 2199. An act to allow States during major disasters to use or distribute certain surplus equipment and supplies of the Federal Government;

H. R. 4072. An act relating to the disposition of certain former recreational demonstration project lands by the Commonwealth of Virginia to the School Board of Mecklenberg County, Va.; and

H. R. 5302. An act to provide for an additional Assistant Postmaster General in the Post Office Department.

The VICE PRESIDENT thereupon signed the same.

HOUSE JOINT RESOLUTION REFERRED The joint resolution, H. J. Res. 294, this day received from the House of Representatives for concurrence, was read the first and second times by unanimous con

sent and referred to the Committee on Appropriations.

REPORT OF EXPORT CONTROL

The VICE PRESIDENT laid before the Senate a communication from the Secretary of Commerce, transmitting, pursuant to law, the 23d quarterly report on export control for the period ended March 31, 1953; which, with the accompanying report, was referred to the Committee on Banking and Currency. AMENDMENT OF NORTHERN PACIFIC HALIBUT ACT OF 1937

The VICE PRESIDENT laid before the Senate a communication from the Secretary of State, transmitting a draft of proposed legislation to amend the Northern Pacific Halibut Act of 1937; which, with the accompanying paper was referred to the Committee on Interstate and Foreign Commerce.

PETITIONS AND MEMORIALS

The VICE PRESIDENT laid before the Senate the following petitions, etc., which were referred as indicated:

A resolution of the House of Representatives of the State of Massachusetts, favoring the enactment of the principles of the Furcolo Federal Scholarship plan which would provide for loans by the Federal Government to scholastically qualified high-school students; to the Committee on Labor and Public Welfare. A resolution adopted in convention at Cleveland, Ohio, by the American Association of Social Workers, urging emergency legislation permitting admission of 240,000 displaced persons over and above existing quotas, as recommended by the President; to the Committee on the Judiciary.

A resolution of the Veterans of Foreign Wars of the United States, Department of California, favoring the enactment of legislation making service on the islands of Jolo and Mindanao in Morro Province, Philippine Islands, from 1902 to December 3, 1913, campaign service;

A petition of Edgar E. Littlefield, Los Angeles, Calif., praying clarification of section 211 and an amendment of H. R. 6000, affecting self-employment under the Social Security Act of 1950; to the Committee on Finance.

Mr. LANGER presented the following resolutions, which were referred as indicated:

A resolution of the North Dakota State Dental Association, commending the excellent efforts of the local, State, and Federal departments of health in making the benefits of fluoridation available to all children in all communities of the State of North Dakota; to the Committee on Labor and Public Welfare.

A resolution of the Carson Commercial Club, Carson, N. Dak., favoring 100 percent of parity for basic farm commodities and maintenance of a production and marketing control program; to the Committee on Agriculture and Forestry.

A resolution adopted in convention at Minneapolis, Minn., by the United States Chamber of Commerce, urging citizens to offer prayers on July 4 for the success of our country in the role of world lead
