sum of fifteen dollars; or to convey merchandise in a boat, or other water craft, the sum of twenty dollars.

SEC. 2. And be it further enacted, That if any such Penalty licensed pedlar shall be found peddling out of said counties, such person, so offending, shall be subject to the penalty now imposed by law for peddling without license. SEC. 3. And be it further enacted, That all laws contravening the provisions of this act, be, and the same are hereby repealed.

AN ACT, to alter the time of holding the Orphans' Court and Probate Court of the county of Franklin.

SEC. 1. Be it enacted by the Senate and House of Representatives of the state of Mississippi, in General Assembly Orphans' convened, That from and after the first day of March next, court, when held. the regular terms of the orphans' court of the county of

court.

Franklin shall be held on the third Monday in each and every month, and may sit the number of days now allowed by law, if business shall so long require.

SEC. 2. And be it further enacted, That from and after County the first day of March next, the regular terms of the county and probate court of the county of Franklin, shall be held on the second Monday in February, May, August and November, in every year, and may sit the number of days now allowed by law, if business shall so long require.

SEC. 3. And be it further enacted, That all acts and parts of acts coming within the purview of this act, shall be, and the same are hereby repealed.

AN ACT, to levy a special tax in the counties therein named, and for

other purposes.

SEC. 1. Be it enacted by the Senate and House of RepreSpecial tax Amite sentatives of the state of Mississippi, in General Assembly county. convened, That the county court of Amite county is hereby

authorized to levy a special tax for the purpose of repairing the jail of said county, or build a new jail, whenever said court may deem it expedient, in a sum not exceeding one half of the state tax, per annum, until a sufficient sum of money be raised to accomplish said purpose.

SEC. 2. And be it further enacted, That it shall be the duty of the assessor and collector of said county to give bond, with approved security, to the judge of probate of bond. said county and his successors in office; conditioned for the faithful performance of said duties of assessing, collecting and paying over said money thus assessed and collected into the county treasury, who shall be entitled to receive the same per cent. as is allowed for collecting the state

SEC. 3. And be it further enacted, That the county and probate court of the county of Rankin be, and the said Special tax court is hereby authorized to levy a special tax for the in Rankin year eighteen hundred and thirty, equal to one-half of the county. state tax, on all persons and property in said county subject to taxation, to be appropriated in such manner as the said court may direct, and it shall be the duty for the collector of taxes of said county to pay over the same, on the order of said court, at the time and under the penalties prescribed by law for the payment of the state tax, into the state treasury.

SEC. 4. And be it further enacted, That the county court Do. in of the county of Washington be, and said court is hereby Washingauthorized to levy and cause to be collected, a special tax ton county. on all taxable persons and property in said county, for the years eighteen hundred and thirty and thirty-one, not exceeding the amount of the state tax, for the purpose of erecting a jail for said county; which shall be collected in the manner and at the same time that the state and county tax is collected, for which he shall receive the same compensation as for collecting the state and county tax.

SEC. 5. And be it further enacted, That the assessor and collector of said county shall enter into an additional bond, with good and sufficient securities, payable as his other bond, in a penal sum of one thousand dollars for the faithful performance of the duties aforesaid, and it shall be his duty

to pay the tax aforesaid, when collected into the county treasury, subject to the order of the commissioners appointed to superintend public buildings, who are hereby authorized to draw for the same and apply it to the erection of a jail for said county: provided, nothing herein contained shall be so construed as to authorize the payment of a greater sum for collecting than is allowed for collecting the county tax.

SEC. 6. And be it further enacted, That the county court of Jones county is hereby authorized and required, at their first or second regular term after the passage of this act, to levy a special tax on the said county of Jones, not exceeding thirty-seven and one-half per cent. on the amount of the state tax, and to be assessed on all persons and property subject to taxation, to be collected by the tax collector of said county, and by him paid over to the county treasurer of said county; which amount when so collected, shall be applied to the discharge of county debts.

SEC. 7. And be it further enacted, That the county court shall make a reasonable allowance to the said collector for his services for collecting said special tax, not exceeding three per cent.

