1 SEC. 7. Section 622 of title 38, United States Code, 2 is amended by inserting "(a)" immediately before the 3 first sentence and by adding at the end thereof the follow4 ing new subsection:

"(b) Notwithstanding the requirements of subsection 6 (a), the receipt of pension under chapter 15 of this title 7 shall be accepted as sufficient evidence of inability to defray 8 necessary expenses, and an applicant in receipt of such 9 pension shall be exempt from executing a statement under 10 oath."

11 SEO. 8. This Act shall take effect on January 1, 1969.

A BILL

To revise the definition of a "child" for purposes of veterans' benefits provided by title 38, United States Code, to recognize an adopted child as a dependent from the date of issuance of an interlocutory decree.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That subsection 101 (4) of title 38, United States Code, 4 is amended by adding at the end thereof the following 5 sentence:

6 "A person with respect to whom an interlocutory de7 cree of adoption has been issued by an appropriate adoption 8 authority shall be recognized thereafter as a legally adopted

9 child, unless and until that decree is rescinded: Provided,

1 That the child remains in the custody of the adopting parent

2 or parents during the interlocutory period."

A BILL

To amend title 38, United States Code, to liberalize the conditions under which the Administrator of Veterans' Affairs is required to effect recoupment from disability compensation otherwise payable to certain disabled veterans.

Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That chapter 11 of title 38, United States Code, is amended 4 by adding the following new section at the end thereof:

5 "§ 361. Payment of disability compensation in disability

7 "The deduction of disability severance pay from dis

8 ability compensation, as required by section 1212 (c) of title

9 10, United States Code, shall be made at a monthly rate not

1 in excess of the rate of compensation to which the former

2 member would be entitled based on the degree of his disability

3

as determined on the initial Veterans' Administration

4 rating."
