§ 249.14 Effective date.

The retention requirements prescribed in this subpart shall be applicable to all records which were in the custody of any air carrier, subject to its provisions, on June 10, 1961, as well as to all records subsequently acquired. With respect to individual records, each retention period herein prescribed shall commence upon the date when the records are created or otherwise come into the possession of the air carrier.

Subpart B-[Reserved]

Subpart C-Truth in Lending Act and
Regulations Thereunder

§ 249.30 Applicability.

This subpart is applicable to all air carriers and foreign air carriers as defined in section 101 of the Federal Aviation Act of 1958, including, without limitation, direct carriers, air taxi operators authorized under Part 298 of

this chapter, indirect air carriers authorized under Parts 296 and 297 of this chapter, tour operators authorized under Part 378 of this chapter, and foreign air carriers holding permits pursuant to section 402 of the Act to engage in indirect foreign air transportation.

§ 249.31 Preservation and inspection of evidence of compliance.

Evidence of compliance with the requirements imposed under Regulation Z of the Board of Governors of the Federal Reserve System (12 CFR Part 226), implementing the provisions of Title I (Truth in Lending Act) and Title V (General Provisions) of the Consumer Credit Protection Act (Pub. L. 90-321; 82 Stat. 146 et seq.), insofar as they pertain to air carriers and foreign air carriers, other than advertising requirements under § 226.10 of Regulation Z, shall be preserved by the carrier for a period of not less than 2 years after the date each disclosure is required to be made. Each carrier shall permit the Board's authorized representatives to inspect its relevant records and evidence of compliance with 12 CFR Part 226.

§ 250.1 Definitions.

For the purposes of this part:

"Airport" means the airport at which the direct or connecting flight, on which the passenger holds confirmed reserved space, is planned to arrive or some other airport serving the same metropolitan area that is served by the former, provided that transportation to the other airport is accepted (i.e., used) by the passenger.

"Carrier" means (a) an air carrier, except a helicopter operator, holding a certificate issued by the Board pursuant to sections 401(d)(1), 401(d)(2), 401(d)(5), or 401(d)(7) of the Act, authorizing the transportation of persons, or (b) a foreign route air carrier holding a permit issued by the Board pursuant to section 402 of the Act authorizing the transportation of per

sons.

"Comparable air transportation" means transportation provided by air carriers or foreign air carriers holding certificates of public convenience and necessity or foreign permits issued by the Board.

"Confirmed reserved space" means space on a specific date and on a specific flight and class of service of a carrier which has been requested by a passenger and which the carrier or its agent has verified, by appropriate notation on the ticket or in any other manner provided therefor by the carrier's tariff, as being reserved for the accommodation of the passenger, except that "confirmed reserved space" shall
