(3) Further processing of the application for citizenship is as prescribed by the Immigration and Naturalization Service.

(4) Upon completion of the naturalization process, immediate application for passport should be made, in order that it can be issued prior to scheduled departure of the dependent for overseas. § 94.5 Forms required.

The following forms required for naturalization purposes may be obtained from any office of the Immigration and Naturalization Service:

(a) N-400 Application to File a Petition for Naturalization (Adult) (Submit original form only).

(b) N-402 Application to File a Petition for Naturalization (Child) (Submit original form only).

(c) G-325 Biographic Information (Submit original and duplicate of multileaf form).

(d) G-325B Biographic Information (Submit original form only).

(e) FD-258 Applicant Fingerprint Card (Submit one completed card).

(f) N-426 Certificate of Military or Naval Service (Submit in triplicate). (Should be handled on a priority basis so as to avoid prejudicing the early completion of the naturalization process, particularly for an alien who may receive an overseas assignment.)

(g) "Naturalization Requirements and General Information," published by the U.S. Department of Justice (Form N-17) describes the naturalization requirements and lists Immigration and Naturalization offices which process applications.

tion requirements for military officer positions and the utilization of qualified military officers in those positions. The program is intended to benefit the Department and the individual officer by insuring higher levels of professionalism and technical competence within the DOD, by recognizing the educational aspirations of individuals and by providing incentives for recruitment and retention of personnel with ability, dedication and capacity for growth.

(b) While this part encompasses graduate education for military officers only, the DOD recognizes the need for better utilization of its resources for continuing education at all levels for officers and enlisted personnel. To carry out this objective, DOD Directive 1322.11 (to be published) seeks to encourage all military personnel to develop educationally through voluntary participation in educational programs, and the Military Departments are requested to support such voluntary educational programs on an equal level of priority with those sponsored for fully funded graduate education. Educational opportunities for enlisted personnel should receive increasing emphasis.

§ 95.2 Applicability.

The provisions of this part apply to the Military Departments and encompass all commissioned officers who enter into a graduate education program after July 1, 1971. With respect to utilization, this part applies to all officers who have had career-related graduate education, except that no officer need be transferred before normal expiration of his tour of duty, on a permanent change of station basis, from a duty assignment solely to satisfy the utilization provisions of this part. Positions filled by and the education of officers in the disciplines of health, law, and religion are not included under the policy set forth herein.

§ 95.3 Policy and responsibilities.

(a) The policy of the Department of Defense is to insure that officer positions are validated for graduate education where such education is essential for optimum performance of duty, that military personnel who have received fully funded graduate level education benefits are utilized to the extent practicable in these positions, that requirements for fully funded graduate education are established on the basis of validated positions, and that all military personnel

acquiring career-related graduate level education through Service-sponsored activities or through other means, including off-duty programs, are considered as potential assets in programing training requirements. The Military Departments will:

(1) In determining requirements for fully funded graduate education, give careful consideration to the experience acquired by officers which may reduce or eliminate the requirements for formal educational programs.

(2) Make the most effective use of short courses and off-duty education programs to fulfill their requirements, prior to validating positions as requiring graduate education.

(3) Make maximum use of educational programs established by civilian educational institutions if they satisfy Service needs or can be tailored by the Services to satisfy such needs, prior to the establishment of in-house programs peculiar to the Military Departments.

(b) In carrying out the policy in paragraph (a) of this section, the Secretaries of the Military Departments are provided the following guidelines:

(1) Criteria for validation of military positions requiring assignment of officer personnel with graduate level education. (1) Positions in which the primary duties of the incumbents cannot be optimally performed except by individuals possessing qualifications that normally can be acquired only through graduate level education in a relevant field of study. These positions are predominantly those in which there is a direct relationship among the primary duty to be performed, the relevant educational field, the individual's occupational specialty or subspecialty, and the organizational function to be performed. Examples are positions requiring assignment of qualified physical, biological, and social scientists, engineers, designers, analysts, teachers, writers, and statisticians.

(ii) Positions which must be filled by individuals who are required to exert direct technical supervision over military and/or civilian personnel who are required to possess graduate level education. These positions are exclusively supervisory and assistant supervisory in nature. There must be a general relationship among the positions, the educational field, and type of organization. Although positions will tend primarily to be in the field grades, some may be in lower grades. Generally, however, level and type of

organization supervised will be of more significance than the position's grade. Examples are chiefs of laboratories, detachments, sections, branches, divisions, and similar organizations of a technical, analytical, developmental, or research nature.

(iii) Positions which, for optimum effectiveness, must be filled by individuals who possess knowledge of a specific field of study to permit effective staff planning, coordination, and command advisory functions. Such knowledge would include the capability to comprehend theories, principles, terminology, processes, and techniques which are necessary for effective appraisal and evaluation of complex programs.

