SEC. 12. Section 103 of this title is amended by strik6 ing out subsection (d) and by redesignating subsection 7 "(e)" as subsection "(d)".

8 SEC. 13. (a) Except for section 9, this Act shall take 9 effect on the first day of the first calendar month which be10 gins after the date of its enactment.

11 (b) Section 9 of this Act shall apply with respect to 12 increases in monthly rates of pension or dependency and 13 indemnity compensation payable under title 38, United 14 States Code, or the first sentence of section 9 (b) of the 15 Veterans' Pension Act of 1959 for months in and after the 16 second calendar quarter beginning after the date of the 17 enactment of this Act.

To amend title 38, United States Code, to provide survivor benefits for military career personnel.

Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That section 410 (a) of title 38, United States Code, is 4 amended to read as follows:

5 "(a) When any veteran dies after December 31, 1956, 6 from a service-connected or compensable disability, the 7 Administrator shall pay dependency and indemnity com8 pensation to his widow, children, and parents. The stand9 ards and criteria for determining whether or not a disability 10 is service connected shall be those applicable under chapter 11 11 of this title: Provided, however, That, for purposes of

1 this section and chapter 11, a veteran entitled to the re2 ceipt of retired or retainer pay at the time of his death 3 shall, if such entitlement to retired or retainer pay is 4 based upon either twenty or more years of active military 5 service or service-connected disability rated at 50 per centum 6 or more, be conclusively presumed to have died of a service7 connected disability."

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That the Administrator of Veterans' Affairs may not, in the 4 administration of the provisions of title 38, United States 5 Code, or of any other veterans' benefit law with respect to 6 pension or disability or indemnity compensation, require a 7 report, statement, or any other form of declaration with

age of seventy-two years, if such person continuously re10 ceived pension or disability or indemnity compensation under
