BILATERAL TREATIES OF ARBITRATION AND CONCILIATION

United States-Chile 1

Mr. Edouard Herriot, President of the Chamber of Deputies of France, has been named by the Governments of the United States and Chile to be the joint commissioner of the Permanent International Commission provided for in the treaty for the advancement of peace between the United States and Chile, signed at Washington on July 24, 1914 (Treaty Series, No. 621).

The Commission, which is now fully constituted, is made up as follows:

American commissioners:

Non-national, Hans Sulzer, of Switzerland
Chilean commissioners:

National, Carlos Estévez

Non-national, Carlos Concha, of Peru

Joint commissioner: Edouard Herriot, of France

France-Yugoslavia

The American Chargé d'Affaires at Belgrade reported by a despatch dated October 20, 1937, that the treaty of friendly understanding and the treaty of arbitration 2 between France and Yugoslavia signed on November 11, 1927, had been prolonged for a period of 5 years. The prolongation was signed at Paris on October 12, 1937.

According to a communication from the Secretary General of the Permanent Court of Arbitration dated October 29, 1937, the Danish Government has appointed Mr. Cosmus A. C. Meyer, former President

of the Supreme Court of Denmark, as a member of the Permanent Court of Arbitration, to replace Mr. F. C. Schröder, deceased.

According to a communication from the registrar of the Permanent Court of International Justice, dated November 5, 1937, the Court elected M. Cheng Tien-Hsi to fill the vacancy in the Chamber for Transit and Communications Cases caused by the death of M. Hammarskjöld.

Consequently the composition of the Chamber for Transit and Communications Cases for the remainder of the period in question, which will expire on December 31, 1939, will be as follows:

Ecuador

On November 3, 1937, the instruments of ratification by Ecuador of the general treaty of inter-American arbitration and of the protocol

of progressive arbitration signed at Washington on January 5, 1929, were deposited in the archives of the Department of State. The Ecuadoran Government in ratifying the convention abandoned the first and second reservations made by the representative of Ecuador at the time of signing the convention, namely:

"1. Questions at present governed by conventions or treaties now in effect;

"2. Those which may arise from previous causes or may result from acts preceding the signature of this treaty."

The third reservation was ratified with the treaty. It is as follows: "3. Pecuniary claims of foreigners who may not have previously exhausted all legal remedies before the courts of justice of the country, it being understood that such is the interpretation and the extent of the application which the Government of Ecuador has always given to the Buenos Aires convention of August 11, 1910."

ADDITIONAL PROTOCOL TO THE GENERAL CONVENTION OF INTER-AMERICAN CONCILIATION (TREATY SERIES, No. 887)

Guatemala

By a note dated November 11, 1937, the Chilean Ambassador at Washington informed the Secretary of State that the instrument of ratification by Guatemala of the additional protocol to the general convention of inter-American conciliation, signed at Montevideo on December 26, 1933, was deposited with the Ministry for Foreign Affairs of Chile on October 1, 1937.

The American Legation at San Salvador transmitted to the Department with a despatch dated November 4, 1937, a copy of the Diario Oficial (No. 230) of October 27, 1937, which publishes the decree of ratification by El Salvador of the convention for the maintenance, preservation, and reestablishment of peace, signed at Buenos Aires on December 23, 1936.

El Salvador

With a despatch dated November 4, 1937, the American Legation at San Salvador transmitted to the Department a copy of the Diario Oficial (No. 230) of October 27, 1937, which publishes the decree by which El Salvador ratifies the convention to coordinate, extend, and assure the fulfillment of the existing treaties between American states, signed at Buenos Aires on December 23, 1936.

The American Legation at San Salvador transmitted to the Department of State with a despatch dated November 4, 1937, a copy of the Diario Oficial (No. 230) of October 27, 1937, which publishes the decree of ratification by El Salvador of the treaty on the prevention of controversies, signed at Buenos Aires on December 23, 1936.

El Salvador

The above-mentioned Diario Oficial, transmitted to the Department of State with a despatch dated November 4, 1937, from the American Legation at San Salvador, publishes also the decree of ratification by El Salvador of the inter-American treaty on good offices and mediation, signed at Buenos Aires on December 23, 1936.