(2) Utilization of officer personnel with graduate level education. (i) Officer personnel to receive fully-funded graduate education will agree in writing that, upon completion of the education, they will serve on active duty, for a period equal to three times the length of the period of that education, but not more than 4 years.

(ii) Officer personnel who have received fully funded graduate level education will serve:

(a) One tour in a validated position as soon as practicable after completion of such education; and

(b) As many subsequent tours in validated positions as Service requirements and proper career development will permit.

(iii) Officer personnel who have received career-related graduate education through other means, including off-duty programs, will be considered assets for filling validated positions.

(3) Identification of positions and personnel. (i) Positions which are determined to require military personnel possessing graduate level education will be identified as follows:

(d) On Service Tables of Organization, manpower authorizations, unit manning documents, or other appropriate documents as determined by each Service for uni-Service activities.

(b) On Joint Tables of Distribution for joint activities which are responsive to or through the Joint Chiefs of Staff. (c) On Tables of Distribution for U.S. elements on international staffs.

(d) On Tables of Distribution for Defense activities other than above.

(ii) Identification of graduate level education requirements in the above documents will be made through the use

of DOD standard data elements and codes where available and applicable. Other data elements used are subject to change after being disciplined under the criteria outlined in DOD 5000.12M, "Manual for Standard Data Elements."1

(lii) To insure uniformity in implementation of the validating criteria among the Military Departments, annual joint reviews of the position codings will be held. These reviews will be chaired by a representative of the Joint Chiefs of Staff. An observer from the Office of the Assistant Secretary of Defense (Manpower and Reserve Affairs) will attend each review.

(iv) Each service shall identify offcers possessing а graduate degree through the use of codes which are compatible with the position codes specified in subdivision (ii) of this subparagraph. Such codes will permit identification of obligations incurred, and pending, and will permit differentiation of fully funded, partially funded, or non-DODfunded education for each officer holding an advanced degree.

(c) Although this part treats primarily with fully funded graduate education for military officers to fill validated positions, it is desirable to encourage the general education of all officers for increased command and staff responsibilities. Such education should be based on off-duty programs funded by tuition assistance or Veterans' Administration benefits.

services to all eligible separating military personnel needing assistance in their readjustment to civilian life. It places the major management responsibility for achieving this goal on each of the Military Services.

§ 96.2 Applicability.

The provisions of this part apply to the Office of the Assistant Secretary of Defense (Manpower and Reserve Affairs), to the Military Departments, and to the Defense Supply Agency (for referral services) and encompass all officer and enlisted personnel "eligible" for transition and referral as defined under § 96.4.

(b) Under the Referral Program all eligible officer and enlisted personnel will be offered personal counseling services where available. All personnel will be provided access to the automated placement services.

(c) The Assistant Secretary of Defense (Manpower and Reserve Affairs) or his designee will:

(1) Develop basic policies and guidelines for the Transition and Referral Programs.

(2) Enlist the support of and maintain primary liaison with governmental agencies having national training and employment responsibilities and resources (e.g., the Departments of Health, Education, and Welfare, Labor, Commerce, Post Office, and the Veterans Administration).

(3) Enlist the cooperation of Federal and State governments in their roles as trainers and employers.

(4) Maintain primary liaison with national trade associations, headquarters of national labor unions, headquarters of national corporations, public interest organizations, and similar organizations to develop support for the program and to develop new sources of

training and job opportunities for the separating serviceman and woman.

(5) Provide policy guidance to the Defense Supply Agency computer facility on the operation of Referral computerized services.

(6) Provide a procedures manual for the Referral Program (1332.25-M1) and employers guide for the Referral Program (1332.25-G1) for retiring personnel and employer participation in the Referral Program.

(7) Develop technical resources for the conduct and support of counseling programs, for the training of counselors, and for the evaluation of counseling effectiveness of the Transition and Referral Programs.

(8) Evaluate effectiveness of the Transition and Referral Programs.

(d) The Secretaries of the Military Departments will manage the Transition and Referral Programs. In carrying out. this responsibility the respective Secretaries will:

(1) Identify all eligible personnel and inform them of the benefits they are entitled to receive from Transition and Referral.

(2) Provide counseling, training and placement services for the Transition Program and counseling and registration services for the Referral Program which will meet program objectives.

(3) Inform local communities about the program, solicit local support for training and placement activities and, as appropriate, develop cooperative interservice relationships with local community activities.

(4) Budget and allocate adequate dollar and manpower resources for Transsition and Referral.

(5) Establish adequate program control, inspection, and evaluation mechanisms and assure that program inadequacies are promptly and effectively remedied.

(6) Assure that Educational Officers, in planning continuing education programs for personnel, will coordinate with Transition Officers to provide programs that would satisfy local requirements.

(e) The Director of the Defense Supply Agency will operate the Referral computer facility and will:

(1) Design and operate an automated system to provide for military personnel retiree registration, receipt and handling of employer queries, matching of retiree skills and preferences against job

opportunities, and the printout and dispatch of appropriate names and brief résumés to prospective employers.

