SEC. 7. Section 622 of title 38, United States Code,

2 is amended by inserting “(a)” immediately before the 3 first sentence and by adding at the end thereof the follow

4 ing new subsection:

“(b) Notwithstanding the provisions of subsection (a)

6 of this section, the Administrator may not require any state

7 ment under oath from an applicant referred to therein who 8 is seventy years of age or older for the purpose of determin

9 ing inability to defray necessary expenses, and such appli

10 cant shall be deemed to be unable to defray the expenses

11 of necessary hospital or domiciliary care.”

SEC. 8. This Act shall take effect on January 1, 1969.

referred to the Committee on Veterans' Affairs

A BILL To amend chapter 1, title 38, United States Code, to provide a

statutory presumption of service-connected death of any veteran who has been rated totally disabled by reason of service

connected disability for twenty or more years. 1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That chapter 1 of title 38, United States Code, is amended

4 to read as follows:

5 " 113. Presumption of service-connected death

“For the purposes of chapters 11 and 13 of this title, 7 any veteran in receipt of or entitled to receive compensation 8 at the time of death for a service-connected disability rated 9 permanently and totally disabling for twenty or more years,

1 his death by any reason except willful misconduct, shall be

2 deemed service-connected. The standards and criteria for

3 determining whether or not a disability is service-connected 4 shall be those applicable under chapter 11 of this title.”
