in Code 941 may not exceed $25,000 or 10% of the total local costs financed by AID for the project whichever is higher; however, in no case may the total amount of such purchases exceed $250,000 without first obtaining a specific geographic source waiver.

(3) Goods imported specifically for the project. Goods imported specifically for the project being implemented by this contract are not eligible for local cost financing; they are subject to the clause of this contract entitled "Source and Nationality Requirements for Procurement of Goods and Services" (AIDPR 7-6.5103).

87-6.5105 Geographic source waivers.

(a) Authority to waive source, origin, nationality, and transportation services requirements is set forth in Delegation of Authority No. 40 (AID Handbook 5). Additional guidance is available in Chapters 5, 7, and 18 of Supplement B to AID Handbook 1.

(b) The contracting officer shall insert the authorized geographic code based on an approved geographic source waiver in the Schedule of the contract as provided for in § 7-6.5101 of this subpart. In addition, the contracting officer shall place a copy of any approved geographic source waiver in the official contract file.

§ 7-7.000 Scope of part.

This part sets forth uniform contract clauses for use in connection with AID's procurement of personal property and nonpersonal services.

§ 7-7.001 References to "Government". Whenever it is appropriate, in order to avoid ambiguity or misinterpretation, the words "United States" may be inserted before the word "Government" in a standard clause. Similar clarification may be appropriate for other words which appear in standard clauses, including those which refer to officers of the United States Government.

Subpart 7-7.1—Fixed-Price Supply Contracts

§ 7-7.102 Required clauses.

§ 7-7.102-1 Definitions.

DEFINITIONS

As used throughout this contract, the following terms shall have the meanings set forth below:

(a) The term "head of the agency", "Secretary", or "Administrator", as used herein means the Administrator, Deputy Administrator, or Associate Assistant to the Administrator for Management of the Agency for International Development; and the term "his duly authorized representative" means any person or persons or board (other than the contracting officer) authorized to act for the head of the agency.

(b) The term "Contracting Officer" means the person executing this contract on behalf of the Government, and any other officer or civilian employee who is a properly designated Contracting Officer; and the term includes, except as otherwise provided in this contract, the authorized representative of a Contracting Officer acting within the limits of his authority.

(c) Except as otherwise provided in this contract, the term "subcontracts" includes purchase orders under this contract.

§ 7-7.102-14 Buy American Act.

The clause set forth in FPR 1-7.10214 is not generally included in AID contracts when more stringent source requirements are stated in the contract or when inclusion is not appropriate under FPR 1-6.104-5. (See Executive Order No. 11223, dated May 12, 1965, 30 FR 6635.) Clauses setting

forth the AID source restrictions are included in AIDPR 7-6.5103.

§ 7-7.102-17 Officials not to benefit.

If the procurement is made by an overseas field procurement activity or in other cases where appropriate, the following clause may be substituted for the provision in FPR 1-7.102-17.

UNITED STATES OFFICIALS NOT TO BENEFIT

No member of or delegate to the Congress of the United States of America, or resident commissioner of the United States of America shall be admitted to any share or part of this contract, or to any benefit that might arise therefrom; but this provision shall not be construed to extend to this contract if made with a corporation for its general benefit.

§ 7-7.103-22 Workmen's compensation insurance (Defense Base Act).

As a general rule, waivers will be obtained for persons employed outside the United States who are not United States citizens or residents, provided adequate protection will be given such persons. See AIDPR 7-10.402.