(2) Manage the automated system, provide machine services and provide technical guidance and issue procedural instructions to users of the system.

(3) Make recommendations to the Assistant Secretary of Defense (Manpower and Reserve Affairs) or his designee on overall policies and on operational procedures for improving the Referral Program.

(4) Make periodic reports (see enclosures 1 and 2) 1 to the Assistant Secretary of Defense (Manpower and Reserve Affairs) or his designee on the program's progress and accomplishments.

(5) Budget and allocate adequate dollar and manpower resources for the tasks assigned in subparagraphs (1) through (4) of this paragraph.

§ 96.4 Eligibility.

(a) All military personnel in the last 6 months of active duty service other than reservists serving 6 months active duty under section 511(d), title 10, United States Code, and military personnel to be separated for disciplinary reasons are eligible for transition. However, the priority of the military mission and the priorities set forth under § 96.5 shall govern the release of individuals for purposes of attending training and education courses during active duty hours.

(b) Any active duty member of the Armed Forces who volunteers for participation in Referral prior to release from active duty shall be eligible for participation in Referral upon:

(1) Completion of the required length of service established by statute for entitlement to retired military pay, and six (6) months prior to completion of such duty.

prior military service who enlist or have enlisted in one of the Reserve components under the provisions of 10 U.S.C. 511, 32 U.S.C. 302, or section 262, Reserve Forces Act of 1955, as amended, are expected to participate and perform satisfactorily as a member of the Ready Reserve in fulfillment of their obligation and/or agreement and in accordance with the standards prescribed in Parts 101 and 102 of this subchapter and by the Military Department concerned.

(2) It is the responsibility of the Secretaries of the Military Departments concerned to insure to the maximum extent practicable that applicants for enlistment in the Reserve components understand prior to their enlistment the obligations and requirements as members of the Ready Reserve for satisfactory participation, and for active service in the event of mobilization.

(b) Compliance measures for unsatisfactory participation. (1) Members of the Ready Reserve who (i) fail, or are unable, to participate satisfactorily in units of the Ready Reserve, (ii) have not fulfilled their statutory reserve obligation, and (iii) have not served, on active duty or active duty for training for a total of 24 months will be ordered to active duty under the provisions of 10 U.S.C. 673a and Executive Order 11366.

(2) A member of the Ready Reserve ordered to active duty under these provisions may be required to serve on active duty until his total service on active duty or active duty for training equals 24 months.

(3) Where the enlistment or period of military service of a member of the Ready Reserve ordered to active duty under the provisions of 10 U.S.C. 673a and Executive Order 11366 expires before he has served the prescribed period of active duty, the enlistment or period of military service may be extended until his obligated active duty service has been completed.

(4) Orders will be mailed to a reservist when he is in an unsatisfactory participation status, if the reservist is not locatable by the usual personal visit or when attending scheduled drills.

(i) Orders mailed to a reservist will be sent via certified or registered mail. The individual who mails the orders will prepare a Sworn Affidavit of Service by Mail (see attached format 1) which will be im

mediately inserted in the reservist's personnel file along with the receipt for registered or certified mail.

(ii) Notification shall be fully and sufficiently accomplished through the mailing of the orders to the reservist concerned at the mailing address which the records (of the activity mailing the orders) indicate to be the most recent one furnished by that individual as an address at or from which official mail will be received by or forwarded to him. Absence of indication of delivery, or return as undeliverable, of orders addressed as above is immaterial as respects its efficacy as notice to or notification of the reservist concerned.

(iii) If, on the appointed date, the individual does not report to the command to which he has been ordered, he will then become an "unauthorized absentee" and the normal procedures for handling unauthorized absences should be followed. As an alternative, if such action is not considered feasible, he may be certified to Selective Service for priority induction as provided by paragraph (d) (2) of this section.

(5) It is the responsibility of each member of the Ready Reserve to assure that all organizational records pertaining to him reflect an accurate and current mailing address where he can be reached.

(c) Exceptions. As exceptions to the policies in paragraph (b) of this section, individuals who do not, or are unable to, participate satisfactorily in units of the Selected Reserve for any of the following reasons will be processed as indicated:

(1) Except as provided in paragraph (c) (3) and (4) of this section, individuals eligible for discharge from the Reserve components for dependency, hardship, or other cogent reasons authorized by regulations of the Military Department concerned will, upon application, be discharged.

(2) Individuals unable to participate in a unit of the Selected Reserve by reason of action taken by the Military Department concerned (e.g., unit inactivation or relocation), to the effect that they reside beyond a reasonable commuting distance as defined in § 100.2(c) of a Reserve unit, will be assigned to the Individual Ready Reserve until they are able to rejoin or be assigned to another Reserve unit, or become eligible for transfer to the Standby Reserve or discharge upon completion of their obligation.