SEC. 8. And be it further enacted, That the county court of Green county is hereby authorized, at their discretion, at their first or some subsequent term of said court after the passage of this act, to levy a special tax on all persons and property within their county subject to taxation, not exceeding one-fourth part of the state tax, to be assessed and collected by the assessor and collector of said county, and by him paid into the county treasury of his county; which amount, when so collected, shall be subject to the order of the presiding justice of the aforesaid county of Green, for the purpose of repairing the court-house and jail thereof.

SEC. 9. And be it further enacted, That the assessor and collector of said county shall assess and collect said special tax, give bond with approved security, in the penal sum of two hundred dollars, payable to the presiding justice and his successors in office; conditioned that he will faithfully assess and collect and pay into the county treasury all

moneys so assessed and collected on or before the first day of January next.

SEC. 10. And be it further enacted, That it shall be the duty of said county court to allow the assessor and collector aforesaid, reasonable compensation for the services by him rendered in assessing and collecting said special tax, not exceeding five per cent.

SEC. 11. And be it further enacted, That the county court. of Perry county is hereby authorized at their first, or some subsequent term of said court, after the passage of this act, county. to levy a special tax, not exceeding twenty-five per cent. on the state tax, on all persons and property subject to taxation in said county, to be assessed and collected by the assessor and collector of said county, and when so collected, by him to be paid to the county treasurer of his county, on or before the first day of December next, and shall be applied to the discharge of county debts.

SEC. 12. And be it further enacted, That the assessor and collector aforesaid, shall enter into bond and sufficient security, to be approved by the presiding justice of said county; conditioned for the faithful performance of his duty as by this act required.

SEC 13. And be it further enacted, That it shall be the duty of the county court to allow the assessor and collector aforesaid, reasonable compensation for the services by him rendered in assessing and collecting said special tax, not exceeding five per cent.

And be it further enacted, That the county court of Copiah county is hereby authorized and required, Do. in at their first or second regular term after the passage of this Copiah act, to levy a special tax on the said county of Copiah, not exceeding one half of the state tax, and to be assessed and collected on all persons and property subject to pay a state tax, to be collected by the tax collector of said county, and by him to be paid over to the county treasurer of said county; which amount, when so collected, shall be appropriated to the discharge of debts of the county; those for the building and repairing the court-house and jail of said county in preference.

SEC. 15. And be it further enacted, That the collector of said county shall give bond and security to be approved of by the presiding justice of said county, payable to the presiding justice of said county and his successors in office; conditioned that he will collect and pay over the said money at the time they are required to pay the state tax into the state treasury:

SEC. 16. And be it further enacted, That the collector shall receive the same per centum for collecting the said tax as he is entitled to for collecting the state tax.

SEC. 17. And be it further enacted, That the county and probate court of the county of Simpson, be, and the said court is hereby authorized to levy a special tax for the year one thousand eight hundred and thirty, on all persons and property in said county, subject to taxation under the existing laws, sufficient to meet the sum due for the building of the court-house and jail, which shall be collected in the same manner as is prescribed by law for collecting the county and state tax, whose duty it shall be to pay over the same to the contractor or contractors for the building of the court house and jail on the order of the commissioners for the erection of public buildings, signed by all of the said commissioners and accompanied by a certificate that the said building or buildings have been completed according to contract, and received by the said commissioners.

SEC. 18. And be it further enacted, That it shall be the duty of the tax collector of said county of Simpson to give bond and security in the same manner, and shall receive the same compensation as is prescribed in the act, entitled 'an act to establish a permanent seat of justice for the county of Simpson,' and in case of the failure of the collector to pay over the money collected by virtue of this act, the commissioners, in their corporate capacity, shall have the same remedy against him as is given to the auditor of public accounts in similar cases.

SEC. 19. And be it further enacted, That in addition to the may powers vested in John Freeman, by the third section of in the sixty-eighth chapter of the acts of eighteen hundred certain and twenty-nine, he is hereby authorized to make any
