if any, to be provided by the proposer;

location where the work will be performed;

cost schedule detailing estimated costs for manresources (GSA Optional Form 60, or equivalent);

(ix) projected date of completion of the proposed effort. (7) resumes of key personnel to be involved which includes a description of relevant experience and associated dates;

(8) a current certified financial statement;

(9) period for which the proposal is valid (if other than that stipulated in the announcement);

(10) names and telephone numbers of proposer's primary business and technical personnel whom ERDA may contact during evaluation; and

(11) signature and title of an official of the proposing organizations authorized to commit such organization to the proposal

term.

(b) Each proposal containing proprietary data or privileged business information which the proposer intends to be used by ERDA for evaluation purposes only should be marked on the cover sheet with the notice prescribed in §9-3.150-3.

(c) If the proposer is a small business concern it shall so certify in its proposal. Other representations, certifications and acknowledgments which may be required by law or regulation shall also be submitted as specified in the announcement.

$9-4.5803 Assistance and participation.

Forms of assistance and participation.

In providing for the accomplishment of research, development, and related activities, ERDA may utilize various forms of Federal assistance and participation. Those forms of assistance and participation relevant to the PRDA mechanism include contracts, grants, and other arrangements authorized by law. A PRDA may highlight a particular form(s) of assistance or participation deemed by ERDA to be most suitable to a specific project; or, when justified, an announcement may limit consideration of assistance or participation to a particular

form. Any resulting arrangment shall comply with the applicable regulations (e.g., if the instrument resulting from an announcement is a procurement contract, the applicable terms and conditions shall be those governing procurement contracts).

The provisions of ERDA's cost participation policy in 9-4.59 shall apply as applicable to proposals submitted hereunder.

$9-4.5804 Method and criteria for evaluation and selection.

(a) General policy.

(1) Information contained in proposals offered in response to PRDAS shall be handled in accordance with the policies and procedures set forth in $9-3.150 pertaining to the marking and handling of proprietary data and privileged business information.

(2) Late proposals, modifications of proposals, and withdrawals of proposals shall be handled in accordance with FPR 1-3.802-1.

(b) Evaluation criteria. The evaluation criteria shall be specified in the announcement along with a narrative description of their relative importance. The following items are illustrative of the elements which may be considered as evaluation criteria:

(1) overall technical feasibility of the proposed concept;

(2)

adequacy and relevance of the proposed research plan, including validity tests as related to the proposed goals;

(3) availability, qualifications,

proposed staff and consultants;

and past performance of

(4) resources, experience, flexibility, and commitment of the proposing organization;

(5) adequacy of proposed project management plan;

(6) adequacy of proposed financial management plan; and

(7) estimated cost.

(c) Program policy factors. These are factors which, while not indicators of a proposal's merit (e.g., technical excellence, proposer's ability, cost), may be essential to the process of selecting the proposals which, taken together, will achieve the program objectives.

Such factors, where they exist, are likely to be beyond the proposer's control. Accordingly, they shall be specified in the announcement to notify proposers of this circumstance. The following are examples:

(1) it is desirable, because of the nature of the energy source, the projects envisioned, or limitations of past efforts, to select or award or support a group of projects with a broad or specific geographic distribution;

(2) it is desirable to select for award or support a group of projects which represent a diversity of methods, approaches, or kinds of work;

(3) it is desirable for reasons which must be stated to select for award or support projects from diverse types and sizes or proposing organizations; or

(4) it is desirable due to the nature of certain projects or proposing organizations to select for award or support duplicative or complementary efforts.

(d) Selection panel. A panel appointed by the cognizant program office will evaluate proposals submitted in response to a PRDA. The panel will be composed of program office and other ERDA personnel, including representatives from procurement counsel, and, as deemed appropriate by the appointing official, supplemented by personnel from other Government agencies. The representative of counsel will be an ex-officio (nonvoting) member of the panel. Personnel from prime management or operating contractors may be used as advisors to the panel when their services are necessary and available. Care is to be taken in the selection of these personnel so as to avoid any actual or apparent conflicts of interests. Moreover, such advisors are expressly forbidden to use privileged information contained in proposals for personal gain or other improper purposes.

(e) Selection official. The selection official shall be the senior program official unless such authority is delegated in writing on a case-by-case basis. A copy of each such delegation shall be sent concurrently to the senior procurement official, Headquarters.

(f) Preliminary review. Prior to making a comprehensive evaluation of a proposal, the receiving office shall determine that it: (1) contains sufficient technical, cost, and other information to enable comprehensive evaluation; and

(2) has been signed by a responsible official of the proposing organization or a person authorized to obligate such organization.

If the proposal does not meet these requirements, a comprehensive evaluation shall not be made. In such case a prompt reply shall be sent to the proposer, indicating the reason(s) for its not being selected for award or support under the PRDA.

(g) Comprehensive evaluation. The basic task in the evaluation and selection of proposals for award or support is to assess their relative merit in order to determine which of them offer the greatest likelihood for achievement of the program objectives stated in the announcement, considering technical quality, ability of the proposer, estimated cost, and other relevant factors. Proposals which survive preliminary review shall be evaluated under a two-step process. the first step, the panel will evaluate the proposals in accordance with the criteria stated in the announcement and rank in order of excellence. In the second step, the selection official will select proposals for support or award from the ranking established by the panel. In this latter process, the selection official will take into account the relevant program policy factors in order to determine the mix of proposed projects which will best further specific program goals. The relevant program policy factors, when reasonably ascertainable, shall be predetermined and specified in this announcement.

$9-4.5805 Award or support.

While only those proposals which best further the needs of the program as specified in the announcement will be considered for award or support, ERDA may accept for award or support, all, none, or any number or part of the proposals submitted.

Subpart 9-4.59 Cost Sharing

$9-4.5900 Scope of subpart.

This subpart sets forth the policy of ERDA on cost sharing by organizations performing basic and applied research under ERDA prime contracts and agreements.

$9-4.5901 Policy.

It is the policy of the ERDA to encourage, when appropriate, participation by the performing organization in the cost of research effort. While not required of the ERDA by statute, cost sharing is. encouraged to obtain a larger national effort in the energy field and to recognize that the research is also normally of benefit to the performing organization.

$9-4.5902 Application.

(a) This policy applies to research contracts and agreements with educational institutions, other not-for-profit or nonprofit organizations and commercial or industrial organizations, or other organizations except other Federal agencies. This policy ordinarily will not be applied in the following cases:

(1) Contracts for the operation of Government-owned or leased, contractor-operated facilities;

(2) Continuing cost reimbursement contracts for missionoriented, large-scale research programs performed in research centers using equipment of facilities which are usually either partially or wholly Government owned.

(b) This policy need not be applied where deemed inappropriate by the cognizant senior program official or head of the procuring activity (whoever selects the contractor) or their designee for any of the following reasons:

(1) It is a development effort the principal purpose of which is the production of, or the design, testing or improvement of, products, materials, devices, systems, or methods such as projects connected with the LMFBR program, the Naval Reactors program or the ROVER program;

(2) The research effort has only minor relevance to the performing organization's non-Federal activities;

(3) The performing organization has little or no non-Federal sources of funds from which to make a cost contribution;

(4) The performing organization is predominantly engaged in research and development and has little or no production or other service activities to which knowledge obtained from the research effort may be gainfully applied;

(5) The research objective or scope of the effort is specified by the ERDA rather than proposed by the performing organization (e.g., a contract resulting from a request for proposal);

(6) It is concluded that payment of the full cost of the research effort is necessary in order to obtain the services of a particular organization.

$9-4.5903 Amount of cost sharing.
