Germany

By a note dated June 11, 1938, the Italian Ambassador at Washington informed the Secretary of State that the instrument of ratification by Germany of the Convention for the Unification of the Methods of Keeping and Operating Cattle Herdbooks, signed at Rome October 14, 1936, was deposited with the Italian Government on May 24, 1938.

Austria

The Italian Ambassador at Washington informed the Secretary of State by a note dated June 20, 1938, that the German Embassy at Rome had notified the Italian Government on May 10, 1938, that following the union of Austria with the Reich, Austria ceased to be one of the states parties to the International Convention for the Creation of an International Institute of Agriculture, signed June 7, 1905, and to the protocol amending paragraphs 3 and 4 of article 10 of the convention, signed at Rome on April 21, 1926.

INTERNATIONAL AGREEMENT REGARDING THE REGULATION OF PRODUCTION AND MARKETING OF SUGAR, AND PROTOCOL 3

There is quoted below the text of a note from the British Ambassador at Washington dated May 28, 1938, suggesting on behalf of his Government procedure for bringing into force definitively the

International Agreement Regarding the Regulation of Production and Marketing of Sugar, signed at London on May 6, 1937:

"The International Agreement for the Regulation of Production and Marketing of Sugar, signed in London on the 6th May, 1937, has now been ratified by all the signatory Governments except those of France, Hungary, Yugoslavia and China. It is expected that the ratifications of the French, Hungarian and Yugoslav Governments will be deposited shortly, but that in existing conditions in China, the ratification by the Chinese Government may be indefinitely delayed.

"2. Article 48 of the Convention provides:

"(a) The present Agreement shall come into force on the 1st September, 1937, if at that date it has been ratified by all the signatory Governments.

"(b) If, by the above-mentioned date, the instruments of ratification of all the signatories have not been deposited, the Governments which have ratified the Agreement may decide to put it into force among themselves."

"Paragraph 4 of the Protocol of signature provides:

"If any Government is unable for constitutional reasons to obtain the necessary parliamentary authority for ratification before the 1st September, 1937, the signatory Governments agree to accept provisionally as equivalent to ratification for the purposes of bringing the Agreement into force on that date a declaration by that Government that it will provisionally accept the obligations of the Agreement as from that date and will ratify it as soon as possible. Should the ratification of such Government not be deposited before the 1st January, 1938, the Contracting Governments shall have the right to decide whether or not the Agreement is to be maintained in force.'

"The Agreement did not come into force under paragraph (a) of Article 48 and the provisions of paragraph 4 of the Protocol providing for a provisional entry into force between the 1st September, 1937, and the 1st January, 1938, in certain events are now spent.

"Consequently if the Agreement is now to come into force it must be by virtue of a decision of the Governments which have ratified taken under paragraph (b) of Article 48.

"3. It appears undesirable that the formal entry into force of the Agreement should be further postponed, and it is therefore hoped that agreement may be reached, as foreshadowed in Article 48 (b) of the Agreement, to enable the latter to come into force definitively between those Governments whose ratifications have been deposited. "4. His Majesty's Government in the United Kingdom accordingly propose, if all the other signatory Governments agree, that, as soon as all the outstanding ratifications have been deposited, with the exception of that of China, a certificate shall be drawn up and signed by His Majesty's Principal Secretary of State for Foreign Affairs to the effect that by the unanimous decisions of those Governments which have ratified taken in accordance with Article 48 (b) the Agreement shall be deemed. to have entered definitively into force as from the 1st September, 1937, the date on which it came into force provisionally in accordance with paragraph 4 of the Protocol annexed to the Agreement. The certificate would be deposited with the original Agreement in the archives of the Government of the United Kingdom and certified copies thereof would be transmitted to the other signatory Governments.

"5. It is the earnest hope of His Majesty's Government in the United Kingdom that on the deposit of all the outstanding instru ments of ratification except that of China the procedure outlined in the preceding paragraph for bringing the Agreement definitively into force may be put into operation without undue delay. I shall therefore be grateful if you will inform me as soon as possible whether the United States Government agree to the definitive entry into force of the Agreement as from the 1st September, 1937, between them and the other Governments which have ratified it, and whether they agree to this being effected by means of the procedure outlined above.

On June 21, 1938, this Government replied to the British Ambassador stating that the going into effect of the agreement as from September 1, 1937, will be entirely satisfactory, and that this Government agrees to this being effected by the means of the procedure outlined by the British Government.

CONVENTION RELATING TO THE REGULATION OF AERIAL NAVIGATION 4

Iraq

PROTOCOLS OF JUNE 1, 1935

The American Legation at Baghdad transmitted to the Department with a despatch dated May 12, 1938, a copy of the Iraq Government Gazette (No. 11) of March 13, 1938, which publishes a law providing for the ratification by Iraq of the protocol signed at Brus sels on June 1, 1935, amending the International Convention Relating to the Regulation of Aerial Navigation, signed at Paris October 13, 1919, and also the protocol of June 1, 1935, amending annex H of the convention in question.

Italy

The American Ambassador to Italy transmitted to the Secretary of State with a despatch dated May 21, 1938, a copy of the Official Gazette for May 19, 1938, which publishes a law approving the adherence of Italy to the protocol signed at Brussels on June 1, 1935, amending the Convention Relating to the Regulation of Aerial Navigation, signed at Paris on October 13, 1919.

According to information contained in the Official Bulletin (No. 25), December 1937, of the International Commission for Air Navigation the following countries have deposited, on the dates indicated, instruments of ratification of or instruments of adherence to the protocol signed at Brussels on June 1, 1935, amending the Convention Relating to the Regulation of Aerial Navigation of October 13, 1919, and the protocol signed at Brussels on June 1, 1935, amending annex H of the said convention:
