Bank, the literary fund stock, and dividends on the same, in the Bank of the state of Mississippi, as soon as the same or any part thereof shall be paid off, or become due and payable, and he shall also semi-annually subscribe as stock in said bank, all other moneys which may be received in the treasury on account of the literary fund.

AN ACT to fix by law the time of the meeting of the Legislature of the State of Mississippi. .

Be it enacted by the Legislature of the state of Mississippi, That from and after the passage of this act, the biennial sessions of the legislature shall commence on the first Mondays in January, any law or usage to the contrary notwithstanding.

AN ACT to repeal part of the twenty-first section of the twentyseventh chapter of the Revised Code.

Be it enacted by the Legislature of the state of Mississippi, That so much of the twenty-first section of the twenty-seventh chapter of the revised code of the state of Mississippi, as requires the sheriff to advertise in a newspaper the sale of personal property, except in the case of executions levied on slaves, be and the same is hereby repealed.

SEC. 2. Be it further enacted, That this act shall not apply to the county of Adams and the county of Warren. Approved, December 9, 1833.

AN ACT to extend the provisions of an act entitled 'an act to prevent the damages which may happen by the firing of woods, marshes, and prairies,' approved February 16, 1828.

Be it enacted by the Legislature of the state of Mississippi, That the provisions of the first five sections of the above recited act shall extend to and be in force in the county of Pike.

AN ACT to direct the mode of publishing the Acts of the Legislature.

Be it enacted by the Legislature of the state of Mississippi, That the secretary of state shall hereafter so cause the acts of the legislature to be copied and delivered to the public printer, and the public printer shall so print, and bind, and publish the same, that the acts of a public and general nature shall be bound together in uninterrupted connection, and have an index attached thereto; and those acts that are of a private or local nature, shall be bound together in like manner, with a separate index attached to them: Provided, they may be all contained in the same volume.

AN ACT in relation to the Boards of County Police of the several counties of this State.

Be it enacted by the Legislature of the state of Mississippi, That the boards of county police of the several counties in this state be, and they are hereby authorized and requested to make such an allowance to the clerks of said boards for extra services, as the said boards may in their discretion think proper to make, payable out of the county treasuries of said counties, any law or laws to the contrary notwithstanding.

AN ACT further to provide for the collection of the Revenue of the
State of Mississippi.

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That it shall be the duty of the assessor Duty of and collector of taxes in each and every county in this state, and where any of the banks or branches of the same, subject to taxation may be located, to assess and collect of said bank or their branches in his county, a tax of one-fourth per cent. on the capital stock subscribed for on the books of said bank or their branches.

SEC. 2. And be it further enacted, That whenever any assessor or collector shall have funds belonging to the state, and shall hold the same after the commencement of the fiscal year of each year, then shall pay the legal interest on the same.

SEC. 3. And be it further enacted, That it shall also be the duty of the assessor and collector of taxes, in like manner, to assess and collect all taxes which any insurance office or other bodies corporate may by law be liable to pay.

SEC. 4. And be it further enacted, That it shall be the duty of the collector to levy one-fourth per cent. on all sums insured in this state by foreign insurance offices located within this state; and that it shall be the duty of the agent to present, on oath, to the assessor, the amount so insured.

Duties of justices, sheriffs, and

AN ACT allowing fees to Sheriffs and Constables in certain cases.

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That in all cases where any person shall be charged with having committed any felony or other misconstables. demeanour before any justice of the peace, it shall and may be lawful for the said justice to require the sheriff of the county, or any constable, to take and execute forthwith the warrant of arrest, mittimus, or other process in the case. And if any sheriff or other officer shall refuse to take and execute any such process, when thereto required by said justice, it shall be deemed a contempt of the penal laws of the country, and it shall and may be lawful for the said justice to enter a fine of five dollars against every such officer so refusing, and to issue executions thereon; which sum, when collected, shall be paid into the county treasury by such justice.

SEC. 2. And be it further enacted, That in all cases when any such officer shall execute any such warrant of sheriffs and arrest and bring the offender to trial before the said justice, he shall be entitled to receive the sum of three dollars for every such arrest on any such criminal charge, and shall

be entitled to demand and receive a certificate from the justice of the peace that such service hath been performed; which certificate, signed by said justice, shall entitle the said officer to receive from the county treasury the said sum of three dollars, and shall moreover be entitled to, and receive the fees now allowed by law for executing a mittimus or other process in any such case as is provided for by this act.

SEC. 3. And be it further enacted, That in every case where there shall be judgment against any such offender so arrested, it shall be the duty of the justice of the peace justices. or court trying every such offender, to tax the sum of three dollars for the arrest as an item in the bill of costs, which shall be collected of such convicted offender as other costs are by law collected, and shall be paid into the county treasury by the justice, sheriff, or other officer receiving the same, who shall be entitled to the county treasurer's receipt therefor.

SEC. 4. And be it further enacted, That this act shall take effect and be in force from and after the passage thereof, and shall be only applicable to the counties of Adams, Covington, Pike, Hinds, Marion, and Rankin.

AN ACT to attach a part of the county of Washington to the county of Yazoo, and for other purposes.

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That all that tract of country situate and being in range two west, and west of Yazoo river, in townships number fourteen, thirteen, twelve, and eleven, be, and the same is hereby attached to, and shall be a part of the county of Yazoo, and that the present boundary line between the counties of Yazoo and Warren be changed so as to commence on the Big Black river at the present boundary line, and from that point, run west till it strikes the Yazoo river at the mouth of Little Sun Flower or Bears lake, in township nine, range five west, and the tract of country situate to the south of said line is hereby attached to Warren county.

SEC. 2. And be it further enacted, That this act shall take effect and be in force from and after the day of its passage.

Clerk of

AN ACT for the relief of the Clerk of the High Court of Errors and
Appeals, and for other purposes.

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That until otherwise provided, the clerk of errors and the High Court of Errors and Appeals, and the clerk of the the Superior Court of Chancery, be, and they are hereby, required to procure suitable offices for the safe keeping of the papers and records belonging to their respective courts; and that the auditor of public accounts shall, upon the approval of the presiding judges of said courts respectively, issue his warrant upon the state treasury for any expenses incurred by them in procuring the same.

SEC. 2. And be it further enacted, That the auditor of public accounts shall also, upon the allowance of the president of the High Court of Errors and Appeals, issue his warrant upon the state treasury for the amount of any expenses incurred by the clerk of said court, in removing the papers thereof from the city of Natchez to the town of Jackson.
